ORDINANCE NO. 282
AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, MAKING IT UNLAWFUL
TO MOVE ANY PORTABLE BUILDING ONTO ANY LOT WITHIN ANY COMMERCIAL,
LOCAL RETAIL OR INDUSTRIAL DISTRICT WITHIN TIlE CITY; PROVIDING
EXCEPTIONS WHERE SPECIAL PERMIT IS OBTAINED FOR TEMPORARY LOCATION
OF PORTABLE BUILDINGS IN SUCH AREAS; PROVIDING A REPEALING CLAUSE;
PROVIDING A SEVERABLIITY CLAUSE; PROVIDING FOR A PENALTY OF FINE NOT
TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE
AND DECLARING AN EFFECTIVE DATE.
BE IF ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS:
SECTION 1. PORTABLE BUILDINGS UNLAWFUL IN CERTAIN AREAS
Except as herein provided, it shall be unlawful for any person to move
any portable building on to any lot within any area of the City which is zoned Local
Retail, Commercial, or Industrial. As used herein a portable building shall mean any
wall and roof type structure intended for occupancy or storage use which is in excess
of ~ C! square feet and does not have a permanent foundation system.
SECTION 2. SPECIAL TEMPORARY PERMIT
The City Council may, on motion froin the property owner, grant a
temporary permit for the location of such a portable building within such areas of the
City on special conditions as may be set by the Council to insure that such use is
temoprary and will not have adverse effects on adjacent property.
SECTION 3. REPEALING CLAUSE
All ordinances, or parts of ordinances, inconsistent or in conflict with the
provisions of this ordinance are hereby repealed, but, any ordinance or part of an
ordinance not inconsistent or in conflict shall not be repealed.
SECTION 4. SEVERABILITY CLAUSE
If any article, paragraph or subdivision, clause or provision of this ordinance
shah be adjudged invalid or held unconstitutional, the same shall not affect the validity
of this ordinance as a whole or any part or provision thereof, other than the part so
decided to be invalid or unconstitutional
SECTION 5. PENALTY CLAUSE
Any person, firm or corporation violating any of the provisions of this ordinance
shall be deemed guilty of a misdemeanor and, upon conviction, shall be punished by a
penalty of fine not to exceed the sum of Two Hundred Dollars ($200.00) for each offense,
and each and every day such offense is continued shah constitute a new and separate
offense.
SECTION 6. EFFECTIVE DATE
This ordinance shall take effect immediately froin and after the publication of
its caption, as the law in such cases provides.
