OR 98-847 Residential permit parking on Copperstone Trail & Copperstone Court AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 98847 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING THE CODE OF ORDINANCES BY AMENDING CHAPTER 8, TO ADD ARTICLE 8-7 TO PROVIDE FOR RESIDENTIAL PERMIT PARKING; PROVIDING DEFINITIONS; PROHIBITING THE PARKING OF MOTOR VEHICLES WITHIN A RESIDENTIAL PERMIT PARKING ZONING WITHOUT DISPLAYING A VALID PERMIT ON THE VEHICLE; PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS {$200.00) FOR EACH OFFENSE; AND PROVIDING AN EFFECTIVE DATE. BE 1T ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS. SECTION 1. That the Code of Ordinance of the City of Coppell, Texas be, and the same is hereby amended by amending Chapter 8, in part to add Article 8-7 Residential Permit Parking to read as follows: "ARTICLE 8-7 RESIDENTIAL PERMIT PARKING Sec. 8-7-1 Purpose The purpose of this article is to promote the health, safety, welfare of the citizens of the City of Coppell, Texas by addressing the problems that arise where streets are used for parking motor vehicles by persons using adjacent property, but who did not reside in the neighborhood. The establishment of residential permit parking zones will reduce these problems, which include but are not limited to, hazardous traffic conditions, limited emergency vehicle access, air and noise pollution, and inability of the residents to obtain easy access to and adequate parking near the residences. Sec. 8-7-2 Definitions The following terms and phrases as used in this article shall have the following meanings unless the context indicates otherwise: I SS19682 Residential Permit Parking Zone means a designated on-street space within the City where only resident motor vehicles displaying a valid permit may stop, stand, or park. Permit means a residential parking permit issued by the City under this article. Sec. 8-7-3 Designation of Residential Permit Parking Zones The City Engineer may, tiom time-to-time, designate residential permit parking zones on the streets described herein, at locations the City Engineer determines necessary, to provide for the parking needs of the applicable residents. Typically, these zones will be designated only in areas where citizens routinely park on residential streets to attend activities associated with adjacent properties including but not limited to parks. The City Engineer shall conspicuously post signs within each zone indicating the times and conditions for which parking is by permit only. A residential permit parking zone becomes effective five working days after signs are in place in the zone. A. Copperstone Trail; B. Copperstone Court. Sec. 8-7-4 Residential Parking Permit A. The City Engineer shall, upon application and payment of a permit fee established by resolution of the City Council fi-om time to time, issue a residential parking permit to any person who is eligible for the permit. A person is eligible for a residential parking permit if the person: 1. owns a motor vehicle; 2. resides within the designated district; and 3. has no unresolved parking citations issued by the City. B. Application for a permit must contain: 1. name, home address, and Texas drivers license number of the owner of the motor vehicle to be parked in a residential permit parking zone; 2. the make, model, registration, and license plate number of the motor vehicles to be parking in a residential permit parking zone; and 3. any other information the City Engineer determines necessary to the enforcement and administration of this article. 2 SS19682 C. To prove residency and to verify the contents of the application, an applicant shall present at the time of application: 1. a valid Texas motor vehicle registration for the motor vehicle to be parked in a residential permit parking zone, showing the applicants current home address; 2. a valid Texas drivers license of the applicant showing the applicant's current home address; 3. a residential utility bill acceptable to the City Engineer, showing the applicant's current home address; and 4. proof of automobile liability insurance in at least the minimum amount required by the Texas Safety Responsibility Act as amended. D. When a motor vehicle is parked in a residential permit parking zone, the permit must be conspicuously displayed in a manner and location approved by the City Engineer. E. A permit authorizes the holder to stop, stand, or park a motor vehicle at any time in a residential permit parking zone, unless such stopping, standing or parking is prohibited or restricted by regulations other than those established under this article. F. A permit is not transferable from one vehicle to another. G. A permit expires one year from the date of issuance and may be renewed by applying in accordance with this article. H. Lost or stolen permits may be replaced by payment of the applicable replacement fee provided the permit holder signs an affidavit stating that the permit was lost or stolen and not transferred to another vehicle. See. 8-7-5 Residential Parking Permit Exemptions A. Vehicles operated for public service (garbage pick up, street repair, water service, police, fire, public utilities) or providing repair or maintenance service, loading or unloading goods, wares, or merchandise are exempt from the provisions of this Article. B. Each resident shall be issued a maximum of two visitor permits per household for the parking of motor vehicles in an adjacent residential permit parking zone by bona fide visitors to the 3 ss19682 residence. It shall be the responsibility of the resident to ensure that a visitor properly displays the visitor permit on the parked vehicle during the visit to the residence. Visitor permits shall be subject to Sec. 8-74 H C. Residents that know in advance that they will be hosting an event at their residence that requires additional visitor permits for a specific date, may apply to the City Engineer for additional visitor permits valid for the day of the event only to accommodate anticipated visitors. Sec. 8-7-6 Offenses; Permit Ratification A. A person commits an offense if the person: 1. stops, stands, or parks a motor vehicle in a residential permit parking zone without displaying a valid permit on the vehicle as required by this article at the times when the stopping, standing, or parking the vehicle without displaying a residential permit is prohibited. 2. displays a permit on a motor vehicle other than the one for which the permit was issued, except for authorized visitor permits; or 3. falsely represents themselves as being eligible for a residential parking permit, submits false documents, or otherwise makes a false statement of material fact on an application for a permit. B. The City Engineer may revoke the residential parking permit of any person who: 1. violates subsection (A) of this section; 2. has an unresolved parking citation issued by the City; Or 3. stops, stands or parks a motor vehicle in a residential permit parking zoning without: (a) a valid Texas license plate; (b) a valid inspection sticker; and (c) automobile liability insurance coverage in at least the minimum amounts required by the Texas Safety Responsibility Act, as amended." 4 SS19682 SECTION2. That all provisions ofthe Code of Ordinances ofthe City ofCoppell, Texas, in conflict with the provisions of this ordinance be, and the same are hereby, repealed, and all other provisions not in conflict with the provisions of this ordinance shall remain in full force and effect. SECTION 3. That should any word, phrase, paragraph, section or phrase of this ordinance or of the Code of Ordinances, as mended hereby, be held to be unconstitutional, illegai or invalid, the same shall not affect the validity of this ordinance as a whole, or any part or provision thereof other than the part so decided to be unconstitutional, illegal or invalid, and shall not affect the validity of the Code of Ordinances as a whole. SECTION 4. An offense committed before the effective date of this ordinance is governed by prior law and the provisions of the Code of Ordinances, as amended, in effect when the offense was committed and the former law is continued in effect for this purpose. SECTION 5. That any person, firm or corporation violating any of the provisions or terms of this ordinance or of the Code of Ordinances, as amended hereby, shall be guilty of a misdemeanor and upon conviction in the Municipal Court of the City of Coppell, Texas, shall be subject to a fine not to exceed the sum of Two Hundred Dollars ($200.00) for each offense, and each and every day such violation is cominued shall be deemed to constitute a separate offense. SECTION 6.
