Presentation:

with the cost of going forward and obtaining a copy of the record and the
legal costs that would be incurred, we were able to negotiate a settlement
for the City of approximately $75,000.00. In analyzing this, the cost to
continue to fight this matter through the appellate stage would far
exceed the amount to settle this case and have it over with forever.
Action:
Mayor Pro Tem Wheeler moved to settle all outstanding issues in the
Sowell vs. City of Coppell case in an amount not to exceed $75,000.00
and authorize the City Manager to sign any necessary documents
relating to settlement of this case even though the Federal Court has
ruled in our favor on all counts, and to prevent the City from incurring
further costs related to a possible defense of this lawsuit and the time
devoted by staff, the Mayor, and Council, copying, computer time, etc.
