CM 2001-01-23MINUTES OF JANUARY 23, 2001 The City Council of the City of Coppell met in Regular Called Session on Tuesday, January 23, 2001, at 6:00 p.m. in the in the Library Meeting Room of William T. Cozby Public Library, 177 N. Heartz, Coppell, Texas. The following members were present: Candy Sheehan, Mayor Larry Wheeler, Mayor Pro Tem Greg Garcia, Councilmember Jayne Peters, Councilmember Diana Raines, Councilmember Marsha Tunnell, Councilmember Doug Stover, Councilmember Bill York, Councilmember Also present were City Manager Jim Witt, City Secretary Libby Ball and City Attorney Robert Hager. 1. Call to order. Mayor Sheehan called Session. the meeting to order and adjourned into Executive EXECUTIVE SESSION (Closed to the Public) Convene Executive Session A. Section 551.074, Texas Government Code - Personnel Matters. 1. City Manager Evaluation. B. Section 551.071, Texas Government Code - Consultation with City Attorney. 1. Sowell vs City of Coppell Mayor Sheehan convened into Executive Session at 6:10 p.m. as allowed under the above-stated article. Mayor Sheehan adjourned the Executive Session at 6:25 p.m. and opened the Work Session. CM01232001 Page 1 of 8 WORK SESSION (Open to the Public) Convene Work Session A. B. C. Review of Comprehensive Annual Fiscal Report. Review Baseball Association Business Plan. Discussion concerning the City of Coppell Infrastructure Maintenance Fund in regards to potential projects and disbursement of funds. Discussion regarding Coppell Celebrates "Pigfest." Discussion of Agenda Items. 4. Invocation. Pastor Wayne McDonald, Metrocrest Community Church, led those present in the Invocation. 5. Pledge of Allegiance. Mayor Sheehan led those present in the Pledge of Allegiance. Mayor Sheehan welcomed Troop 829 who were working on their badges. 6. Report by the Coppell Economic Development Committee. Bill Rohloff, Chairman, Coppell Economic Development Committee, made a presentation to Council. Presentation of plaque from Coppell High School Band Officers to City of Coppell. The following Coppell High School Band members presented an appreciation plaque to the City: Andrew Straight, President; Nell Wiersum, Vice President; Justin Rich, Historian; and Martin Hechanova, Freshman Representative CM01232001 Page 2 of 8 Consider approval of a Proclamation naming the month of January SCHOOL BOARD APPRECIATION MONTH, and authorizing the Mayor to sign. Mayor Sheehan read the Proclamation for the record and presented the Proclamation to the following: Carrollton-Farmers Branch ISD John Tepper, Board President Coppell ISD Dianne Miller Deena Reeves, Board President Cindy Warner Issues Discussed: Deene Reeve, Coppell ISD, discussed the changing financial positions of the school districts. The Coppell ISD School Board invited citizens in the community to participate in a public awareness and public input process. The forums will be held every Tuesday, Wednesday and Thursday evening at 7:15 p.m. for the next three weeks, at the Coppell High School Lecture Hall. The School Board will explain the Robin Hood process, and funding and participants will be able to participate in an on-line survey that will help the Board as they establish a budget for next year. Mr. Tepper, Carrollton-Farmer's Branch ISD, discussed how excited they are to have the new Riverchase Elementary School open in Coppell. They will also be having some public forums at Creekview High School and R.L. Turner High School in the upcoming weeks regarding citizen input on the budget issues, Chapter 41 and anything else that is on the citizens minds. Action: Councilmember Tunnell moved to approve the Proclamation naming the month of January SCHOOL BOARD APPRECIATION MONTH. Councilmember Stover seconded the motion; the motion carried 7-0 with Mayor Pro Tem Wheeler and Councilmembers Garcia, Peters, Raines, Tunnell, Stover and York voting in favor of the motion. CM01232001 Page 3 of 8 Citizen's Appearances. Debra Dezendorf, 322 S. MacArthur, spoke about the Montessori School at the Church of Apostles. Laura Jarvis, 812 Crane, and Rachel Williams, 784 Crestview Court, spoke regarding their Trash Bash to clean up Denton Creek. 10. Consider approval of the following consent agenda items: A. Consider approval of minutes: January 9, 2001. Consider approval of final Change Order #9 in the amount of $57,327.00, to the contract with Hisaw ~ Associates for the construction of the Aquatics and Recreation Center, and authorizing the City Manager to sign. Issues Discussed: The dollar amount on 10B should be amended to reflect $59, 2 19.00. Action: Councilmember Tunnell moved to approve Consent Agenda Items A, and B reflecting an amended amount of $59,2 19.00. Councilmember Garcia seconded the motion; the motion carried 7-0 with Mayor Pro Tem Wheeler and Councilmembers Garcia, Peters, Raines, Tunnell, Stover and York voting in favor of the motion. 11. Consider acceptance of the Comprehensive Annual Financial Report for the fiscal year ended September 30, 2000. Presentation: Jim Witt, City Manager, gave a presentation to Council. Action: Councilmember Stover moved to accept the Comprehensive Annual Financial Report for the fiscal year ended September 30, 2000. Councilmember Tunnell seconded the motion; the motion carried 7-0 CM01232001 Page 4 of 8 with Mayor Pro Tem Wheeler and Councilmembers Garcia, Peters, Raines, Tunnell, Stover and York voting in favor of the motion. 12. Consider approval of an Ordinance authorizing the issuance of City of Coppell, Texas Combination Tax and Revenue Certificates of Obligation, Series 2001 in the amount of $3,000,000.00 for purchasing of public land, approving an Official Statement and making provisions for the security thereof, and ordaining other matters relating to the subject and authorizing the Mayor to sign. Presentation: Boyd London, First Southwest Company, made a presentation to Council. Action: Councilmember Tunnell moved to approve Ordinance No. 2000-936 authorizing the issuance of City of Coppell, Texas Combination Tax and Revenue Certificates of Obligation, Series 2001 in the amount of $3,000,000.00 for purchasing of public land, approving an Official Statement and making provisions for the security thereof, and ordaining other matters relating to the subject and authorizing the Mayor to sign. Councilmember Raines seconded the motion; the motion carried 7-0 with Mayor Pro Tem Wheeler and Councilmembers Garcia, Peters, Raines, Tunnell, Stover and York voting in favor of the motion. 13. Necessary action resulting from Work Session. There was no action necessary under this item. 14. City Manager's Report. A. Update on Wagon Wheel and MacArthur Parks. B. Scoreboard Review. Jim Witt, City Manager, updated Council on the progress at Wagon Wheel and MacArthur Parks. Mayor Sheehan announced that the Breakfast with City Leaders that is sponsored by the Coppell Chamber of Commerce would be held on March 1, 2001, at 7:30 a.m. at Daddy Jack's in Coppell. Mayor Sheehan announced the State of the City would be presented at the Chamber of Commerce monthly meeting on January 21,2001 at the William T. Cozby Library. Mayor Sheehan announced that there is a new Kiwanis Club in Coppell. A kick-off reception will be held January 25, 2001, at 7:00 p.m. at Hackberry Creek. The weekly meetings will be held at on Thursday at 7:00 a.m. at CJ's. Mayor Sheehan reported on the Leadership Coppell reception held last week at Hackberry Creek. She also announced that the first meeting will be held January 24, 2001 and invited everyone to attend. Mayor Sheehan reported on the first class of the new session of the Citizens Police Academy. CM01232001 Page 6 of 8 F, Councilmember Stover gave his condolences to Councilmember York on the loss of his father. Councilmember Stover announced that the Lakeside Carnival will be held on February 3,2001. Councilmember Stover announced that the Coppell Baseball Boosters Casino night would be held on February 3, 2001, at 7:00 p.m. Councilmember Stover announced the CISD Education Foundation Founders Drive deadline has been extended to January 31,2001. Councilmember Peters updated Council on the Senior Adult Services upcoming move due to the demolition of their current building for the expansion of Beltline Road. The City of Carrollton has offered to let them move into the new Gravely Center when it is complete. This move will result in an annual rent increase of $18,000.00. 16. Necessary Action Resulting from Executive Session. Presentation: Bob Hager, City Attorney, made a presentation to Council, stating that with the cost of going forward and obtaining a copy of the record and the legal costs that would be incurred, we were able to negotiate a settlement for the City of approximately $75,000.00. In analyzing this, the cost to continue to fight this matter through the appellate stage would far exceed the amount to settle this case and have it over with forever. Action: Mayor Pro Tem Wheeler moved to settle all outstanding issues in the Sowell vs. City of Coppell case in an amount not to exceed $75,000.00 and authorize the City Manager to sign any necessary documents relating to settlement of this case even though the Federal Court has ruled in our favor on all counts, and to prevent the City from incurring further costs related to a possible defense of this lawsuit and the time devoted by staff, the Mayor, and Council, copying, computer time, etc. CM01232001 Page 7 of 8 Councilmember Tunnell seconded the motion; the motion carried 7-0 __ with Mayor Pro Tem Wheeler and Councilmembers Garcia, Peters, Raines, Tunnell, Stover and York voting in favor of the motion.
