ORDINANCE NO. 320
AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING THE CODE
OF ORDINANCES OF THE CITY OF COPPELL, TEXAS, BY AMENDING SECTION 3-3-2
SO AS TO ADOPT NEW WATER PAYMENT PROCEDURES FOR WATER SERVICE
FURNISHED BY THE CITY WATER SYSTEM; PROVIDING FOR A TEN PERCENT (10%)
PENALTY FOR FAILURE TO PAY BILLS BEFORE OR ON THE DUE DATE; PROVIDING
DISCONTINUANCE OF SERVICE TO CUSTOMERS WHOSE BILLS ARE THIRTY (30) DAYS
OR LONGER OVERDUE; PROVIDING FOR INSPECTIONS OF METERS; PROVIDING FOR
LEAKAGES ON CUSTOMER SIDE; PROVIDING AUTHORITY TO ESTIMATE USAGE IF
METER IS INOPERABLE; PROVIDING A TEN PERCENT (10%) DISCOUNT FOR SENIOR
CITIZENS AGE 65 AND OLDER.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS:
SECTION l. AMENDING SECTION 3-3-2 OF CODE OF ORDINANCES
That Section 3-3-2 of the Code of Ordinances of the City of Coppell, Texas,
be, and the same is hereby, amended to read as follows:
"Section 3-3-2 PAYMENT OF BILLS
All bills for water, sewer and garbage services are due the
clate shown on the bill, arid a penalty of ten percent (10%)
of the total charge will be assessed for all bills not paid on
or before the due date.
A. DISCONTINUANCE OF SERVICE
The City of Coppell, after giving the customer written notice
of intent to terminate service, may discontinue service to
such customer whose bill for water, sewer and/or garbage is
thirty (30) days or longer overdue.
B. RESTORATION OF SERVICE
Services shall not be continued or reconnected to any customer
until all current and delinquent charges, plus the ten percent
(10%) penalty, plus an additional Ten Dollars ($10.00) to cover
the cost of disconnecting and reconnecting services, have
been paid.
C. INSPECTIONS
Any utility service customer shall have the right to request
that the meter through which water is being furnisheO be
examined and tested for accuracy. If the meter has not been
tested within the past three years such test shall be free of
charge. If the meter has been tested within the past three
years, such customer shall, in his written application, agree
to a fee of Seven Dollars ($7.00) to be added to the consumer's
water bill. In the event such inspection reveals said meter
was registering incorrectly or misread, as determined by a
representative of the City of Coppell, said Seven Dollars
($7.00) shall be waivered and adjustment will be made for
the inaccurate reading.
D. USAGE ESTIMATION
If the meter is not registering due to realfunction, or due to
any circumstances it is impractical to read said meter, meter
usage may be estimated. This estimation will be calculated
using the average of the previous three (3) months' usage.
If the customer has less than three (3) months of usage history,
the average of total past usage will be used.
E. LEAKAGE ON CUSTOMER SIDE
All customers shall be responsible for loss of water due to
leakage in pipes inside the discharge side of the meter, and
if this water is not paid for according to the rates provided
by Section 3-1-5 and by Section 3-3-2 of the Code of
Ordinances of the City of Coppell, Texas, service shall be
discontinued. Service will not be restored until all claims
have been paid.
F. SENIOR CITIZEN DISCOUNT
The City of Coppell shah grant a senior citizen discount of
ten percent (10%) to all senior citizens that provide valid
proof that he/she has reached his/her 65th birthday. Such
proof must be brought in person to the Finance Department
of the City of Coppel] between regular working hours in order
for the discount to be granted. Examples of valid proof
include a valid Texas driver's license, birth certificate, or
any other original document proving age. Copies of documents
will not be accepted."
SECTION 3. REPEALING CLAUSE
All ordinances, or parts of ordinances, inconsistent or in conflict with the
provisions of this ordinance are hereby repealed.
SECTION 4. SEVERABILITY CLAUSE
If any article, paragraph or subdivision, clause or provision of this ordinance
shah be adjudged invalid or held unconstitutional, the same shall not affect the validity
of this ordinance as a whole or any part or provision thereof, other than the part so
decideci to be invalid or unconstitutional.
SECTION 5. PENALTY CLAUSE
Any person, firm or corporation violating any of the provisions of this ordinance
shah be deemed guilty of a misdemeanor and, upon conviction, shall be punished by a
penalty of fine not to exceed the sum of Two Hundred Dollars ($200.00) for each offense,
and each and every day such offense is continued shall constitute a new and separate
offense.
SECTION 6. EFFECTIVE DATE
This ordinance shall take effect immediately from and after the publication of
its caption, as the law in such cases provides.
