OR 304 Adopts the Electrical Code, 1984 edition AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 304 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, ADOPTING THE NATIONAL ELECTRICAL CODE, 1984 EDITION AND INTERIM AMENDMENTS (TIA 70- 84-1 AND TIA 70-84-2); PROVIDING FOR THE REGULATION OF ELECTRICAL WORK WITHIN THE CITY OF COPPELL, TEXAS; AND DEFINING CERTAIN TERMS; PROVIDING FOR CERTAIN DELETIONS AND EXEMPTIONS; PROVIDING SPECIFICATIONS, MATERIALS AND METHODS OF ELECTRICAL INSTALLATION; PROVIDING REGULATIONS FOR THE INSTALLATION OF ELECTRIC CONDUCTORS AND EQUIPMENT INSTALLED WITHIN OR ON PUBLIC AND PRIVATE BUILDINGS OR OTHER STRUCTURES, INCLUDING MOBILE HOMES AND RECREATIONAL VEHICLES; AND OTHER PREMISES SUCH AS YARDS, CARNIVAL, PARKING AND OTHER LOTS, AND INDUSTRIAL SUBSTATIONS; PROVIDING REGULATIONS FOR CONDUCTORS THAT CONNECT THE INSTALLATIONS TO A SUPPLY OF ELECTRICITY AND OTHER OUTSIDE CONDUCTORS ON PREMISES; REPEALING ALL PARTS OF ORDINANCES IN CONFLICT WITH THIS ORDINANCE; SPECIFICALLY REPEALING ORDINANCES NO. 276 AND NO. 276-A-1; PROVIDING A SEVERABILITY CLAUSE; PROVIDING PENALTIES FOR VIOLATION OF THIS ORDINANCE NOT TO EXCEED THE SUM OF ONE THOUSAND DOLLARS ($1,000.00) FOR EACH OFFENSE; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. TITLE. This ordinance shall be known as the "City of Coppel] Electrical Code" and Article 15-2 of the City Code shall be amended to reflect its adoption. SECTION 2. ADOPTION OF "NATIONAL ELECTRICAL CODE," 1984 EDITION AND INTERIM AMENDMENTS TIA 70-84-1 and 70-84-2. There is hereby adopted by the City of Coppell, Texas, for the purpose of providing requirements for the safeguarding of persons and property and promoting the welfare of the public, that certain National Electrical Code, 1984 Edition, together with interim amendments (TIA 70-84-1 and 70-84-2), adopted by the National Fire Protection Association, save and except portions as hereinafter deleted, modified or amended. A copy of said adopted code is attached hereto as Exhibit "A" and made a part hereof, the same as if fully set out at length herein, and from the date this ordinance shall take effect, the provisions thereof shall be controlling within the corporate limits of the City. SECTION 3. GENERAL AMENDMENT TO NATIONAL ELECTRICAL CODE, 1984 EDITION. In addition to the provisions of the Electrical Code attached hereto as Exhibit "A", the fees set out in the fee schedule attached hereto as Exhibit "B" shall be collected in connection with Electrical Code matters. SECTION 5. REPEALING CLAUSE. All parts of ordinances inconsistent or in conflict with the provisions of this ordinance are hereby repealed. Ordinances No. 276 and No. 276-A-1 are hereby specifically repealed. However, the repeal of existing ordinances by this ordinance shall not affect or prevent the prosecution or the punishment of any person for any act done or committed prior to the effective date of this ordinance in violation of any ordinance hereby repealed; and the prosecution of such offenses may be instituted and causes presently pending prosecuted as if such prior ordinance or ordinances had not been repealed. SECTION 5. SEVERABILITY CLAUSE. If any article, paragraph or subdivision, clause, phrase or provision of this ordinance shall be adjudged invalid or held unconstitutional, the same shall not affect the validity of this ordinance as a whole or any part or provision thereof, other than the part so decided to be invalid or unconstitutional. SECTION 7. PENALTY CLAUSE. Any person, firm or corporation violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and, upon conviction, shall be fined not to exceed the sum of One Thousand Dollars ($1,000.00) for each offense, and each and every day such offense is continued shall constitute a new and separate offense. SECTION 8. EFFECTIVE DATE. This ordinance shall take effect i~m~d~at~- f~m eP'~ after its passage and publication of its caption, as the law in such eases provides. SECTION 9. SPECIAL HANDLING OF ORDINANCE. Due to the size of the volume attached hereto as Exhibit "A", it is hereby directed that the original of this ordinance, with Exhibit "A" attached, be kept as a separate file in the office of the City Secretary, and that a duplicate original of this ordinance, with a photocopy of the cover sheet of such volume, be placed in the official ordinance book.
