OR 275-A-2 Require fire-retardant roof coverings AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 275A2 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING THE CITY OF COPPELL BUILDING CODE, TO WIT: THE UNIFORM BUILDING CODE, 1982 EDITION, HERETOFORE ADOPTED BY ORDINANCE NO. 275, TO REQUIRE ALL ROOF COVERINGS TO BE FIRE RETARDANT OF AT LEAST CLASS C ROOFING ON ALL OCCUPANCIES IN THE CITY; PROVIDING A REPEALING CLAUSE, AND SPECIFICALLY REPEALING SECTIONS 32:8 AND 32:11 OF SAID ADOPTED CODE; PROVIDING A SEVERABLIITY CLAUSE; PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF ONE THOUSAND DOLLARS ($1000.00) FOR EACH OFFENSE AND DECLARING AN EFFECTIVE DATE. WHEREAS, use of untreated wood roofs can only lead to continued overhead fire spread with continued defeat of ground based fire forces, increased destruction of property, and increased danger to persons; and WHEREAS, dangerous overhead fire spread can be severely limited early in a fire by requiring roofing that will at least resist a shower of small sparks, such as Class C roofing; NOW, THEREFORE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. AMENDING COPPELL BUILDING CODE, TO WIT: UNIFORM BUILDING CODE 1982 EDITION That the City of Coppell Building Code, to wit: The Uniform Building Code, 1982 Edition, as heretofore adopted by Ordinance No. 275, is hereby amended by adding thereto a new section which shall read as follows: "All roof coverings shall be fire retardant of at least Class C roofing on all occupancies in the City" SECTION 3. REPEALING CLAUSE All ordinances, or parts of ordinances, inconsistent or in conflict with the provisions of this ordinance are hereby repealed. Sections 32:8 and 32:11 of the Coppell Building Code (Uniform Building Code, 1982 Edition) are specifically repealed. SECTION 4. SEVERABILITY CLAUSE If any article, paragraph or subdivision, clause or provision of this ordinance shall be adjudged invalid or held unconstitutional, the same shall not affect the validity of this ordinance as a whole or any part or provision thereof, other than the part so decided to be invalid or unconstitutional. SECTION 5. PENALTY CLAUSE Any person, firm or corporation violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and, upon conviction, shall be punished by a penalty of fine not to exceed the sum of One Thousand Dollars ($1,000.00) for each offense, and each and every day such offense is continued shall constitute a new and separate offense. SECTION 6. EFFECTIVE DATE This ordinance shall take effect immediately from and after the publication of its caption, as the law in such eases provides.
