OR 2001-939 Establishing an Infrastructure Maintenance Fund AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE No. 2001939 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING ORDINANCE NO. 98822, AS AMENDED, ESTABLISHING AN INFRASTRUCTURE MAINTENANCE FUND BY AMENDING THE AMOUNT FUNDED; PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Ordinance No. 98822, adopted by the City Council on the lOth day of February, 1998, authorized an amount to be used for the funding of the Infrastructure Maintenance Fund (IMF); and WHEREAS, City Council desires to amend the amounts allotted for Infrastructure Maintenance Fund (IMF), NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. That Ordinance No. 98822 be and the same are hereby amended to read as follows: "Infrastructure Maintenance Fund (IMF): .... The City Council may, as a separate line item in the budget, authorize the City Manager to allocate an amount not to exceed Two Hundred Thousand Dollars ($200,000.00) payable from the proceeds of the general funds and the water and sewer fund to the IIVlF. In addition, after completion of each fiscal year audit, the City Council may authorize the City Manager to transfer from the annual operating surpluses, the general fund and the water and sewer fund an amount to the IMF provided all required fund balance requirements are met. .... " SECTION 2. That all ordinances of the City of Coppell in conflict with the provisions of this Ordinance, be, and the same are hereby, repealed and all other provisions of the Ordinances of the City of Coppell including ordinance No. 98822 as amended, not in conflict with provisions of this ordinance shall remain in full force and effect. SECTION 3. That should any word, phrase, paragraph, section or phrase of this ordinance or of the Ordinances of the City, as amended hereby, be held to be unconstitutional, illegal or invalid, the same shall not affect the validity of this ordinance as a whole, or any part or provision Page -1- 39481 thereof other than the part so decided to be unconstitutional, illegal or invalid, and shall not affect the validity of the Ordinances as a whole. SECTION 4. That this ordinance shall take effect immediately from and after its passage, as the law and charter in such cases provide.
