OR 324.1 Requirements for type of exterior construction AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 324.1 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF COPPELL, TEXAS, AS HERETOFORE AMENDED BY AMENDING THE MASONRY CONSTRUCTION REQUIREMENT IN THE AGRICULTURAL, SINGLE FAMILY AND TWO FAMILY ZONING DISTRICTS TO REQUIRE AT LEAST 80% OF THE EXTERIOR WALLS OF THE FIRST FLOOR OF ALL STRUCTURES BE OF MASONRY CONSTRUCTION EXCLUSIVE OF DOORS, WINDOWS, AND THE AREA ABOVE THE TOP PLATE LINE AND THAT EACH STORY ABOVE THE FIRST FLOOR OF A STRAIGHT WALL STRUCTURE TO BE AT LEAST 80% MASONRY EXCLUSIVE OF DOORS, WINDOWS AND THE AREA ABOVE THE TOP PLATE LINE AND PROVIDING THAT STUCCO TYPE EXTERIORS SHALL BE PERMITED ONLY BY SPECIFIC USE PERMIT; PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING PENALTIES FOR VIOLATION OF THIS ORDINANCE NOT TO EXCEED THE SUM OF ONE THOUSAND DOLLARS ($1,000.00) FOR EACH OFFENSE; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City Zoning Commission and the Governing Body of the City of Coppell, Texas, in compliance with the laws of the State of Texas with reference to the granting of zoning changes under the zoning ordinanee and zoning map, have given requisite notices by publication and otherwise, and after holding due hearings and affording a full and fair hearing to all property owners generally, the said Governing Body is of the opinion that Ordinance Number 979, the Comprehensive Zoning Ordinance of the City of Coppell, should be amended in the exercise of its legislative discretion: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. That Section 8.4 of the Comprehensive Zoning Ordinance of the City of Coppell, Ordinance Number 979, providing requirements for the type of exterior construction for structures in the ~A" Agricultural 1)istriet, be amen<led to read as follows: "8.4 Type of Exterior Construction: At least 80% of the exterior walls of the first floor of all structures shah be of masonry construction exclusive of doors, windows, and the area above the top plate line. Each story above the first floor of a straight wall structure shall be at least 80% masonry exclusive of doors, windows and the area above the top plate line. Stucco type exteriors are permitted only by Specific Use Permit." SECTION 2. That Section 9.4 of the Comprehensive Zoning Ordinance of the City of Coppell, Ordinance Number 979, providing requirements for the type of exterior construction for structures in the "SF-ED" Single Family Residential District, be amended to read as follows: "9.4 Type of Exterior Construction: At least 80% of the exterior walls of the first floor of all structures shall be of masonry construction exclusive of doors, windows, and the area above the top plate line. Each story above the first floor of a straight wall structure shall be at least 80% masonry exclusive of doors, windows and the area above the top plate line. Stucco type exteriors are permitted only by Specific Use Permit." SECTION 3. That Section 10.4 of the Comprehensive Zoning Ordinance of the City of Coppell, Ordinance Number 979, providing requirements for the type of exterior construction for structures in the "8F-18" Single Family Residential District, be amended to read as follows: 10.4 Type of Exterior Construction: At ]east 80% of the exterior walls of the first floor of all structures shall be of masonry construction exclusive of doors, windows, and the area above the top plate line. Each story above the first floor of a straight wall structure shall be at least 80% masonry exclusive of doors, windows and the area above the top plate line. Stucco type exteriors are permitted only by Specific Use Permit." SECTION 4. That Section ]1.5 of the Comprehensive Zoning Ordinance of the City of Coppell, Ordinance Number 979, providing requirements for the type of exterior construction for structures in the "SF-12" Single Family Residential District, be amended to read as follows: "11.5 Type of Exterior Construction: At least 80% of the exterior walls of the first floor of all structures shall be of masonry construction exclusive of doors, windows, anti the area above the top plate line. Each story above the first floor of a straight wall structure shall be at least 80% masonry exclusive of doors, windows and the area above the top plate line. Stucco type exteriors are permitted only by Specific Use Permit." SECTION 5. That Section 12.5 of the Comprehensive Zoning Ordinance of the City of Coppell, Orclinance Number 979, providing requirements for the type of exterior construction for structures in the "SF-9" Single Fmnily Residential District, be amended to read as follows: 12.5 Type of Exterior Construction: At least 80% of the exterior walls of the first floor of all structures shall be of masonry construction exclusive of doors, windows, and the area above the top plate line. Each story above the first floor of a straight wall structure shah be at ]east 80% masonry exclusive of doors, windows and the area above the top plate line. Stucco type exteriors are permitted only by Specific Use Permit." SECTION 6. That Section 13.5 of the Comprehensive Zoning Ordinance of the City of Coppell, Orainance Number 979, providing requirements for the type of exterior construction for structures in the "SF-7" Single Family Residential District, be amended to reac~ as follows: 13.5 Type of Exterior Construction: At least 80% of the exterior walls of the first floor of all structures shall be of masonry construction exclusive of doors, windows, and the area above the top plate line. Each story above the first floor of a straight wall structure shall be at least 80% masonry exclusive of doors, windows and the area above the top plate line. Stucco type exteriors are permitted only by Specific Use Permit." SECTION 7. That Section 14.5 of the Comprehensive Zoning Ordinance of the City of Coppell, Ordinance Number 979, providing requirements for the type of exterior construction for structures in the "SF-0" Single Family Residential District - Zero Lot Line, be amended to read as follows: 14.5 Type of Exterior Construction: At least 80% of the exterior wails of the first floor of all structures shall be of masonry construction exclusive of doors, winelows, and the area above the top plate line. Each story above the first floor of a straight wall structure shall be at least 80% masonry exclusive of doors, windows and the area above the top plate line. Stucco type exteriors are permitted only by Specific Use Permit." SECTION 8. That Section 15.5 of the Comprehensive Zoning Ordinance of the City of Co[3pell, Ordinance Number 979, providing requirements for the type of exterior construction for structures in the "2F-9" Two Family Residential District, be amended to read as follows: 15.5 Type of Exterior Construction: At least 80% of the exterior walls of the first floor of all structures shah be of masonry construction exclusive of doors, windows, and the area above the top plate line. Each story above the first floor of a straight wall structure shall be at least 80% masonry exclusive of doors, windows and the area above the top plate line. Stucco type exteriors are permitted only by Specific Use Permit." SECTION 9. That all ordinances of the City in conflict with the provision of this ordinance be, and the same are hereby, repealed and all other ordinances of the City not in conflict with the provisions of this ordinance shall remain in full force and effect. SECTION 10. That should any paragraph, sentence, subdivision, clause, phrase or section of this ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall not affect the validity of this ordinance as a whole or any part or provision thereof other than the part so decided to be invalid, illegal or unconstitutional and shall not affect the validity of the Comprehensive Zoning Ordinance as a whole. SECTION 11. That any person, firm or corporation violating any of the provisions or terms of this ordinance shall be subject to the same penalty as provided for in the Comprehensive Zoning Ordinance of the City, as heretofore amended, and upon conviction shall be punished by fine not to exceed the sum of One Thousand Dollars ($1,000.00) for each offense, and that each day such violation shall continue to exist shall constitute a separate offense. SECTION 12. It is necessary to amend the Zoning Ordinance of the City in order to permit proper development and in order to protect the public interest, comfort and general welfare of the City. Therefore, this ordinance shall take effect immediately from and after' its passage and publication of its caption, as the law in such cases provides.
