ORDINANCE NO. 274
AN ORDINANCE OF THE CITY OF COPPELL, TEXAS AMENDING THE CODE
OF ORDINANCES OF THE CITY OF COPPELL, TEXAS BY ADDING TO SECTIONS
3-1-4 AND 3-2-1 A PROVISION MAKING THE OWNER OF ANY PROPERTY
RESPONSIBLE FOR OPENING THE HOLE TO THE WATER AND/OR SEWER MAIN
AND LEAVING IT OPEN AND PROTECTED UNTIL THE WATER AND/OR SEWER
CONNECTION IS MADE BY CITY PERSONNEL; FURTHER AMENDING SECTION 3-2-2
SO AS TO ADOPT NEW SEWER RATES FOR SERVICES FURNISHED BY THE SANITARY
SEWER SYSTEM AND AMENDING THE SECTION 3-2-4 ADOPTING NEW TAPPING
FEES FOR CONNECTION WITH THE SANITARY SEWER SYSTEM; PROVIDING A
REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A
PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS
($200.00) FOR EACH OFFENSE AND DECLARING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS:
SECTION 1. AMENDING SECTION 3-1-4 OF CODE OF ORDINANCES
That Section 3-1-4 of the Code of Ordinances of the City of Coppell, Texas,
be and the same is hereby amended by adding thereto the following:
"The owner of any property desiring to connect with the City Water Works
System shall be responsible for opening the hole to the water main and leaving it open
and protecting it until the water connection is made by City personnel."
SECTION 2. AMENDING SECTION 3-2-1 OF CODE OF ORDINANCES
That Section 3-2-1 of the Code of Ordinances of the City of Coppell, Texas,
be and the same is hereby amended by adding thereto the following:
"The owner of any property desiring to connect with the City Sewer System
shall be responsible for opening the hole to the sewer main and leaving it open and
protecting it until the sewer connection is made by City personnel~ ~9~//~ ~-~
SECTION 3. AMENDING SECTION 3-2-2 OF CODE OF ORDINANCE~
That Section 3-2-2 of the Code of Ordinances of the City of CoppeR, Texas,
be and the same is hereby amended to read as follows:
"The monthly rates charged for services furnished by the Sanitary Sewer System
of the City shall be based upon the amount of metered water which is furnished during
the month as follows:
Residential: First 1~000 gallons (minimum) $5.00. All over 1,000
gallons 80 cents per 1,000 gallons to a maximum of
14,000 gallons.
Commercial &
Industrial: First 1,000 gallons (minimum) $5.00 and all over 1,000
gallons 80 cents per 1,000 gallons.
Sewer Service
Only (flat rate): $10.00
Each residential unit, apartment, multiple family dwelling or mobile home park
will be billed a minimum charge plus consumption up to the maximum of 14,000 gallons
of metered water per unit."
SECTION 4. AMENDING SECTION 3-2-4 OF CODE OF ORDINANCES
That Section 3-2-4 A 1 be and the same is hereby amended to change the
tapping fee for connections with the Sanitary Sewer System as follows:
"1. 4" Residential $ ~(Z)(D. ~_~o.
4" Commercial $ //(~)D, ~o__ plus total cost of
materials and labor.
6" and larger $ ~ ~)~)o.? plus total cost of
materials and labor."
SECTION 5. REPEALING CLAUSE
All ordinances, or parts of ordinances, inconsistent or in conflict with the
provisions of this ordinance are hereby repealed.
SECTION 6. 8EVERABILITY CLAUSE
If any article, paragraph or subdivision, clause or provision of this ordinance
shall be adjudged invalid or held unconstitutional, the same shall not affect the validity
of this ordinance as a whole or any part or provision thereof, other than the part so
decided to be invalid or unconstitutional.
SECTION 7. PENALTY CLAUSE
Any person, firm or corporation violating any of the provisions of this ordinance
shall be deemed guilty of a misdemeanor and~ upon eonvietion~ shall be punished by a
penalty of fine not to exceed the sum of Two Hundred Dollars ($200.00) for each
offense~ and each and every day such offense is continued shall constitute a new and
separate offense.
SECTION 8, EFFECTlifE DATE
This ordinance shall take effect immediately from and after the publication of
its eaption~ as the law in such eases provides.
