OR 265 Construction or location of metal buildings AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 265 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING THE CODE OF ORDINANCES OF THE CITY OF COPPELL BY ADDING THERETO A NEW ARTICLE 9-7 MAKING IT UNLAWFUL FOR ANY PERSON TO CONSTRUCT OR LOCATE A METAL BUILDING WITHIN THAT PORTION OF THE CITY WHICH LIES WEST OF ALLEN ROAD AND SOUTH OF BELTLINE ROAD; EXCEPTING METAL ACCESSORY BUILDINGS HAVING AN AREA OF LESS THAN 150 SQUARE FEET AND BUILDINGS ALREADY IN EXISTENCE AS OF THE EFFECTIVE DATE OF THIS ORDINANCE; PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE AND DECLARING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. AMENDING COPPELL CODE OF ORDI~IANCES The Code of Ordinances of the City of Coppell, Texas, is hereby amended to read as follows: ~ARTICLE 9-7 METAL BUILDINGS Section 9-7-1 METAL BUILDINGS PROHIBITED IN CERTAIN AREAS A. It shall be unlawful for any person to construct or locate a metal building within that portion of the City of Coppell which lies west of Allen Road and south of Beltline Road. B. This section shall not apply to accessory buildings having an area of less than /5'O square feet. C. This section shall not apply to buildings presently in existence as of the effective date of this ordinance. Such buildings shall be considered as nonconforming buildings and shall be permitted to continue in existence until such nonconforming status ceases to exist. The nonconforming status of any such building shall be determined by the same provisions for determining such status under the Comprehensive Zoning Ordinance of the City? SECTION 2. REPEALING CLAUSE AH ordinances, or parts of ordinances, inconsistent or in conflict with the provisions of this ordinance are hereby repealed. SECTION 3. SEVERABILITY CLAUSE If any article, paragraph or subdivision, clause or provision of this ordinance shah be adjudged invalid or held unconstitutional, the same shall not affect the validity of this ordinance as a whole or any part or provision thereof, other than the part so decided to be invalid or unconstitutional. SECTION 4. PENALTY CLAUSE Any person, firm or corporation violating any of the provisions of this ordinance shah be deemed guilty of a misdemeanor and, upon conviction, shah be punished by a penalty of fine not to exceed the sum of Two Hundred Dollars ($200.00) for each offense, and each and every day such offense is continued shah constitute a new and separate offense. SECTION 5. EFFECTIVE DATE. This ordinanee shah take effeet immediately from and after the publication of its caption, as the law in such eases provides.
