ORDINANCE NO. 259
AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING CHAPTER
3 OF THE CODE OF ORDINANCES OF THE CITY OF COPPELL BY ADDING THERETO
A NEW ARTICLE 3-5 "SANITATION DEPARTMENT"; PROVIDING FOR THE
COLLECTION OF GARBAGE AND REFUSE THROUGH THE GRANT OF A FRANCHISE
TO AN INDEPENDANT CONTRACTOR; REQUIRING ALL RESIDENCES AND
COMMERCIAL ESTABLISHMENTS WITHIN THE CITY TO MAKE USE OF THE SOLID
WASTE DISPOSAL SERVICES OFFERED BY THE CITY THROUGH ITS FRANCHISEE;
ESTABLISHING A FEE FOR SUCH SERVICE; PROVIDING REGULATIONS CONCERNING
CONTAINERS AND THEIR PLACEMENT; PROVIDING FOR A SERVICE DEPOSIT;
PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABLIITY CLAUSE;
PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO HUNDRED
DOLLARS ($200.00) FOR EACH OFFENSE AND DECLARING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS:
SECTION 1 AMENDING CHAPTER 3 OF THE CODE OF ORDINANCES
That Chapter 3, of the Code Of Ordinances Of The City Of The City Of Coppell
is hereby amended by adding thereto a new Article 3-5 which shall read as follows:
"ARTICLE 3 - 5
Section 3-5-1 SANITATION DEPARTMENT CREATED
There is hereby created the City of Coppall Sanitation Department.
Section 3-5-2 GARBAGE COLLECTION BY FRANCHISEE
Garbage and Refuse shall be collected in the city by an Independent
Contractor who shall operate under a franchise granted by the city.
section 3-5-3 USE OF COLLECTION SERVICE MANDATORY
All residents and commercial establishments within the city shall
be required to use the waste disposal services offered directly by
the city or under its authorized independent franchisee.
Section 3-5-4 RE:$1DENTIAL COLLECTION FEE
For one family residential service (twice weekly pick-up) the fee
shall be $6.40 per month. A $5.00 deposit for new residential
customers shall be collected and included in the initial bill.
Section 3-5-5 COMMERCIAL COLLECTION FEE
Commercial Hand Collection shall be $12.00. When volume of hand
collection reaches three (3) cubic yards or more per weel<,
containerized service must be used.

Commercial Containerized, Roll-off:
20 Cubic yard, 30 Cubic yard, Open Tops $90.00 rental monthly per
container, $4.80 per Cubic Yard.
42 Cubic Yard enclosed compactor container, $325.00 rental, $156.00
per load.
Any establishment generating 3 cubic yards or more per week will
be required to obtain a commercial type container.
Section 3-5-6 RESIDENTIAL CONTAINERS
It shall be the responsibility of each residential dwelling unit to
provide portable containers for the placement of all refuse. Such
containers may consist of plastic or treated paper bags, galvanized
iron, tin or other suitable metal or plastic cans with two handles
and a tight fitting cover with a handle for removal. The capacity
shall be a minimum of 20 gallons and not exceeding 30 gallons.
Each residential unit shall provide sufficient number of containers
to accommodate the storage of all refuse produced from the unit.
The common 55 gallon drum or similar type shall not be considered
as a proper container.
Section 3-5-7 PLACEMENT OF CONTAINERS
A. If the residential unit from which garbage is to be collected
is adjacent to an alley, the owner, occupant, tenant or lessee
shall be required to keep the garbage container within his
private property until the day of, or the evening before, the
day for collection.
B. If alley service is not available, the owner, occupant, tenant
or lessee shall keep the container at a point behind the
building line until the day of, or the evening before, collection.
C. When Dlacin~ the containers for collection, wet garbage shall
be contained in a suitable manner to prevent odors from
escaping, and the containers placed adjacent to the alley, or
when alley service is not available, adjacent to the front
curb line.
Section 3-5-8 BRUSH AND OTHER LARGE TRASH OBJECTS
Brush must be cut in five-foot lengths and securely tied in bundles
not to weigh more than 50 pounds. Such brush and large trash
objects (which can be reasonably handled by two men) shall be
placed at the usual pick-up site and shall be collected only on the
second pick-up of each week".
SECTION 2 REPEALING CLAUSE
All ordinances, or parts of ordinances, inconsistent or in conflict with the
provisions of this ordinance are hereby repealed.
SECTION 3 SEVERABILITY CLAUSE
If any article, paragraph or subdivision, clause or provision of this ordinance
shall be adjudged invalid or held unconstitutional, the same shah not affect the validity
of this ordinance as a whole or any part or provision thereof, other than the part so
decided to be invalid or unconstitutional.
SECTION 4 PENALTY CLAUSE
Any person, firm or corporation violating any of the provisions of this ordinance
shall be deemed guilty of a misdemeanor and, upon conviction, shall be punished be a
penalty of fine not to exceed the sum of Two Hundred Dollars ($200.00) for each
offense, and each and every day such offense is continued shall constitute a new and
separate offense.
SECTION 5 EFFECTIVE DATE
This ordinance shall take effect immediately from and after the publication of
its caption, as the law in such cases provides.
