OR 251 Unlawful parking on Freeport Pkwy. AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 251 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, REGULATING THE STOPPING, STANDING AND PARKING OF VEHICLES GENERALLY; DEFINING THE TERM PERSON; MAKING IT UNLAWFUL FOR ANY PERSON TO PARK ANY VEHICLE ON FREEPORT PARKWAY, A PUBLIC STREET WITHIN THE CITY; PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING PENALTIES FOR VIOLATION OF THIS ORDINANCE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. DEFINITIONS. The term "person" as used in this ordinance shah mean any person, firm, association, or corporation. SECTION 2. NO PARKING ON FREEPORT PARKWAY It shall be unlawful for any persn to park any vehicle on any portion of Freeport Parkway, a public street within the city. SECTION 3. OWNER PRESUMED TO HAVE PARKED UNATTENDED VEHICLE. If any vehicle is found unattended or unoccupied and in violation of any of the provisions of this ordinance, the fact that such vehicle is unattended or unoccupied shall be prima facie evidence that the owner unlawfully stopped, placed, or parked the vehicle. Proof of ownership may be made by a copy of the registration of the vehicle with the State Highway Department or the County Motor Vehicle License Department showing the name of the person to whom the State Highway License Plates were issued. This proof shall constitute prima facie evidence of ownership of the motor vehicle by the person to whom the Certificate of Registration was issued. SECTION 4. REPEALING CLAUSE. All ordinances, or parts of ordinances, inconsistent or in conflict with the provisions of this ordinance are hereby repealed. SECTION 5. SEVERABILITY CLAUSE. If any article, paragraph or subdivision, clause or provision of this ordinance shall be adjudged invalid or held unconstitutional, the same shall not affect the validity of this ordinance as a whole or any part or provision thereof, other than the part so decided to be invalid or unconstitutional. SECTION 6. PENALTY CLAUSE. Any person, firm or corporation violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and, upon conviction, shall be punished by a penalty of fine not to exceed the sum of Two Hundred Dollars ($200.00) for each offense, and each and every day such offense is continued shall constitute a new and separate offense. SECTION 7. EFFECTIVE DATE. This ordinance shall take effect immediately from and after the publication of its caption, as the law in such cases provides.
