ORDINANCE NO. 250
AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, ESTABLISHING
40 MILES PER HOUR AS THE MAXIMUM PRIMA FACIE SPEED LIMIT ON
FREEPORT PARKWAY, A PUBLIC STREET WITHIN THE CORPORATE LIMITS OF
THE CITY; MAKING IT UNLAWFUL FOR ANY PERSON TO OPERATE OR DRIVE A
VEHICLE ON SAID PUBLIC STREET AT A SPEED GREATER THAN SAID DESIGNATED
SPEED; PROVIDING THAT ANY SPEED IN EXCESS OF SAID DESIGNATED SPEED
SHALL BE PRIMA FACIE EVIDENCE THAT SUCH SPEED IS NOT REASONABLE NOR
PRUDENT AND IS UNLAWFUL; PROVIDING A REPEALING CLAUSE; PROVIDING A
SEVERABILITY CLAUSE; PROVIDING PENALTIES FOR VIOLATION OF THIS
ORDINANCE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS FOR EACH
OFFENSE AND ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, the Director of Traffic Control has determined upon the basis of an
engineering and traffic investigation, the reasonable and safe maximum speed limits
for each street within the corporate limits of the City; and
WHEREAS, said Director of Traffic Control has submitted his recommendations
based upon his investigation to the City Council; and
WHEREAS, the City Council may by ordinance alter the maximum prima faeie
speed limit upon the basis of said engineering and traffic investigation, NOW,
THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS:
SECTION 1 MAXIMUM SPEED LIMITS DETERMINED
ON FREEPORT PARKWAY
Based upon the investigation and recommendation of the Director of Traffic
Control there is hereby established on the below mentioned public streets or portions
thereof, within the corporate limits of the City, the following maximum prima faeie
speed limits. A person commits an offense if he operates or drives a vehicle on any
portion of said following designated streets at a speed greater than the speed so
designated by this Section for said street or portion thereof and any speed in excess
of said limit shall be prima facie evidence that the speed is not reasonable nor prudent
and is unlawful:

SECTION 2 SPEED LIMITS POSTED
The Director of Traffic Control shall post the maximum and/or minimum speeds
established by City ordinance by erecting appropriate signs in conspicuous places so
that every motorist may be aware of the established speed limits. No sign shah be
required in any urban district where the maximum speed limit is 30 miles per hour
and where tilere is no minimum speed limit.
SECTION 3 REPEALING CLAUSE
All parts of ordinances, inconsistent or in conflict with the provisions of this
ordinance are hereby repealed.
SECTION 4 SEVERABILITY CLAUSE
If any article, paragraph or subdivision, clause or provision of this ordinance
shall be adjudged invalid or held unconstitutional, the same shall not affect the validity
of this ordinance as a whole or any part or provision thereof, other than the part so
decided to be invalid or unconstitutional.
SECTION 5 PENALTY CLAUSE
Any parson, firm or corporation violating any of the provisions of this ordinance
shah De deemed guilty of a misdemeanor and, upon conviction, shah be punished by a
ponalty of fine not to exceed the sum of Two Handred Dollars ($200.00) for each
offense, and each and every day such offense is continued shall constitute a new and
separate offense.
SECTION 6 EFFECTIVE DATE
This ordinance shah take effect immediately from and after the publication of
its caption, as the law in such cases provides.
