OR 249 Utility easement no longer needed AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 249 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, ABANDONING AN UNUSED UTILITY EASEMENT; PROVIDING THAT SUCH ABANDONMENT SHALL BE THE INTEREST WHICH THE CITY MAY LEGALLY AND LAWFULLY ABANDON; PROVIDING THAT SAID ORDINANCE SHALL CONSTITUTE A QUITCLAIM DEED THAT MAY BE RECORDED WITH THE COUNTY CLERK OF DALLAS COUNTY, TEXAS; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Coppell has determined that the following easement is no longer needed for public purposes; and WHEREAS, the abutting property owner desires that said utility easement be abandoned; NOW, THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. That the hereinafter described utility easement is no longer needed or necessary for public parposes and should be abandoned in favor of First Security Bank & Trust, the abutting property owner. The utility easement being abandoned herein is described as follows, to-wit: Being that certain fifteen (15) foot utility easement in and across Lots 1, 2, 3, 4, 14, 15, 16 and 17 of the Coppell Heights Addition to the City of Coppell as shown on the Plat of said Addition filed February 20, 1957, Volume 32, Page 229 of the Plat Records of Dallas County, Texas. SECTION 2. That the above described easement be, and the same is hereby, abandoned in favor of First Security Bank & Trust, the owner of the abutting property. SECTION 3. That this abandonment ordinance shall constitute a quitclaim deed in favor of First Security Bank & Trust, the abutting property owner, and a certified copy of the same may be filed in the Deed Records of Dallss County, Texas, to indicate such abandonment. SECTION 4. The abandonment provided for herein shall extend only to the public right, title and interest which the City of Coppell, Texas, may have in and to said easement, and shall be construed to extend only to such interest that the governing body of the City of Coppell, Texas, may legally and lawfully abandon. SECTION 5. The fact that the above described utility easement is no longer needed or necessary for public parposes, and that such easement should be abandoned in favor of the abutting property owner requires that this ordinance shall take effect immediately from and after its passage as the law in such cases provides.
