ORDINANCE NO. 236
AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, MAKING IT UNLAWFUL
TO DEPOSIT GARBAGE, TRASH, RUBBISH, STAGNANT WATER OR DEAD ANIMALS,
UPON ANY PUBLIC OR PRIVATE PROPERTY WITHIN THE CITY; MAKING IT
UNLAWFUL FOR ANY PERSON WHILE DRIVING OR AS A PASSENGER IN ANY
VEHICLE TO THROW TRASH, GARBAGE OR RUBBISH UPON ANY PUBLIC STREET
OR ON ANY PRIVATE PROPERTY; MAKING IT UNLAWFUL FOR ANY PERSON TO
DRIVE ANY TRUCK OR VEHICLE WITHIN THE CITY UNLESS SUCH VEHICLE IS SO
CONSTRUCTED OR LOADED SO AS TO PREVENT RUBBISH AND GARBAGE FROM
BEING BLOWN OR DEPOSITED UPON THE STREETS OR OTHER PUBLIC PROPERTY
WITHIN THE CITY; REQUIRING ALL CONSTRUCTION SITES TO MAINTAIN AN
ENCLOSED COMPOUND FOR THE CONTAINMENT OF WASTE BUILDING MATERIALS
SUSCEPTIBLE OF BEING BLOWN OR SCATTERED BY THE WIND; MAKING IT
UNLAWFUL TO FAIL TO CONTAIN SUCH BUILDING MATERIAL WITHIN SAID
COMPOUND; PROVIDING A SEVERABILITY CLAUSE; PROVIDING PENALTIES FOR
VIOLATION OF THIS ORDINANCE NOT TO EXCEED THE SUM OF TWO HUNDRED
DOLLARS ($200.00) FOR EACH OFFENSE AND ESTABLISHING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL,
TEXAS:
SECTION 1. It shall be unlawful for any person to deposit garbage, trash,
rubbish, stagnant water or dead animals, upon or along any drain, gutter, alley, sidewalk,
street, or vacant lot, or upon any public or private premises within the corporate
limits of the City.
SECTION 2. It shall be unlawful for any person while driving or riding as a
passenger in a vehicle to throw or deposit trash, garbage or rubbish of any kind upon
any street, street right-of-way, or other public place within the City or upon private
property. Any person who accidently drops or permits to be dropped or thrown upon
any street any trash, rubbish or other foreign material or object, shall immediately
remove the same or cause it to be removed and failure to do so shall be a violation
of this ordinance.
SECTION 3. It shall be unlawful for any person to drive or move any truck
or other vehicle within the City, unless such vehicle is so constructed or loaded so as
to prevent any load contents, including trash, rubbish or garbage from being blown or
deposited upon any street, street right-of-way, alley, or any other public or private
property within the City.
SECTION 4. Every building or construction site within the City shall maintain
an enclosed compound for the containment of waste building material which is susceptible
of being blown or scattered by the wind. Such compound shah be constructed with
sufficient material to retain such waste material within the enclosure. The compound
shah be enclosed on all its sides and its top. Provided, however, the material used
for such enclosure may be of a mesh type wire fencing material. The compound shah
be at least six feet in width, six feet in length and six feet in height. It shah further
be unlawful for the person in control of a building site to fail to contain within such
compound waste building materials of the type susceptible of being blown or scattered
by the wind.
SECTION 5. REPEALING CLAUSE.
All ordinances, or parts of ordinances, inconsistent or in conflict with the
provisions of this ordinance are hereby repealed.
SECTION 6. SEVERABILITY CLAUSE.
If any article, paragraph or subdivision, clause, phrase or provision of this
ordinance shah be adjudged invalid or held unconstitutional, the same shall not affect
the validity of this ordinance as a whole or any part or provision thereof other than
the part so decided to be invalid or unconstitutional.
SECTION 7. PENALTY CLAUSE.
Any person, firm or corporation violating any of the provisions of this ordinance
shall be deemed guilty of a misdemeanor and, upon conviction, shall be fined not to
exceed the sum of Two Hundred Dollars ($200.00) for each offense and each and every
day such offense is continued shah constitute a new and separate offense.
SECTION 8. EFFECTIVE DATE.
This ordinance shall take effect immediately from and after the publication of
its caption as the law in such cases provides.
