OR 219 Flood Control ORDINANCE NO. 219 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, PROVIDING DEFINITIONS; PROVIDING A PENALTY OF FINE NOT TO EXCEED TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE; PROVIDING FOR A DEVELOPMENT PERMIT IN A SPECIAL FLOOD HAZARD AREA; DESIGNATING A LOCAL ADMINISTRATOR: PROVIDING, A VARIANCE PROCEDURE; PROVIDING AN APPEAL BOARD AND ITS POWERS; PROVIDING STANDARDS FOR SPECIAL FLOOD HAZARD AREAS; REGULATING FLOODWAYS; ADOPTING A FLOOD INSURANCE STUDY WITH ATTACHMENTS; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL: SECTION 1.1 STATUTORY AUTHORIZATION. The Legislature of the State of Texas has in Articles 1175 and Water Code Section 16.311 et. seu. delegated the responsibility to local governmental units to promote the public health, safety and general welfare of its citizenry. Therefore, the City Council of the City of Coppell, Texas, has enacted this ordinance to establish such regulations. SECTION 1.2 FINDINGS OF FACT. 1) The food hazard areas of the City are subject to periodic inundation ~vhieb results in loss of life and property, health and safety hazards, disruption of commerce and governmental services, extraordinary public expenditures for ~ood protec,inn and relief, and impairment of the tax base, all of which adversely affect the public health, safety add ~enera] welfare. 2) These fl~d l~ses are caused by the cumulative effect of obstructions iB areas of special ~ood hazards which increase ~ood heights and velocities, an~ when inadequately anchored, damage uses ip other areas. Uses that ~e inadeouately floodproofed, elevated or otherwise protected ~rom flood damage also contribute to the fl~d ]~s. SECTION 1.3 STATEMENT OF PUI~POSE. It is the purpose of this ordinance to promote the Dub]it health, safety and general welfare, and to minimize public and private losses due to flood conditions in spee}fic areas by provisions desiStned: 1) To protect human life and health; To minimize expenditure of pub]it money for costly flood control p-ejects; 3) To minimize the need for rescue and relief efforts associated with flooding and generally undertaken at the expense of the general Dublie: 4) To minimize prolonged business interruptions; 5) To minimize damage to public facilities and utilities such as wster and gas mains, electric, telephone and sewer lines, streets and bridges located in areas of special flood hazard; 6) To help maintain a stable tax base by providing for the second use and development of areas of special flood hazard so as to minimize future flood blight areas; 7) To insure that potential buyers are notified that property is in an area of special flood hazard; and, 8) To ensure that those who occupy the areas of special flood hazard assume responsibility for their actions. SECTION 1.4 METHODS OF REDUCINC, FLOOD LOSSES. In order to accomplish its purposes, this ordinance includes methods and provisions for: 1) Restricting or prohibiting uses which are dangerous to health, safety, and property due to water or erosion hazards, or which result in damning increases in erosion or in flood heights or velocities; 2) Requiring that uses vulnerable to floods, including facilities which serve such uses, be protected against flood damage at the time of initial construction; 3) Controlling the alteration of natural flood plains, stream channels and natural protective bnrriers, which help accommodate or channel flood waters; "Expansion to an existing mobile home park or mobile home subdivision" means the preparation of additional sites by the construction of faeiJitles for serving the lots on which the mobile homes are to be affixed (including the installation of utilities, either final site grading or pouring of concrete or the construction of streets). "Flood" or "flooding" means a general and temporary condition of partial or complete inundation of normally dry ]and areas from: 1) The overflow or inland or tidal waters and/or; 2) The unusual and rapid accumulation or runoff of surface ,waters from any source. "Flood Insurance Rate Map" (FIRM) means the official map on which the Federal Insurance Administration has delineated both the areas of special flood hazards and the risk premium zones applicable to the community. "Flood Insurance Study" means the official report p.ovided in which the Federal Insurance Administration has provided flood profiles, as well as the Flood Boundarv- Flood~,ay ~ap and the water surface elevation of the base flood. "Floodway" means the channel of a river or other watercourse and the adiacent ]and areas that must be reserved in order to discharge the base flood without cumulatively increasing the water surface more than one (l) Foot. "Habitable floor" means any floor usable for living purposes, which inc]ndes working, s]eeping, eating, cooking or recreation, or a combination thereof. A floor used only for storage purposes is not a "habitable floor." "lVYobile home" means a structure that is transportable in one or more sections, built on a permanent chassis, and designed to be used with or withoot a permanent foundation when connected to the required utilities. It does not include recreations] vehicles or travel trailers. "New oonstruction" means structures for which the "start of construction" commenced on or after the effective date of this ordinance. "New mobile home Dark or mobile home subdivision" means a parcel or (contiguous parcels) or land divided into two or more moblie home lots for rent or sale for which the construction of facilities for servicing the lot (including, at a minimum, the insta]]ation of utilities, either fins] site grading or the Donring of concrete pads, and the construction of streets) is completed on or after the effective date of this ordinance. "Start of construction" means the first placement of permanent construction of a structure (other than a mobile home) on a site, such as the Dourin~ of slabs or footings or any work beyond the stage of excavation. Permanent construction does not include ]end preparation, such as clearing, ~rading and fil]ing, nor does {t include the intallation of streets and/or walkways; nor cbes it include excavation for a basement, footings, piers or foundations or the erection of temporary forms; nor does it inc}ude the }nsta]]ation on the property of accessory buildings, such as gareges or sheds not occupied as dwelling units or not as pert of a main strncture. For a strncture (other than a mobile home) without a basement or poured footings, the "start of construction" includes the first permanent framing or assembly of the structure or eny part thereof on its piling or foundation. For mobile homes not within s mobile home park or mobile home subdivision, "start of construction" means the affixin~ of the mobi]e home to its permanent site. For mobile homes within mobile home parks or mobile home subdivisions, "start of construction" is the date on which the construction of facilities for servicin~ the site on which the mobile home is to be affixed (including, at e minimnm, the construction of streets, either final site ,grading or the pouring of concrete pads, end installation of utilities) is completed. "Structure" means a welled and roofed building, a mobile home, or a gas or liquid storage tank, that is principally above ground. "Substantial improvement" means any repair, reconstruction, or improvement of a structure, the cost of which equals or exceeds 50 percent of the market value of the structure either: l) Before the improvement or repair is started, or 2) If the structure has been damaged and is bejn,g restored, before the dsmage occurred. For the purposes of this definition "substantial improvement" is considered to occur when the first alteration of 8ny wail, ceiling, floor or other structural part of the building commences, whether or not that alteration affects the external dimensions of the structure. The term does not, however, include either: 1) Any project for improvement of a structure to comply with existing State or local health, sanitary, or safety code spee~flcations which are solely necessary to assure safe living conditions, or 2) Any alteration of a structure listed on the National l~egister of Historic Places or a State Inventory of Historic Places. "Variance" means a grant of relief from the reqnirements of this ordinance which permits construction in a manner that would otherwise be prohibited by this ordinance. SECTION 3.1 LANDS TO WHICH THIS ORDINANCE APPLIES. This ordinance shall apply to all areas of special flood hazards witbln the jurisdiction of the City. SECTION 3.2 BASIS FOB. ESTABLISHING THE AREAS OF SPECIAL FLOOD HAZAI~D. The areas of special flood hazard identified by the Federal Insurance Administration in a scientific and engineering report e~titled, "The Flood Insurance Study for the City of Coppel], Texas," dated August 1, 1980, with accompanying F]ood Insurance Rate Maps and Flood Botmdary Floodway Maps is hereby adopted and attached hereto as Exhibit "A" and declared to he a part of this ordinance. SECTION 3.3 PENALTIES FOR NONCOMPLIANCE. No structure or ]and shall hereafter be constructed, located, extended, converted or altered without full compliance w~th the terms of this ordinance and other applicable regulations. Violation of the provisions of this ordinance by failure to comply with any of its requirements (including violations of conditions and safeguards established in connection with conditions) shall constitute a misdemeanor. Any person who violates this ordinance or fails to comply with any of its requirements shall upon conviction thereof be fined not more than Two Hundred Dollars ($200.00) for each vlo]ation.
