ORDINANCE NO. 212
AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, ESTABLISHING THE
FOLLOWING SPEED ZONE ON THE FOLLOWING STREET: STATE HIGHWAY 121
FROM ITS INTERSECTION WITH THE NORTH CORPORATE LIMIT LINE OF THE
CITY OF COPPELL, SOUTH TO ITS INTERSECTION WITH THE DALLAS-TARRANT
COUNTY LINE, 40 MILES PER HOUR; MAKING IT UNLAWFUL FOR ANY PERSON
TO OPERATE ANY MOTOR OR OTHER VEHICLE ON SAID STREET AT A SPEED
GREATER THAN THE SPEED DESIGNATED; REPEALING ANY PART OF ANY ORDI-
NANCE IN CONFLICT WITH THIS ORDINANCE; PROVIDING A SEVERABILITY
CLAUSE; PROVIDING PENALTIES FOR VIOLATION OF THIS ORDINANCE NOT TO
EXCEED THE SUM OF TWO HUNDRED ($200.00) DOLLARS FOR EACH OFFENSE;
AND ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, construction work is about to commence on that portion of State
Highway 121 which lies within the corporate limits of the City; and
WHEREAS, the City Council is of the opinion that a forty mile per hour speed
limit should be established through such construction sections, while work is in progress
for the safety of the traveling public as well as for the safety of the people working
within the construction area; and
WHEREAS, the State Department of Highways and Public Transportation has
also requested that such speed limit should be established, now, therefore,
BE IT ORDAINED BY TFTE CITY COUNCIL OF THE CITY OF COPPELL~
TEXAS:
SECTION 1. SPEED ZONE ON STATE HIGHWAY
That no person shah operate or drive any motor or other vehicle on that portion
of State Highway 121 from its intersection with the north corporate limit line of the
City of Coppe]l, south to its intersection with that certain common boundary line
known as the Dallas-Tarrant County line, at a greater speed than forty miles per hour,
and any speed in excess of forty miles per hour shah be prima facie evidence that
such speed is neither reasonable nor prudent and is unlawful.
SECTION 2. REPEALING CLAUSE.
Any part of any other ordinance of the City inconsistent or in conflict with
the provisions of this ordinance are hereby repealed.
SECTION 3. SEVERABILITY CLAUSE.
If any section, part of anv section, paragraph or clause of this ordinance is
declared invalid or unconstitutional for any reason, such declaration shall not be held
to invalidate or impair the validity, force or effect of any other sections, part of
sections, paragraphs or clauses of this ordinance.
SECTION 4. PENALTY CLAUSE.
Any person, firm or corporation v~olatin~ any of the provisions of this ordinance
shall be deemed ~lilty of a misdemeanor and, upon conviction, shall be subject to a
fine not to exceed Two Hundred ($200.00) Dollars for each offense, and each day that
such violation continues shah constitute a new and separate offense and shall be
punished accordingly.
SECTION 5. EFFECTIVE DATE.
This ordinance shall become effective immediately upon its passage and pub]i-
cation of its caption as the law in such eases provides.
