OR 204-A-12 Changes "SF-12" to "PD" Planned Development classification AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 204A12 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF COPPELL, TEXAS, AS HERETOFORE AMENDED, SO AS TO CHANGE THE ZONING ON THE HEREINAFTER DESCRIBED PROPERTY TO THE NEW ZONING CLASSIFICATION HEREIN STATED; PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING PENALTIES FOR VIOLATION OF THIS ORDINANCE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City Zoning Commission and the Governing Body of the City of Coppell, Texas, in compliance with the laws of the State of Texas with reference to the granting of zoning changes under the zoning ordinance and zoning map, have given requisite notices by publication and otherwise, and after holding due hearings and affording a full and fair hearing to all property owners generally, the said Governing Body is of the opinion that said change of zoning which is on application of John R. Dobecka should be granted and the Comprehensive Zoning Ordinance of the City of Coppell should be amended in the exercise of its legislative discretion: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. That the Comprehensive Zoning Ordinance of the City of Coppell, Texas, be and the same is hereby amended by amending the Zoning Map of the City of Coppell, so as to give the hereinafter described property the following zoning district classification: Changed from "SF-12" Single Family Residential District District Classification to "PD" Planned Development District Classification, said property being described as follows: BEING a tract of land situated in the S. B. Henderson Survey, Abstract No. 629 Dallas County, Texas and being part of a 3.5 acre tract conveyed to John R. Dobeeka and wife Vickie Dobecka by H. D. Brim, et ux by deed dated April 22, 1960 and recorded in Volume 5321, Page 209 of the Deed Records of Dallas County, Texas and also being part of a 3.5 acre tract conveyed to Cecil J. Dobecka and wife Mary Dobecka by H. D. Brim, et ux by deed dated April 22, 1960 and recorded in Volume 5321, Page 145 of the Deed Records of Dallas County, Texas and being located in the City of Coppell, Texas and being more particularly described as follows: BEGINNIN~ at a point in the centerline of Sandy Lake Road, said point being N.89 17'00"E. a distance of 182.98 feet from the northwest corner of 50.04 feet oto a point for corner; THENCE S.01 35'05"W., a distance of 189.37 feet to the beginning of a curve to the left having a central angle of 09o54'58'' and a radius of 150.00 feet; THENCE along said curve to the left an arc distance of 25.96 feet to the beginning of a curve to the right having a central angle of 09°54'58'' and a radius of 150.00 feet; THENCE along said curve to the right an arc distance of 25.96 feet to the end of saiod' carve; a point for corner; THENCE S.01 ~5'05"W., a distance of 14.97 feet to a point for corner; THENCE S. 880 09'21"E., a distance of 176.96 feet to a point for corner; THENCE S.01 35'05"W., a distance of 476.15 feet to a point for corner in the north line of a 20-foot alley as dedicated by Willowood No. 2 Addition; THENCE N.89°39'46"W., along the north line of said 20-foot alley a distance of 4.1o4.37 feet to a point for corner; THENCE N.0~l~35'05"E., a distance of 487.04 feet to a point for corner; THENCE S.88 09'21"E., a distance of 173.55 feet to a point for corner and the beginning of a curve to the right having a central o~a~.gle of 20°27'05'', a radius of 150.00 feet and a tangent bearing of N.04 01'53"W; THENCE along said curve to the right an arc distance of 53.54 feet to the end of said cur~e and the beginning of a curve to the left having a central angle of 14 50'06" and a radius of 150.00 feet; THENCE along said curve to the left an arc distance of 38.84 feet to the end of sai~ curve; THENCE N.01 35'05"E., a distance of 162.21 feet to the PLACE OF BEGINNING and containing approximately 4.89 acres of land. Zoning on said property to be governed by the Development Plan attached hereto as Exhibit "A" and made a part of this ordinance. SECTION 2. That all ordinances of the City in conflict with the provision of this ordinance be, and the same are hereby, repealed and all other ordinances of the City not in conflict with the provisions of this ordinance shall remain in full force and effect. SECTION 3. That the above described property shall be used only in the manner and for the purposes provided for in the Comprehensive Zoning Ordinance of the City, as amended herein by the granting of this zoning classification. SECTION 4. That should any paragraph, sentence, subdivision, clause, phrase or section of this ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall not affect the validity of this ordinance as a whole or any part or provision thereof other than the part so decided to be invalid, filegal or unconstitutional and shall not affect the validity of the Comprehensive Zoning Ordinance as a whole. SECTION 5. That any person, firm or corporation violating any of the provisions or terms of this ordinance shall be subject to the same penalty as provided for in the Comprehensive Zoning Ordinance of the City, as heretofore amended, and upon conviction shall be punished by fine not to exceed the sum of two hundred dollars ($200.00) for each offense, and that each day such violation shall continue to exist shall constitute a separate offense. SECTION 6. It is necessary to give the property described herein the above mentioned zoning classification in order to permit its proper development and in order to protect the public interest, comfort and general welfare of the City. Therefore, this ordinance shall take effect immediately from and after its passage and publication of its caption, as the law in such cases provides.
