AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING THE
COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF COPPELL, TEXAS, AS
HERETOFORE AMENDED, SO AS TO CHANGE THE ZONING ON THE HEREINAFTER
DESCRIBED PROPERTY TO THE NEW ZONING CLASSIFICATION HEREIN STATED;
PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE;
PROVIDING PENALTIES FOR VIOLATION OF THIS ORDINANCE NOT TO EXCEED
THE SUM OF TWO HUNDEED DOLLARS ($200.00) FOR EACH OFFENSE; AND
DECLARING AN EFFECTIVE DATE.
WHEREAS, the City Zoning Commission and the Governing Body of the City of
Coppel], Texas, in compliance with the ]sws of the State of Texas with reference to
the granting of zoning changes under the zoning ordinance and zoning map, have given
requisite notices by publication and otherwise, and after ho]dlng due hearings and
affording a full and fair hearing to all property owners generally, the said Governing
Body, is of the opinion that said change of zoning which is on application of L&N ]and
Corp. should be granted and the Comprehensive Zoning Ordinance of the City of Coppe]]
should be amended in the exercise of its legislative discretion:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF COPPELL, TEXAS:
SECTION 1. That the Comprehensive Zoning Ordinance of the City of CoDDell,
Texas, be and the same is hereby amended by amending the Zoning Map of the City
of Coppel], so as to gfve the hereinafter described property the following zoning district
classification:
Changed from "MF-]" Multi-Family ResidentialDistrict Classification to "R" Retail
District Classification, said property being described as follows:
Being a tract or parcel of land containing 1.951 acres
located in the James Parfish Survey, A-1139 and the S.A.
& M.G.B.R. Survey, A-1442, Dallas County, Texas, and
more particularly being a portion of that certain 245 acre
tract of land conveyed to George S. Highland by instrument
of record in Volume 79005, Page 872 of the Deed ]~eeords
of Dallas County, Texas, said 1.951 acres being more
particularly described my metes sod bounds as follows:
COMMENCING for reference at the Southwest corner of
that certain 0.758 sere tract of land conveyed to Coppelf
Municipal District No. I by instrument of record in Volume
75222, Page 1202 of the Deed Records of Dallas County,
Texas;
Thence, along the west line of said 0.758 acre tract of
land North 00 deg. 07' 27" East, ] 20.00 feet to the POINT
OF BEGINNING;
Thence, leaving the west llne of said 0.758 acre tract
South 89 deg. 28' 00" West, 933.07 feet to a point for
corner in the easterly line of proposed AHen Road (100.00
feet wide);
Thence, with said proposed easterly line along the arc of
a non-tangent curve to the r;ght, whose Pad;us bears North
77 deg. 19' 58" East, said curve being subtended by a
central angle of 04 deg. ]~l' 37", having a radius of ]150.00
feet and an arc length of 34.~7 feet to a Ooint for corner;
Thence, leaving said proposed easterly line North 89 deg.
28' 00" East, 1058.69 feet to a point for corner in the
east line of the aforementioned 245 acre tract;
Thence, with said east line South 00 deg. 07' ?7" west,
64.13 feet to a point for corner;
Thence, North 89 deg. 52' 33" West, 110.00 feet to a point
for corner;
Thence, South 00 deg. 07' ?7" West, 20.00 feet to the
POINT OF BEGINNING and containing ] .59] acres of land.
SECTION 2. That all ordinances of the City in conflict with the provision of
this ordinance be, and the same are he.eby, repealed and all other ordinances of the
City not in conflict with the provisions of this ordinance sba]l remain in full force
and effect.
SECTION 3. That the above described property shall be used only in the
manner and for the purposes provided for in the Comprehensive Zonin~ Ordinance of
the City, as amended herein by the ~rantin~ of this Zoning' classification.
SECTION 4. That should any paragraph, sentence, subdivision, e!ause, ph.ase
or section of this ordinance be adjudged or held to be unconstitutional, illegal or
invalid, the same shah not affect the validity of this ordinance as a whole or any part
or provision thereof other than the part so decided to be invalid, illegal or
unconstitutional and shall not affect the validity of the Comprehensive Zonin~ Ordinance
as a whole.
SEC~ON 5. That any person, firm or corporation violatin~ ~ny of the provisions
or terms of this ordinance shall be subject to the same Denairy as provided for in the
Comprehensive Zonin~ Ordinanee of the City, as heretofore sinended, and upon
eonvietion shall be Dun/shed bY fine not to exceed the sum of two hundred doll8~s
($200.00) for each offense, and that eaeh day such vio]afion shall eontjnne to exist
shah constitute a separate offense.
SECTION 6. It is necessary to ~ive the property deseMbed berejn the above
mentioned zoning classification in order to permit its proper development ~nd in order
to protect the public interest, comfort ~d general welf~e of the City. Therefore,
this ordinance shall take effect immediately f~om and after jts passage and pub]{eation
of its caption, as the law in such eases provides.
