OR 204-A-02 Amending the Comprehensive Zoning Ordinance of the City AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 204A2 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY, AS HERETOFORE AMENDED, SO AS TO CHANGE THE ZONING CLASSIFICATION ON THE PROPERTY HERE- INAFTER DESCRIBED AND DESIGNATED; PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING PENALTIES FOR VIOLATION OF THIS ORDINANCE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the Cit~z Zoning Commission of the Citv and the governing body of the City, in compliance with the laws of the State of Texas with reference to the granting of zoning changes under the zoning ordinance and zoning maD, have given requisite notices by publication and otherwise, sod have he}d due hearings that have afforded a full and fair hearing to all proDertV owners generaUy and to the Dersnns interested in the area and situated in the area, and WHEREAS, the City Counci] is of the oDinion that the zoning change set forth herein on application of Cadco, Inc. should be granted and in the exercise of its legislative discretion the Comprehensive Zoning Ordinance sheold be sinended to reflect such change. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. That the Comprehensive Zoning Ordinance of the City he, and the same is hereby amended by amending the zoning mad of the City, so as to give the following described property located within the corporate lifoits of the citv, the zoning district c]asslfication 8s bereinafter desi~:nsted: Change said propertv from its present zonine district classification to "PD" Planned Development District Classification subject to the Site Plan attached heretn as Exhibit "A" and made a part hereof for all purposes. SECTION 4. That should 8DV p~.agraD~, sentence, subdivision, clause, Dhrase or section of this ordinance be adjudged or held to he Unconstitutional, illegal or invalid, the same shall not affect the validitv of this ordinance as a who]o or any part or provision thereof other than the part so decided to be invalid, illegal or uncon- stitutional and shall not affect the validitS of the Comprehensive Zoninff Ordinance as s whole. SECTION 5. mhat any person, firm or corporation violating anV of the D-ovisions or terms of this ordinsvce shall be subject to the same penalt)r as provided for jn the Comprehensive Zoning Ordinance of the Citv. as heretofore amended, add Upon con- viction shal] be punished by fine not to exceed the sum of two hundred dollars for each offense, and that each day such violation shall continue to exist shall eonstitnte a separate offense.
