ORDINANCE NO. 203
AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, MAKING IT UNLAWFUL
TO OPERATE A VEHICLE ON ANY PUBLIC STPEET WITHIN THE CITY AT A SPEED
GREATER THAN 30 MILES PER HOUR OR ON ANY PUBLIC ALLEY AT A SPEED
GREATER THAN 10 MILES PER HOUR, EXCEPT WHERE OTHERWISE SPECIFICALLY
DESIGNATED; PROVIDING FOR THE ESTABLISHMENT OF SCHOOL ZONES AND
MAKING IT UNLAWFUL TO OPERATE A VEHICLE WITHIN ANY SCHOOL ZONE AT
A GREATER SPEED THAN 20 MILES PER HOUR; ESTABLISHING SPEED ZONES ON
CERTAIN SPECIFIC STREETS AND MAKING IT UNLAWFUL TO OPERATE A VEHICLE
ON SAID STREETS AT A GREATER SPEED THAN THE SPEED DESIGNATED; SPECI-
FICALLY REPEALING ORDINANCE NO. 167 AND ALL OTHER ORDINANCES IN
CONFLICT WITH THIS ORDINANCE; PROVIDING A SEVERABILITY CLAUSE; PRO-
VIDING PENALTIES FOR VIOLATION OF THIS ORDINANCE NOT TO EXCEED THE
SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE AND ESTAB-
LISHING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL,
TEXAS:
SECTION 1. SPEEDS GREATER THAN 30 MILES PER HOUR ON PUBLIC
STREETS OR 10 MILES PER HOUR ON PUBLIC ALLEYS NOT REASONABLE AND
PRUDENT. A person commits an offense if he operates a vehicle on any pub]it street
within the City at a speed greater than 30 miles per hour or on any public a]]ey at
a speed greater than 10 miles per hour, unless otherwise provided by this ordinance.
Any speed in excess of 30 miles per hour on a public street or ]0 miles per hour in
a public alley, ~ln]ess otherwise provided bv this ordinance, shah be prima fac{e evidence
that the ~Deed is not reasonable or prudent and is unlawful.
S2CTION ~. SPEED IN SCHOOL ZONES; SIGNS IN SCHOOL ZONES. A person
commits an offense if he operates a vehicle in a schoo] traffic zone at a speed greater
than ~0 miles per hour, and any speed in excess of ~{~ miles per }~our shall bo Drirna
facie evidence that the speed is not reasonable nor Drndent and is unlawful Th~
Director of Traffic Control shall designate school traffic zones with appropriate street
markings or signs, which street markings or signs shall be placed at the school zone
by the Director of Traffic Control The speed limit designated for school traffic zones
shall be effective only at time when approrpiate signs advising motorists of the speed
limit are placed in conspicuous places.
SECTION 3. MAXIMUM SPEED LIMITS; DETERMINATION. The Director o~
Traffic Contro] shall determine on the basis of engineering and traffic surveys the
reasonable and safe maximum speed limits for each street within the Citv and s.hmit
recommendations based upon his investigation to the City Council. On the basis of the
recommendations of the Director of Traffic Control, the City Council may alter the
maximum speed limit established by this ordinance as the Council deems necessary.
The Director of Traffic Control shaB post the maximnm and minimum speeds established
by this ordinance by appropriate signs in conspicuous places so that every motorist
may be aware of the speed limits. No sign shall be requi.ed in an urban district where
the maximum speed limit is 30 miles per hour and where there is no minimum speed
limit.
SECTION 4. SPEED ON SPECIFIC STREETS. A person commits an offense
if he operates or drives a vehicle on the following designated streets at a speed greater
than the speed designated b.v this section for that street or portion of that street,
and any speed in excess of the limit provided in this section shall be prima fscie
evidence that the speed is not reasonab!e nor prudent and is un]awfn]:

SECTION 5. REPEALING CLAUSE. All ordinances, inconsistent or in conflict
with the provisions of this ordinance are hereby repealed. Ordinance No. 167 is
specifically repealed.
However, the repeal of existing ordinances by this ordinance shall not affect
or prevent the prosecution or the punishment of any person for any act done or
committed prior to the effective date of this ordinance in violation of any ordinance
hereby repealed; and prosecution for st~eh offenses may be instituted and causes present]V
pending proceeded with in all respects as if such prior ordinance or ordinances bad
not been repealed.
SECTION 6. SEVERABILITY CLAUSE. If any section, part of any section,
paragraph or clause of this ordinance is declared invalid or tinconstitutional for any
reason, such declaration shall not be held to invalidate or impair the validity, force
or effect of any other sections, part of sections, paragraobs or clauses of this ordinate.
SECTION 7. PENALTY CLAUSE. Anv person, firm or corporation violating
any of the provisions of this ordinance shah be deemed ~nli]ty of a misdemeanor and,
upon conviction, shah be subject to a fine not to exceed two hundred do]lsrs f$200.00)
for each offense, and each day that such violation cnntinues shall constitute a new
and separate offense and shall be punished accordingly.
SECTION 8. EFFECTIVE DATE. This ordinance shall become effective fron~
and after its adoption and publication of a caption as required by law.
