ORDINANCE NO. 189
AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, MAKING IT
UNLAWFUL AND AN OFFENSE TO DRIVE OR OPERATE A TRUCK HAVING A
CARRYING CAPACITY OF TWO TONS OR MORE ON MOORE ROAD FROM SANDY
LAKE ROAD TO BELT LINE ROAD WITHIN THE CORPORATE LIMITS OF THE CITY;
PROVIDING AN EXCEPTION IN INSTANCES WHERE DELIVERY OR PICKUP OF
MATERIAL CAN BE ACCOMPLISHED ONLY BY TRAVELING ON SUCH ROADWAY;
REPEALING ALL ORDINANCES IN CONFLICT WITH THIS ORDINANCE; PROVIDING
A SEVERABILITY CLAUSE; PROVIDING PENALTIES FOR VIOLATION OF THIS
ORDINANCE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS FOR EACH
OFFENSE; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL,
TEXAS:
SECTION 1. It shah be unlawful for any person to drive or operate a truck
having a carrying capacity of two tons or more on Moore Road from its intersection
with Sandy Lake Road to its intersection with Belt Line Road, within the corporate
limits of the City, except where actual delivery or pickup of material can be
accomplished only by travel on such roadway and where operator of such truck shall
have in his possession for inspection by police officers, his log book, delivery slips, or
other evidence of his destination and point of origin to justify the presence of the
vehicle on said roadway.
SECTION 2. All ordinances, or parts of ordinances, inconsistent or in
conflict with the provisions of this ordinance are hereby repealed.
SECTION 3. If any srtic]e, paragraph or subdivision, clause, phrase or
provision of this ordinance shall be adjudged invalid or held unconstitutional, the same
shah not affect the validity of this ordinance as a whole or any part or provision
thereof, other than the part so decided to be invalid or unconstitutional.
SECTION 4. Any person, firm or corporation violating any of the provisions
of this ordinance shall be deemed guilty of a misdemeanor and, upon conviction, shall
be punished by a penalty of fine not to exceed the sum of Two Hundred Dollars
($200.00) for each offense, and each and every day such offense is continued shall
constitute a new and separate offense.
SECTION 5. This ordinance shall take effect immediately from and after
the publication of its caption, as the law in such cases provides.
