OR 156 Provides for apportioning of overlapping extraterritorial jurisdiction between Coppell & Grapevine ORDINANCE NO. 156 AN ORDINANCE PROVIDING FOR APPORTIONING OF OVERLAPPING EXTRATERRITORIAL JURISDICTION BETWEEN THE CITY OF COPPELL, TEXAS, AND THE CITY OF GRAPEVINE, TEXAS, PURSUANT TO AND IN ACCORDANCE WITH TEX.REV.CIV.STAT.ANN.ART. 970 A MUNICIPAL ANNEXATION ACT; PROVIDING FOR THE ORDINANCE TO GO INTO EFFECT WHEN AND IF SAME IS ALSO APPROVED BY THE CITY OF GRAPEVINE; AND DECLARING AN EMERGENCY. WHEREAS, the City of Coppell, a General Law City, situ- ated in Dallas County~ Texas~ and the City of Grapevine~ a Home Rule City, situated in Tarrant County~ Texas, have boundary lines that are in close proximity to each other; and WHEREAS~ the governing bodies of the two cities pursuant to and in accordance with Tex.Rev.Civ.Stat.Ann.Art.970 a Municipal Annexation Act desires to apportion their overlapp- ing areas of extraterritorial jurisdiction; and WHEREAS, the two cities are in agreement to take any and all necessary steps to release any boundary claims heretofore made by each of the cities in the areas that will be reserved exclusively to each of the cities; and WHEREAS, the governing bodies of each of the cities are in agreement that it is in the best interest of the two muni- cipalities and for the welfare of their respective citizens to reach an agreement as to the boundary lines of the two cities and to apportion any overlapping extraterritorial jurisdiction of the two municipalities. NOW, THEREFORE~ BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: Section 1. That the City of Coppell does hereby agree~ pursuant to and in accordance with Tex. Rev.Civ. Stat.Ann.Art.970 the Municipal Annexation Act that all the property West of the hereinafter described line is hereinafter exclusively within the extraterritorial jurisdiction of the City of Grapevine. The City of Coppell hereby relinquishes any claim of extra- territorial rights it may have in said area and further the City of Coppell agrees to take any action that may be necessary to relinquish any territorial or boundary claims it may have had in the past into said area. The City of Coppell agrees to pass disannexation ordinances if any of its prior annexation ordinances cover any of the property hereinafter described that is henceforth to be exclusively within the province of the City of Grapevine. The City of Coppell takes this action in apportioning the extraterritorial jurisdiction claims between the City of Coppell on the condition that the City of Grapevine does hereby or here- inafter agree~ pursuant to and in accordance with Tex. Rev.Civ. Star.Ann.Art.970 the Municipal Annexation Act that all the property east of the hereinafter described line is hereinafter exclusively within the extraterritorial jurisdiction of the City of Coppell. The City of Grapevine hereby relinquishes any claim of extraterritorial rights it may have in said area and further the City of Grapevine agrees to take any action that may be necessary to relinquish any territorial or boundary claims it may have had in the past into said area. The City of Grapevine agrees to pass disannexation ordinances if any of its prior annexation Ordinances cover any Of the property hereinafter described that is henceforth to be exclusively within the province of the City of Coppell. The agreed upon line between the municipalities is described as follows: BEGINNING at the point of intersection of the North R.O.W. line of State Highway 121, as it stands on September 1~ 1975, with the Dallas-Denton County line; THENCE in a Southwesterly direction along the said North R.O.W. line of State Highway 121 to lts point of intersection with the Tarrant-Dallas County line; THENCE in a Southerly direction along the said Tarrant- Dallas County line to its point of intersection with the South R.O.W. line of County Road 3012, sometimes called Cottonwood Road and as shown on the official Tarrant County Road Map in use until 1973. Said point being the end oi the line being described. All of the property west of said line is to be exclusive- ly withan the extraterritorial jurisdiction oi the City of Grapevine. The City of Coppell hereby relinquishes any terrxtorlal claim it may have ~nto said territory and agrees to pass appropriate d~sannexation ordinances if any prior annexation ordinances included any of the territory that is to be exclusively within the jurisdiction of Grapevine. All of the property east of said line is to be exclusive- ly within the extraterritorial jurisdiction of the City of Coppell. The City of Grapevine hereby relinquishes any territorial claim it may have into said territory and agrees to pass appropriate disannexation ordinances if any prior annexation ordinances included any of the territory that is to be exclusively within the jurisdiction of Coppell. Section 2. That this ordinance is passed contingent upon and subject to the City of Grapevine approving a similar ordinance or resolution that is passed pursuant to the Texas Municipal Annexation Act. Section 3. The fact that it is imperative that the City of Coppell, Texas, and the City of Grapevine, Texas, agree on a mutual boundary and resolve any dispute or claims relative to overlapping boundaries and overlapping claims of extra- territorial jurisdiction presents an emergency relating to the public health, moral and general welfare that requires this ordinance to be passed on an emergency basis.
