AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING CHAPTER 11
OF THE CODE OF ORDINANCES OF THE CITY OF COPPELL, THE COPPELL
INDUSTRIAL WASTE CODE TO REVISE THE ALLOWABLE CONCENTRATIONS OF
PERMITTED DISCHARGES; PROVIDING A FORM FOR PERMIT APPLICATION FOR ANY
INDUSTRIAL USER; PROVIDING FOR SAMPLING AND TESTING AT THE COST OF THE
INDUSTRIAL USER; PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM
OF ONE THOUSAND DOLLARS ($1,000.00) FOR EACH OFFENSE; PROVIDING A
REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE AND DECLARING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS:
SECTION 1. AMENDING CODE SECTION 11-~--1
The City of Coppell Code of Ordinances is hereby amended by adding the following
definition:
"SIGI~IIFICANT INDUSTRIAL USER (SUD means any person or industrial user who
is connected or desires to connect to the City's domestic wastewater collection system
and meets at least one of the following criteria:
(i) Average industrial wastewater discharge rate greater than 50,000 gpd.
(ii) BOD and or suspended solids concentrations in industrial waste water
greater than 250 mg/1.
(iii) Industrial category regulated by National Pretreatment Standards as
promulgated by the United States Environmental Protection Agency."
SECTION 2. AMENDING CODE SECTION 11-2-4
The City of Coppell Code of Ordinances is hereby amended by amending Subsection
B of Section 11-2-4 to read as follows:
The maximum allowable concentrations of heavy metals and other pollutants
stated in terms of milligrams per liter (rag/l) determined on the basis of
individual sampling in accordance with "Standard Methods" are:
1. Arsenic 0.05 rag/1
2. Barium 2.0 rag/1
5. Chromium 3.5 rag/1

8. Manganese 1.0 mg/1

SECTION 3. AMENDING CODE SECTION8 11-2-17, 11-2-18 end 11-2-19
The City of Coppell Code of Ordinances is hereby amended by amending code
Sections 11-2-17, 11-2-18 and 11-2-19 to read as follows:
"Section 11-2-17 INDUSTRIAL COST RECOVERY FEES
A. The City shah require SIU's to pay applicable fees for:
sampling and testing to determine compliance;
disconnection/reconnection of service resulting
from noncompliance;
abnormal strength wastes;
additional costs incurred by City or POTW in
transporting or treating wastes;
filing, revision, or renewal of permit application.
Section 11-2-18 VIOLATIONS
The City shall provide public notification for instances
of violation.
The City shall deny/revoke permit, disallow/disconnect
service, assess civil or criminal penalties, and seek
other available legal and equitable remedies against
SIU for:
1. discharge to sewerage system resulting in
violation of POTW's discharge permit conditions;
2. hazard to health or life of POTW personnel or
users of receiving waters;
3. violation of any applicable ordinance or
regulation;
4. false information transmitted to approving
authority through permit application, monitoring
reports, etc.

CONDITIONS OF PERMITS
For each existing and future SIU, the City shall require
said user to complete and submit a permit application
containing that information specified in the attached
sample application (Exhibit 1). The Trinity River
Authority of Texas (hereinafter called Authority), shall
be provided a copy of the permit application within
thirty days after receipt by City. Authority shall
provide comments on said application within thirty days
of receipt and return comments to City. Failure to
comment within thirty days of receipt of the application
shall be construed as concurrence by Authority. After
approval of the permit application for both City and
Authority, the City may issue a permit to discharge
which shall be as shown on Exhibit 2. Said permit to
discharge shall be required of all SIU's before said user
will be allowed to discharge industrial wastes into the
sewage system. A copy of the permit to discharge
shall be forwarded to the Authority.
The City shall require SIU's to comply with applicable
Federal Categorical Pretreatment Standards as well as
any applicable state and local standards.
The City shall maintain certain information contained
in permit applications as confidential at SIU's request.
The City shall disallow dilution as a means of reducing
pollutant concentrations in an SIU's waste stream.
The City shall be authorized to enter SIU premises at
any time for independent monitoring, inspection, or
review of applicable records to determine compliance.
The City shall develop and require adherence to SIU
compliance schedules.
The City shall require self-monitoring and reporting at
SIU's expense.
H. The City shall choose or approve laboratory to analyze
industrial wastes."
SECTION 4. PENALTY CLAUSE
Any person, firm or corporation violating any of the provisions of this ordinance
shah be deemed guilty of a misdemeanor and, upon conviction, shall be punished by a
penalty of fine not to exceed the sum of One Thousand Dollars ($1,000.00) for each
offense, and each and every day such offense is continued shall constitute a new and
separate offense.
SECTION 5. REPEALING CLAUSE
All ordinances, or parts of ordinances, inconsistent or in conflict
provisions of this ordinance are hereby repealed.

SECTION 4. SEVERABILITY CLAUSE
If any article, paragraph or subdivision, clause or provision of this ordinance
shall be adjudged invalid or held unconstitutional, the same shall not affect the validity
of this ordinance as a whole or any part or provision thereof, other than the part so
decided to be invalid or unconstitutional.
SECTION 6. EFFECTIVE DATE
This ordinance shall take effect immediately from and after the publication of
its caption, as the law in such cases provides.

Ordinance number has been adopted for the purpose of regulating the
quality of industrial wastewaters contributed to the sanitary sewer. The
objectives of the Ordinance are to prevent damage or obstruction to the sewer,
to avoid interference with the regional wastewater treatment plant operated by
the Trinity River Authority, and to comply with state and federal regulations
regarding pretreatment of industrial wastes.
Significant industrial users must obtain a Permit to discharge Industrial
wastewaters to the sewer. The Permit authorizes your discharge and sets forth
criteria for discharge quality and requirements for reporting.
The attached application for a Permit must be completed and returned to the
mailing address shown below within |80 days. A fee of must
accompany this Application. The City and the Trinity Ri veF'Authority will
review your application. Additional information such as evidence of
treatability may be requested fro~ either entity. The City will return a
Permit to you upon approval of your application and will either approve or
deny said application within 90 days of its receipt by City.

The discharge of any pollutant at a level in excess of that Identified and
authorized by this permit, shall constitute a violation of the terms and
conditions of this permit. Such a violation may result in permit
revocation and/or the imposition of civil and/or criminal penalties.
8. HONITORING AND REPORTING
Permittee $hal1 collect representative samples of the wastewater
discharge and analyze these waters for the pollutants indicated in
Section A. Where feasible, samples shall be obtained using flow
proportional composite sampling techniques specified in the applicable
Categorical Pretreatment Standard. ~here composite sampling ts not
feasible, grab sampling Is acceptable. The permittee shall collect and
analyze sample(s) during a period.
Permittee shall summarize monitoring information on a Copy of the
attached "Significant Industrial User Self Monitoring Report" form.
