CITY MANAGER'S REVIEW: MEMORANDUM February 5, 2002 TO: FROM: VIA: SUBJECT: Mayor & City Council Clay Phillips, Deputy City Jim Witt, City Manager ~/f//~//./ Tennis Center The following information is being provided to assist you in reviewing the proposed tennis center one final time before we proceed with the bidding process. We thought it prudent to review the project given the fact that we have recently enacted the Budget Reduction Contingency Plan at the staff level and will be bringing forth a budget amendment on February 12 to reflect those changes. The tennis center project will have an impact on both the debt service and operations & maintenance components of future budgets. We are simply providing one more look at the issues involved before proceeding. PROJECT REVIEW To assist in a review of the discussions regarding the project, a copy of a memorandum dated August 24, 2001 is attached for your review. This memorandum is a brief review of the actions taken by the Bond Advisory Steering Committee, the voters, the City Council and the CRDC leading up to the meeting of August 28, 2001. The project was discussed in some detail at the August 28, 2001 City Council meeting. In addition to facility design issues, the discussions included some detail regarding the costs associated with staffing and operations as well as the issue of membership fees and user fees. The information presented indicated that the staffed tennis centers in our region were subsidized by as much as 30% - 40% of operating costs that ranged in the $300,000 - $400,000 level annually. The information discussed also indicated that membership and user fees are widely used. At the conclusion of the discussions regarding the project, staff was instructed to proceed with a design including six courts with two additional courts as an add/alternate, restroorn/concession areas that would support some level of staffing, associated parking and grading. The construction documents are being developed at this time following these parameters. Tennis Center Project Update 2/5/02 Page 2 of 6 CURRENT ISSUES Given the current financial conditions, there are several issues that staff felt compelled to discuss with you prior to proceeding further. The issues are 1) access/staffing, 2) membership/user fees, 3) facility design, and 4) economic conditions. These issues are discussed below. Following the discussion we have provided two alternative design recommendations and one fee structure recommendation that we believe have merit at this time. ACCESS/STAFFING What type of access is expected? Should staffing be the desired route, discussions have centered on the need for a tennis pro and/or the need for an attendant. Many options are possible regarding staffing. Tennis pro services could be provided on a contractual basis. In the event the facility is staffed by an attendant to monitor use and access, a minimum of 2.5 - 3.0 full time equivalent positions will required to staff the facility from 8:00 a.m. to 10:00 p.m. daily as was discussed at the August 28, 2001 City Council meeting. Attendant costs could be recovered through user fees or subsidized by the General Fund. Electronic access could be an option should the City Council decide staffing the facility would be unnecessary or inappropriate at this time. This solution would be possible by using IVR telephony technology currently in place for patrons to reserve courts and receive access codes. If this option is selected, reservations and questions would be handled at the Coppell Aquatics & Recreation Center. A third option would be to privatize the staff/program component of the facility. Some of the facilities in our region have done so. Carrollton is currently converting to a privatized management environment. Southlake has attempted to do so, and while it has been problematic, they are continuing to pursue this option. In order to privatize the operation fully, we would most likely need to construct a full service facility as has been designed thus far with restrooms, meeting room, office, display space and concessions in order to attract a tennis management firm to the complex. In so doing, we could be left with more facility than we need or could staff in-house should the privatized concept fail. The question of facility access and staffing must be definitively determined as these issues have a direct bearing on the facility design. MEMBERSHIP/USER FEES What is the City Council's direction regarding membership fees and/or daily use fees? A membership structure similar to the one used at the Coppell Aquatics & Recreation Tennis Center Project Update 2/5/02 Page 3 of 6 Center could be employed. In such a case, members would use the courts for no additional fee while non-members would pay court rental fees based on a per hour use. Member benefits similar to those enjoyed by Coppell Aquatics & Recreation Center members could also be available. These could include reduced fees for classes, tournaments, and preferred court reservation opportunities. A joint membership to both the tennis center and the Coppell Aquatics & Recreation Center could also be offered. Information presented at the August 28, 2001 City Council meeting indicates that several of the tennis centers use some form of membership and/or court rental fee structure. This information is attached for your review. The issue of user fees is important, as it will have a direct beating on the amount of subsidy that will be required from the General Fund. FACILTY DESIGN Once the staffing and fee questions have been answered, facility design can be completed. Several options are available to the City Council regarding facility design and construction. They options appear to be as follows: 1. Construct a full service facility with 6 - 8 courts, restroom/concession building suitable for full staffing and access issues. * 2. Construct a facility with 6 - 8 courts and restroom/public space building suitable for minimum staffing and electronic access. 3. Construct a facility with 6 - 8 courts and minimal restroom facilities and electronic access only. ** 4. Construct 6 - 8 courts only with electronic access. 5. Place the project on hold. (Additional 2 courts will cost approximately $200,000.00 per current estimate) (* Full service pro shop & restroom facility cost is approximately $310,000.00) (** Minimal restroom and storage facility cost is approximately $126,000.00) In the opinion of staff we believe it is necessary to either staff the facility or provide electronic access. Simply building courts that are totally accessible 24 hours per day without secured access or staffing would be a maintenance problem given the likelihood of misuse and abuse. Based on other electronic security items, we believe electronic access can be accomplished for under $10,000.00. Tennis Center Project Update 2/5/02 Page 4 of 6 ECONOMIC CONDITIONS What beating, if any, should current economic conditions, the implementation of the Budget Reduction Contingency Plan and resulting impacts to the 5 Year Plan and future budgets have one this project? Staffs concern regarding a fully staffed facility funded by the General Fund is directly related to the fact that the Budget Reduction Contingency Plan and direction regarding future staffing allocations within the 5 Year Plan have dictated less staff than originally anticipated, not more. To staff a new function would be counter to the direction dictated by the recent budget expenditure reductions regarding overall staffing in the organization. One possible solution to this issue would be to treat the facility as a hybrid "enterprise" fund allowing the revenues generated by the facility to be used to offset the expenses incurred for operations. In so doing, programs that create a positive cash flow continue. Those that do not are discontinued unless the overall fund balance in the enterprise remains positive. Use patterns can be monitored and hours of operation adjusted accordingly. Certain program offerings can be designed in this manner at a minimum. We did not feel it would be acceptable if we did not give the City Council a chance to review this issue prior to proceeding on a course that might be counter to what you now think is appropriate. STAFF RECOMMENDATIONS Facility Design Several design and operational scenarios can be created using various combinations of options discussed above. Given the current state of revenues and the uncertainty regarding the immediate economic future, staff offers the following alternative recommendations regarding overall facility design. Place the project on hold: This option would allow us to take a "wait and see" approach with this project as we have done with several items in the current budget and Five-Year Plan. Build a facility with a scaled down restroom and lobby space that is designed for future expansion. Provide lessons, tennis pro services and other program offerings via contract services using an enterprise fund approach. Provide seven day per week access with a combination of staff attendants for prime use time periods and electronic access technology and/or volunteer staffing for less active time periods as follows: Tennis Center Project Update 2/5/02 Page 5 of 6 March through October Staffed: 8:00 a.m. to 11:00 a.m. 5:00 p.m. to 10:00 p.m. Electronic/Volunteer Access: 11:00 a.m. to 5:00 p.m. November through February Electronic/Volunteer Access: 8:00 a.m. to 9:00 p.m. This option will have the least amount of negative impact on future operational budgets while allowing the recreational opportunity to remain on track. The facility and operations can be expanded when demand dictates and funds allow. The volunteer concept must be clearly defined with regard to responsibilities. Reduced membership fees or reduced court fees could be used as incentives to attract volunteer staff. Fee Structure The issues of program offerings, fees for lessons, tournaments, clinics and other activities have not been discussed in any detail. It would be staffs recommendation that these be treated in a similar fashion as they have been at the Coppell Aquatic & Recreation Center. If done in this manner, staff will develop program offerings as we move forward and fees will be based on a cost recovery model. Membership and court use fees could follow the model below: 1. Family membership program with annual fees in the $350 - $450 range. o Joint family membership with Aquatics Center with lower fee than would be the case if person were a member of each in the $650 - $700 range. Individual memberships priced appropriately when compared to family membership fees. Individual court fees for non-members set at a rate making annual memberships more attractive to regular users. Tennis Center Project Update 2/5/02 Page 6 of 6 ADDITIONAL INFORMATION In addition to the August 24, 2001 memorandum discussed earlier, we have also included attachments with information on users fees, membership fees, numbers of members at various centers, per court costs, restroom/concession building costs, staffing levels, program offerings and other pertinent information. CLOSING COMMENTS Once again, if it is the consensus of the City Council to stay the course as presently planned, we are certainly ready to do so. However, we did not want to continue without giving thought to the current economic and revenue conditions in our community. Staff does not believe this facility will recover costs fully as all of the other tennis complexes in our area appear to be subsidized to some degree. Please feel free to call if you have any questions regarding the issue. We will discuss the project further at the February 12 City Council meeting. MEMORANDUM August 24, 2001 TO: FROM: VIA: SUBJECT: Mayor & City Council Clay Phillips, Deputy Cit~y~,~anager iWsitt ' i 2 The following information is being provided to assist you in the decision making process regarding the proposed tennis center. As you know, this item was pulled from the last City Council agenda and held over until the August 28 meeting. The project has been discussed now for several months. A review of the bond referendum results is provided as the foundation for the discussion. A recap of previous City Council Work Session and Regular Session discussions between the City Council and City Staff and a recap of discussions between the CRDC and City staff regarding the project are also provided. Hopefully, this information will provide the entire Council with the requisite information necessary to continue the discussions and arrive at a decision regarding how staff should proceed with this project. 1999 Bond Referendum A total of $8,685,000 was included in the Park Improvements & Equipment proposition as approved in the bond referendum. Of that amount, $785,000 was earmarked for the design and construction of the tennis center. Specifically, the Parks, Recreation and Quality of Life Sub-Committee included in their recommendation that six (6) courts be included as phase one of the project. Discussions at the Sub-Committee and Bond Advisory Steering Committee meetings included other amenities such as restrooms, operator's office, merchandising shop and future court expansion. The recommendation of the Steering Committee was as described above. September 12, 2000 City Council Work Session Staff produced information concerning site selection for the Tennis Center. Included for consideration as potential sites were the Baptist Foundation land that had been recently acquired, the current Service Center site, Andrew Brown Jr. Park -West, Wagon Wheel Tennis Center Project 8/17/01 Page 2 of 3 Park and MacArthur Park. Site selection criteria as defined by Schrickle, Rollins and Associates were also presented. The City Council removed from consideration the Baptist Foundation property. Site constraints and/or flood plain issues removed MacArthur Park and Andrew Brown Jr. Park -West sites from consideration. Staff was asked to provide additional information regarding the remaining two sites at a future date. December 12, 2000 City Council Work Session Staff presented three (3) schematics of very basic site/master plans for the project. A design showing a split court concept was reviewed for the Service Center Site. A design placing the project on the northwest comer of Wagon Wheel Park was reviewed. A third design for the southwest comer of Wagon Wheel Park was also reviewed. After some discussion, Mr. Witt recommended the southwest comer of Wagon Wheel Park as the site for the Tennis Center. This met with general approval for several reasons. Proximity to residential neighborhoods was problematic concerning the Service Center site. The site at the northwest comer of Wagon Wheel continued to generate comment regarding security and safety due to its relative location away from the remainder of the park. As no funding had been allocated for parking, the newly constructed parking at Wagon Wheel Park could be used jointly if the southwest comer location were used. December 12, 2000 City Council Regular Session A contract for $25,000 was before the City Council for approval to proceed to final schematic and Master Plan design for the project. Mr. Witt gave a brief overview of the bond proposal that authorized the project. He reminded the City Council that the $785,000 was for both design and construction and did not include additional funding for parking. Staff also sought approval to include two additional courts for a total of eight (8) courts. Discussion followed regarding expansion possibilities and other amenities. Specifically, questions concerning the pavilion, pro shop and a manned office and their funding were discussed. Mr. Witt explained that those amenities would be included only if money would allow. The City Council by unanimous vote approved the Master Plan design contract for eight courts. Tennis Center Project 8/17/01 Page 3 of 3 CRDC Discussions Staff has had preliminary discussions with the CRDC concerning their willingness to fund additional amenities should the City Council approve such. Improvements to Wagon Wheel Park do fall into the scope of the CRDC's mission as Wagon Wheel Park is the athletic complex authorized by the 4B sales tax referendum. The possible amenities could include additional parking, restrooms, an office, a pavilion and a playground. No decisions have been made by the CRDC regarding this issue. The CRDC received an update from staff regarding this project at their August 20 meeting. The CRDC will not be forwarding any recommendations regarding additional funding for the Tennis Center until after the City Council determines the desired scope of the project. Current Issues Before moving to the next step in the design process, staff needs clear direction from the City Council on this project. The City Council Work Session scheduled for August 28 will allow staff an opportunity to get on the same page with the entire City Council concerning this project. Staff and the architect will be presenting the Master Plan for the project at the August 28 City Council Work Session. In addition, I have directed staff to have two design contracts available for approval that night. The first will be for design of phase one including eight (8) tennis courts. This is in keeping with the original direction given by the City Council on December 12, 2000. The second contract will be for the design of the entire Tennis Center including an expanded number of courts, restrooms, a pro shop/office, a pavilion, and a playground. The City Council will be able to approve one contract or the other, or direct staff to revise either as desired, depending upon the deliberations that evening. WHEREAS, the City Planning and Zoning Commission and the governing body of the City of Coppell, Texas, in compliance with the laws of the State of Texas and pursuant to the Comprehensive Zoning Ordinance of the City of Coppell, have given requisite notices by publication and otherwise, and after holding due hearings and affording a full and fair hearing to all property owners generally, and to all persons interested and situated in the affected area and in the vicinity thereof, the said governing body is of the opinion that Zoning Application No. S-1195 should be approved, and in the exercise of legislative discretion have concluded that the Comprehensive Zoning Ordinance and Map should be amended. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. That the Comprehensive Zoning Ordinance and Map of the City of Coppell, Texas, duly passed by the governing body of the City of Coppell, Texas, as heretofore amended, be and the same is hereby amended to grant a change in zoning from "TC" (Town Center) to "TC- S.U.P.-1195" (Town Center, Special Use Permit-1195) to grant a special use permit to allow for the 1 45836 construction of a telecommunications tower at Andrew Brown Community Park Central located at 364 North Denton Tap Road, along the east side of North Denton Tap Road, north of Parkway Boulevard, for the property described in Exhibit "A" attached hereto and made a part hereof for all purposes.. SECTION 2. That the Special Use Permit for a communications tower is hereby approved subject to the following special conditions: (A) That project construction shall be completed by March 1, 2002. (B) That construction shall not interfere with any activities being held at the park. (C) That all vehicles, equipment, and materials shall be prohibited fi.om game fields at all times. (D) That any and all damage to the park facility or utilities, including but not limited to parking lot, landscape, irrigation system, sidewalks, and concession building(s), shall be repaired by the contractor with the approval and acceptance of the Coppell Parks Department, or shall be repaired at the expense of the contractor. (E) That parking shall not be altered and there shall not be reserved or designated parking for Sprint, PCS. (F) That all development shall be in accordance with the approved site plan/survey, detail site plan and building elevations, which are attached hereto and incorporated herein by reference as Exhibits "B", "C" and "D", respectively, and such development shall not interfere or disrupt the existing service provided by AT&T Wireless Services. 2 45836 SECTION 3. That the site plan/survey, detail site plan and elevation plan, attached hereto as Exhibits "B", "C" and "D", respectively, and made a part hereof for all purposes, are hereby, approved. SECTION 4. That the above property shall be used only in the manner and for the purpose provided for by the Comprehensive Zoning Ordinance of the City of Coppell, as heretofore amended, and as amended herein. SECTION 5. That all provisions of the Ordinances of the City of Coppell, Texas, in conflict with the provisions of this ordinance be, and the same are hereby, repealed, and all other provisions not in conflict with the provisions of this ordinance shall remain in full force and effect. SECTION 6. That should any sentence, paragraph, subdivision, clause, phrase or section of this ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall not affect the validity of this ordinance as a whole, or any part or provision thereof other than the part so decided to be unconstitutional, illegal or invalid, and shall not affect the validity of the Comprehensive Zoning Ordinance as a whole. SECTION 7. An offense committed before the effective date of this ordinance is governed by prior law and the provisions of the Comprehensive Zoning Ordinance, as amended, in effect when the offense was committed and the former law is continued in effect for this purpose. SECTION 8. That any person, firm or corporation violating any of the provisions or terms of this ordinance shall be subject to the same penalty as provided for in the Comprehensive Zoning Ordinance of the City of Coppell, as heretofore amended, and upon conviction shall be punished by a fine not to exceed the sum of Two Thousand Dollars ($2,000.00) for each offense; and each and every day such violation shall continue shall be deemed to constitute a separate offense. 3 45836 SECTION 9. and the publication of its caption, as the law and charter in such cases provide. In September 2001, the City of Coppell received a request from Doug Ralston, of Ralston Investment, for the abandonment of a portion of Cotton Road. At the time of the original request, Mr. Ralston was requesting to abandon the northern half of Cotton Road. Because a partial abandonment of Cotton Road would leave a substandard roadway section, Mr. Ralston was instructed to contact the property owner to the south, DFW Airport, to obtain their support for the abandonment of the entire roadway. Mike Pyles, Manager of Airport Real Estate, responded to the City of Coppell that DFW Airport had no objections to the abandonment and would include the southem half of the abandonment into their property once the City of Coppell completed the abandonment. Mr. Pyles informed me that the City of Irving abandoned the north/south portion of the roadway which the easement of Cotton Road tied into, Radio Road in the City of Irving, in 1998. Therefore, the section of Cotton Road that was remaining is a dead- end section of roadway between the abandoned portion of Radio Road and Royal Lane. Once confirmation was provided that the section of Cotton Road was no longer necessary as a thoroughfare, the City of Coppell contacted the utility companies to insure that there were no existing or proposed utilities within the right-of-way. We received responses from Oncor Electric Delivery Company (formerly TXU Electric Company), AT&T Broadband, Verizon, and Southwestern Bell. The only utility company that had utilities in the area was Oncor Electric. They have an existing underground electric line at the far east end of the proposed abandonment and an overhead electric line along the north side of the abandonment. Their only request was that the City of Coppell retain the abandoned area as an easement. In reviewing the abandonment of Radio Road approved by the City of Irving in 1998, the City of Irving also retained the abandoned right-of-way as a utility easement. Because of the abandonment of Radio Road by the City of Irving in 1998 that created a dead-end thoroughfare and because the City of Coppell has no plans to improve or utilize Cotton Road as a thoroughfare and upon the request of the property owner to the north and the concurrence of the property to the south, staff request that City Council approve the ordinance abandoning Cotton Road in its entirety from Royal Lane east to its intersection with I.H. 635 and the previously abandoned Radio Road Staff further requests that the abandoned area be retained as a utility easement. In the 1970's, the City of Coppell and the Trinity River Authority (TRA) entered into an agreement whereby TRA issued revenue bonds and constructed the Half Million Gallon Storage Tank and the Sandy Lake Road Pump Station for the City of Coppell. The City of Coppell and TRA also entered into a contract whereby the City of Coppell purchased water from TRA. In essence, TRA purchased water from the City of Dallas and supplied the water to the City of Coppell. Since the 1970's, the City of Coppell has constructed other ground storage tanks and pump stations at Village Parkway and entered into additional agreements with the City of Dallas to purchase water directly from the City of Dallas. However, we still have the agreement with TRA to repurchase water from TRA and TRA is still the lawful owner of the Half Million Gallon Storage Tank and Pump Station on Sandy Lake Road. The revenue bonds, which TRA issued, to construct the improvements have been repaid by the City of Coppell. I have had numerous conversations with representatives of TRA concerning the water contract and the official conveyance of the facilities to the City of Coppell. The item before you this evening is a conveyance of the facilities to the City of Coppell. Council may recall that the facilities on Sandy Lake Road are part of the development agreement between the City of Coppell and St. Joseph Village. The agreement states that the facilities will be removed from the site and the site will be transferred to St. Joseph's in exchange for a different location off of Sandy Lake Road. This conveyance is the final step necessary to begin the demolition of the facilities. Staff recommends approval of acceptance of conveyance of the water facilities from TRA to the City of Coppell. I will provide additional information in the future when the contract between the City and TRA has been terminated. Staff will be available to answer questions at the Council meeting. Pitched roofs shall have roof'mg material of a lusterless neutral/earth tone or green color. Green colors shall be limited to dark forest greens, gray greens, pale bluish-gray greens, slate greens and copper patina. Metal roofs may be standing seam either with a baked-on lusterless finish or made of copper. Exterior wall surfaces should consist of no more than three colors--a base color, and/or a trim ¢olor, and/or an accent color. The base color may be utilized on up to 100% of the surface area of any one fagade of a building. Another color, other than a base color, shall be permitted on up to only 5 % of the surface area of any one fagade, and an accent color on up to only 1% of the surface area of any one faCade. For calculation purposes, wall surfaces should include eaves, gables and parapets, but should exclude roofs, awnings or signs. Glass should not exceed 50 percent of the total area of any one facade of a building. Awnings are limited to canvas, or a lusterless, non-metal material that closely resembles canvas, at least 98 percent of which is a single deep or neutral solid color. The remaining up to 2 percent, if different, shall be contrasting. Awnings shall not be backlit. Lettering and logos should be limited to a monogram, not exceeding 20% of the sign area. DISCUSSION: Recently there have been discussions concerning the parking requirement for restaurant uses. Last month, Chili's Too received SUP approval for a 3,700 square-foot restaurant with 128 seats. Per our current requirement, of one parking space per 100 square feet, only 37 parking spaces were required. This restaurant will be located in a small retail center, where "overflow" parking opportunities will be limited. Similarly, the recent approval of the expansion of 7-Salsas could only be approved contingent upon relief granted from the Board of Adjustment to allow for a three parking space variance. Staff is concerned that if not enough parking is provided on site, customers will seek other places to park. Parking within a larger shopping center, i.e. Tom Thumb or the former Minyard's shopping center may be less problematic, given the amount of parking available and the hours of operation of other retailers in the center, allowing for shared parking opportunities. But in small centers, such as the two discussed above, parking for the restaurants may overflow to adjacent land uses (i.e. the YMCA, Comerica Bank) or on the street. A deficiency in parking is also a problem for freestanding restaurants, where "shared" parking opportunities are not available. For example, Dickey's restaurant on Denton Tap Road adhered to the requirement of one space per 100 square feet of floor area when the restaurant was constructed. However, when it opened, an additional 12 parking spaces needed to be provided off-site to accommodate employees and customers. To research this issue, staff surveyed other cities' restaurant parking requirements, and reviewed existing restaurants in Coppell. As detailed in the following table, various parking requirements are based on the square footage of the restaurant, number of seats, or a combination of both. Addison a. Restaurants: (1/70 sq. ft.) One space for 70 square feet of floor area for all free-standing buildings, unless it is part of a shopping center or mixed-use development. · Parking regulations/restaurants in mixed-use developments. a. If all buildings which are part of the development total less than 30,000 square feet in area and the development has more than 40 percent of its floor area devoted to restaurant uses, the parking for the restaurant uses shall be provided at the ratio of one space for every 70 square feet of gross restaurant floor area. b. Freestanding restaurants which occur within the mixed-use developments shall be required to provide parking at the ratio of one parking space for every 100 square feet of gross floor area if the property is deed restricted or if covenants exist which allow the restaurant the use of the entire on- site parking provided by the development. Such on-site parking must adjoin and/or be contiguous to the restaurant use. When there are no deed restrictions or covenants allowing restaurants the use of on-site parking, freestanding restaurants in mixed-use developments shall be required to provide parking at the ratio of one parking space for every 70 square feet of gross floor area. c. In the case of a restaurant development occurring in an unfinished center, the center must provide enough parking so as to give the restaurant use a parking requirement of one space for every 70 square feet. Page 2 of 5 Item #6 The most restrictive parking requirement based on square footage is the Town of Addison, which requires one space per 70 square feet, however, one space per 100 square feet is permitted if shared parking opportunities exists within the shopping center. One space per 100 square feet is a fairly standard requirement for restaurants as required in Grapevine, McKinney, Carrollton, Denton, Plano, Southlake and Allen. Drive-through restaurants generally have a higher parking ratio, requiring one space per 50 to 75 square feet. Parking requirement on a per seat basis is also utilized. The most restrictive being the City of Irving where one space per 2.5 seats is required, and one space per three seats is required in Denton, Mesquite, McKinney and Haltom City. The next step was to analyze these various parking requirements in relation to the existing restaurants in Coppell. The fast-food and freestanding restaurants generally provide more parking than would be required under the per seat requirement and/or the 1 per 100 square feet. Therefore, this revision should not impact those existing restaurants. The issue is the parking in existing retail centers, less than 30,000 square feet, where overflow parking is not readily available. In these centers, this additional per seat parking requirement will address this deficiency. Stacking/Queuing for Drive-in/through facilities A related issue is a requirement for the provision of stacking or queuing for drive- through facilities. Currently the City ordinances are silent on this issue. Reviewing the most recently approved SUP's for drive-throughs in the City of Coppell, Grandy's will be providing queuing for 5 spaces, Jack-in-the-Box has 4 spaces prior to the order board and an additional 4 spaces prior to the pick-up window. It appears that a minimum queuing/stacking of 5 spaces is a reasonable requirement, adding to that requirement that no queuing/stacking shall occur in any designated fire lane. RECOMMENDATION TO THE PLANNING AND ZONING COMMISSION: Staff recommends APPROVAL of the proposed text amendments: Amend Section 12-3 I-6.28 to read as follows: Restaurant, night club, caf6 or similar recreation or amusement establishment: One parking space for each 100 square feet of floor area, or one space per three (3) seats Item #6 Page 4 of 5 whichever is greater. "CITY OF COPPELL ENGINEERING - EXCELLENCE BY DESIGN" For some time now the City of Coppell has been experiencing maintenance issues with pavers throughout the community. Once a complaint is received it is investigated and if the paver failure creates a dangerous driving situation then a temporary asphalt patch is provided to make the roadway driveable and safe. A crew is then scheduled to perform the task of removing the failed section of pavers, trying to determine the cause of the failure so that it can be repaired and then the pavers are reinstalled. Our experience has been that once the concrete foundation beneath the paver section has started to fail it becomes an ongoing situation where the pavers continue to fail. This ordinance will require the use of stamped concrete within thoroughfares where pavers are now required. The two exceptions within the thoroughfare are: 1) concrete pavers within median noses when a left turn lane is constructed where paver bands currently exist within the road; 2) concrete pavers within a deceleration lane where paver bands currently exist within the road. Also, paver bands may be allowed at Commercial shopping centers and Industrial parks if the installation is not within a dedicated right of way of the City of Coppell. The color scheme and pattern will be the same as the band at the MacArthur/Sandy Lake Road intersection. The stamped concrete will be Red Clay - Bomanite Integral Color with Bomanite Natural Gray release, or an approved equal and Gunmetal Gray - Bomanite Integral Color with Cobblestone Gray Release, or an approved equal. The pattern will be Running Bond Used Brick. Staff recommends approval of an ordinance that will allow the utilization of stamped concrete in lieu of concrete pavers throughout the City of Coppell. General Fund The General Fund Revenues are being decreased $1,714, 213. The majority of this decrease is from Sales Tax Revenue ($646,000), Building Permits ($600,000), interest earnings (200,000) and fines ($400,000). Increases in various other accounts compensate for the difference. Expenditures for the General Fund are decreasing overall ($705,797). Attached is a spreadsheet that shows implementing the 10% Contingency plan, the hold on Capital items, the hold on new personnel and the encumbrance carry-over. Water/Sewer Fund Water/Sewer Fund expenses are being increased by $32,001 for encumbrance carry-overs. Utility Operations $28,186 Encumbrance carry-over. Utility Billing 3,815 Encumbrance carry-over. Child Safety Revenues are being amended to reflect the collection of this fee, which was reinstated September 1, 2001. Police Special Revenue Fund Revenues are being amended to reflect forfeitures that have been received. Parks Special Revenue Fund Expenditures are being amended to reflect the contracts approved for construction of parking facilities. Encumbrance carry-overs of $104,754 are included in the amendment. Tree Preservation Fund The revenues are being amended to reflect funds that have been received for Tree Preservation. Recreational Programs Revenues and expenditures are being amended to reflect the accounting for recreational programs that are considered self-supporting. Municipal Court Expenditures are being amended for encumbrance carry-overs and security cameras installed in the Justice Center. CRDC Special Revenue The revenues are being amended to show a decline in sales tax collections and interest earnings.
