AN ORDINANCE OF THE CITY OF COPPELL, TEXAS,
ABANDONING COTTON ROAD IN ITS ENTIRETY FROM
ROYAL LANE EASTERLY TO ITS INTERSECTION WITH THE
I.H. 635 RIGHT-OF-WAY, IN FAVOR OF THE ABUTTING
PROPERTY OWNERS; PROVIDING THAT SAID ABANDONED
AREA BE RETAINED AS A UTILITY EASEMENT; PROVIDING
THAT SUCH ABANDONMENT SHALL BE IN EXCHANGE FOR
THE PAYMENT BY THE ABUTTING PROPERTY OWNERS OF
THE FAIR MARKET VALUE OF THE RIGHT OF WAY
EASEMENT TO BE ABANDONED; PROVIDING THAT SUCH
ABANDONMENT SHALL BE THE INTEREST WHICH THE CITY
MAY LEGALLY AND LAWFULLY ABANDON; PROVIDING
THAT SAID ORDINANCE SHALL CONSTITUTE A QUITCLAIM
DEED THAT MAY BE RECORDED WITH THE COUNTY CLERK
OF DALLAS COUNTY TEXAS; AND PROVIDING AN EFFECTIVE
DATE.

WHEREAS, the City Council of the City of Coppell has determined that Cotton
Road in its entirety from Royal Lane easterly to its intersection with the I.H. 635 right-of-
way and more particularly described in Exhibits "A" and "B" attached hereto, is no longer
needed for City services; and
WItEREAS, the abutting property owners desire that said right of way easement be
abandoned and in consideration thereof has agreed to pay to the City of Coppell, Texas, the
fair market value of the property as established by an appraisal; and
WHEREAS, a proper appraisal has been conducted establishing the fair market
value of the easement to be abandoned to be zero;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF COPPELL, TEXAS: '
SECTION 1. That the City Council of the City of Coppell, Texas has
determined that Cotton Road in its entirety from Royal Lane easterly to its intersection with
the I.H. 635 right-of-way, and more particularly described in Exhibits "A" and "B", attached
hereto and made a part hereof for all purposes, is no longer needed or necessary for public
transportation purposes and should be, and is hereby, abandoned in favor of the abutting
property owners, in exchange for the payment of the fair market value of the easement to be
abandoned.
SECTION2. That the City Council of the City of Coppell, Texas has
determined that the abandoned Cotton Road, more particularly described in Exhibits "A"
and "B", attached hereto and made a part hereof for all purposes, be retained as a public
utility easement.
SECTION 3. That the fair market value of the said right of way easement
being abandoned has been determine by an appraisal to be of no value.
SECTION 4. That this abandonment ordinance shall constitute a Quitclaim
Deed in favor of the abutting property owners, and a certified copy of the same may be filed
in the Deed Records of Dallas County, Texas, to indicate such abandonment.
SECTION 5. That the abandonment provided for herein shall extend only to
the public right, title and interest which the City of Coppell, Texas, may have in and to said
utility easement, and shall be construed to extend only to such interests that the governing
body of the City of Coppell, Texas, may legally and lawfully abandon.
SECTION 6. That this ordinance shall become effective from and after its
passage as the law and charter in such case provide.

OVERALL TRACT
BEING a 35,915 square foot (0.8245 acre) tract of land situated in the Joel Wilson Survey, Abstract
No. 1555, and the S.A. & M.G.R.R. Survey, Abstract No. 1439, in the City of Coppell, Dallas
County, Texas, said tract being a portion of a tract of land described in Deed to Douglas R. Ralston,
dated September 5, 2000, as recorded in Volume 2000174, Page 3045 of the Deed Records of
Dallas County, Texas (D.R.D.C.T.), and also being a portion of a tract of land described in
Annexation Ordinance of the City of Coppell, Texas, Ordinance No. 88-411, dated July 17, 1988,
as recorded in Volume 88154, Page 4093, D.R.D.C.T., and being more particularly described as
follows:
BEGINNING at a point that is 25.00 feet perpendicularly distant north of the approximate
centerline of Cotton Road (called 50 feet wide) and on an easterly right-of-way line of Interstate
Highway 635 as described in Volume 80236, Page 1004, D.R.D.C.T., from which a found concrete
highway monument bears South 00 degrees 41 minutes 39 seconds West, a distance of 1.83 feet;
THENCE South 87 degrees 47 minutes 41 seconds East, along a line parallel to and 25.00 feet
north of said approximate centerline, a distance of 635.08 feet to a point for comer on the
southwest right-of-way line of Interstate Highway 635;
THENCE South 72 degrees 17 minutes 28 seconds East, along said southwest fight-of-way line, a
distance of 93.53 feet to a 1/2-inch found iron rod for comer;
THENCE North 88 degrees 52 minutes 12 seconds East, continuing along said southwest right-of-
way line, a distance of 15.18 feet to a point for comer;
THENCE South 62 degrees 20 minutes 06 seconds East, continuing along said southwest right-of-
way line, a distance of 50.02 feet to a 1/2-inch found iron rod with a yellow plastic cap stamped
"HALFF ASSOC INC" for comer, said point being at the intersection of said southwest right-of-
way line with the north right-of-way line of Radio Road as abandoned in document recorded in
Volume 98163, Page 5695, D.R.D.C.T.;
THENCE North 89 degrees 00 minutes 59 seconds West, departing said southwest right-of-way
line and along said north fight-of-way line of abandoned Radio Road, a distance of 69.91 feet to a
5/8-inch found iron rod with a cap stamped "DFW" for comer;
THENCE South 00 degrees 59 minutes 01 second West, along the west right-of-way line of said
abandoned Radio Road, a distance of 2.89 feet to a point for comer, said comer being 25.00 feet
perpendicularly distant from said approximate centerline;
THENCE North 87 degrees 47 minutes 41 seconds West, departing said west right-of-way lire and
along a line parallel to and 25.00 feet south of said approximate centerline, a distance of 714.37 feet
to a point for the intersection of said parallel line with the southerly extension of said easterly right-
