OR 135 Creates a Library Dept. within the City & creates Board of Trustrees of the Coppell Public Library AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 135 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, CREATING A LIBRARY DEPARTMENT WITHIN THE CITY; CREATING THE BOARD OF TRUSTEES OF THE COPPELL PUBLIC LIBRARY; PROVIDING FOR IT'S MEMBERSHIP; PROVIDING A SEVERABILITY CLAUSE AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. LIBRARY DEPARTMENT. Pursuant to the Laws of the State of Texas, a depart- ment is hereby created within the framework of the Governmental Organization of the City of Coppell, Texas, which shall be known as the Library Department and shall function according to the laws of the State of Texas, the ordinances of the City of Coppell, Texas, and the provisions of this enactment. SECTION 2. BOOKS AND EQUIPMENT. The City of Coppell, Texas, hereby accepts all gifts and donations of books and equipment for the Coppell Public Library, with greatful thanks to the donators of books and time, and it is ordained that such books and equipment, together with such additions as may be made from time to time, shall constitute and form the books and equipment of the Coppell Public Library. SECTION 3. BOARD OF TRUSTEES. There is hereby created the Board of Trustees, the Coppell Public Library. of SECTION 4. MEMBERSHIP OF BOARD. (a) The Board of Trustees of the Coppell Public Library shall consist of seven (7) members to be appointed by the City Council and such other members as may be appointed by the Board under the provisions of sub-section~ (b) hereof. The term of office of such appointees shall be for two years; pro- vided, however, the first seven appointees shall, at their first meeting, determine by lot, which four (4) of said appointees shall serve for a two year term and which three (3) shall serve for a one term; the first year thereafter three shall be appointed to fill the vacancy created by those whose terms were for one year and the second year thereafter four shall be appointed to fill the vacancies created by those whose terms were for two years. Each year thereafter three shall be appointed in one year and four shall be appointed in the alternate year. The initial terms under this enactment shall commence to run from the date of this ordinance. (b) By majority vote of all the members of the entire Board of Trustees, the Board may at any time appoint two (2) additional Board members. The term of such additional Board members may be for either one or two years to be set by the members of the Board making such appointment. SECTION 5. POWERS AND DUTIES OF BOARD OF TRUSTEES. The Board of Trustees of the Coppell Public Library shall, under the supervision and control of the City Council, administer and supervise the operation of the Coppell Public Library and any branches thereof as may be hereafter established by the City Council. Such Board may formulate rules and regula- tions as it shall deem necessary for the orderly use of the library facilities and in governing the performance and duties of library personnel. The Board of Trustees shall have authority to accept in the name of the City of Coppell, Texas, all gifts in the form of donations of books and equipment and said board is hereby charged with the responsibility of selecting the books to be maintained within the Public Library and determining when and under what conditions books shall be disposed of because of obsolescence or duplication. The Board shall have no power to obligate the City of Coppell, in any manner. The Boards finances shall be handled in the same manner as any division of the City, except that the Board r~ayestablish a separate bank account, which shall be maintained separate and apart from City funds, and over which the Board shall have exclusive control administration and responsibility. Provided, however, the funds within such account shall be used only for Public Library purposes. Said account shall be known as the "Board of Trustees, Coppell Public Library" account. In the event the City shall receive a donation, specifically conditioned upon the fund being used for library purposes and also specifically conditioned that such funds be under the exclusive control, administration and responsibility of the Board of Trustees of the Coppell Public Library, then such funds shall be placed in the above mentioned account to be administered by the board. In the event the board conducts its own fund raising campaign or conducts activities which bring funds directly to the board for library purposes, then in such account control. event such funds may be placed in the above mentioned over which the Board of Trustees whall have exclusive SECTION 6. SEVERABILITY CLAUSE. If any article, paragraph or sub-division, clause, phrase or provision of this Ordinance shall be adjudged in- valid or held unconstitutional, the same shall not affect the validity of this Ordinance as a whole or any part or provision thereof other than the part so decided to be invalid or uncon- stitutional. SECTION 7. EMERGENCY CLAUSE. The fact that the present City regulaticns are in- adequate to properly protect the public health, safety and welfare, creates an urgency and an emergency and requires that this Ordinance shall take effect immediately from and after the publication of its caption as the law in such cases pro- vides.
