AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING THE
COMPREHENSIVE ZONING ORDINANCE OF THE CITY, AS HERETOFORE AMENDED,
SO AS TO CHANGE THE ZONING CLASSIFICATION ON THE PROPERTY AS HERE-
INAFTER DESCRIBED AND DESIGNATED; PROVIDING A REPEALING CLAUSE; PRO-
VIDING A SEVERABILITY CLAUSE; PROVIDING PENALTIES FOR VIOLATION OF THIS
ORDINANCE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00)
FOR EACH OFFENSE; AND DECLARING AN EFFECTIVE DATE.
WHEREAS, the City Zoning Commission of the City and the governing body
of the City, in compliance with the laws of the State of Texas with reference to the
granting of zoning changes under the zoning ordinance and zoning map, hsve ~iven
recuisite notices by publication and otherwise, and after holding due hesrings and
affording a full and fair hearing to all property owners generally and to the persons
interested in the area and situated in the area, the City is of the opinion thft the
said change of zoning application of Coppert Associates should be ~ranted and the
Comprehensive Zoning Ordinance should be amended in the exercise of its legislative
discretion.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIl, OF THE CITY
OF COPPELL, TEXAS:
SECTION ]. That the Comprehensive Zonin~r Ordinance of the City be,
the same is hereby amended by amending the zoning map of the Citv, so as to give
the hereinafter described property located within the corporate Hmits of the City, the
zoning district classification as hereinafter designated:
Change from "M F-I" Mnlti-Family Dwelling District Classification to "C" Commercial
District Classification, and;
BEING A TRACT of land situated in the Edward A. nrow Survey,
Abstract No. 301, in the City of Coppe]], Dallas County, Texas, and
bein~ more particularly described as follows:
BEGINNING at the point of intersection of the south cut-back line of
Bethel School Road with the east R.O.IA'. line of Denton Tap Road (100
ft. R.O.W.);
THENCE N 41 deg. 06' 53" E, a]onff the south cut-back line of Bethel
School Road, a distance of 57.55 ft.;
THENCE N 85 deg. 05' 53" E, along the south ]R.O.W. Line of Bethel
School Road, a distance of 386.30 ft.;
THENCE S 0 de~. 23' 07" E, a distance of 531.65 ft.;
THENCE N 89 deg. 51' 55" W, 8 distance of 403.71 ft. to a point
the east R.O.W. line of Denton Tap Road;
THENCE in a northerly direction along the east R.O.W. Line of Denton
Tap Road with a curve to the left, said curve bavin~ a tangent bearing
of N 2 de~. 26' 15" W, a central angle of 0 deg. 25' 52" and a rsdiu~
of 5,779.58 ft., a distance of 43.49 ft.;
THENCE N 2 deg. 52' 07" W, continuing along the east R.O.W. line of
Denton Tap Road, a distance of 411.40 ft. to the point of be~nning
and containing 4.8643 acres of ]and.
SECTION 2. That all ordinances of the City in conflict with the provision of
this ordinance be, and the same are hereby, repealed and all other ordinances of the
City not in oonf]ict with the provisions of this ordinance sh8]i remain in full force
and effect.
SECTION 3. That the above described property shah be used only, in the
manner and for the purposes provided for in the Comprehensive Zoning Ordinance of
the City, as amended herein by the ~ranting of this zoning classification.
SECTION 4. That should any paragraph, sentence, subdivision, clause, phrase
or section of this ordinance be adjudged or held to be unconstitutional, illegal or
invalid, the same shall not affect the validity of this ordinance as a whole or any Dart
or provision thereof other than the part so decided to be invalid, illega} or uncon-
stitutional and shall not affect the validity of the Comprehensive Zoning Ordinance as
a whole.
SECTION 5. That any person, firm or corporation vio]atin,g any of the provisions
or terms of this ordinance shall be sub.iect to the same pe.a]tV 8s provided for in the
Comprehensive Zonin~ Ordinance of the (~ity, as heretofore amended, and upon con-
viction shall be punished by fine not to exceed the sum of two hnndred dollars ($200.00)
for each offense, and that each day such violstioD sbsll continue to exist sb8]] constitute
a separate offense.
SECTION 6. It is neeessay to ~ve the property described bere}n t~e 8hove
mentioned zoning classification in order to permit }ts proper development add in order
to protect the public interest, comfort and geDer81 welfare of the City. Therefore,
this ordinance shah take effect immediste]y from add 8fter its psssa~e apd publication
of its caption, as the law iD snch cases provides.
