OR 129-A-11 Amending the Comprehensive Zoning Ordinance AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 129A11 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY, AS HERETOFORE AMENDED, SO AS TO CHANGE THE ZONING CLASSIFICATION ON THE PROPERTY AS HEREINAFTER DESCRIBED AND DESIGNATED; PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING PENALTIES FOR VIOLATION OF THIS ORDINANCE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City Zoning Commission of the City and the governing body of the City, in compliance with the laws of the State of Texas with reference to the granting of zoning changes under the zoning ordinance and zoning map, have given requisite notices by publication and otherwise, and after holding due hearings and affording a full and fair hearing to all property owners generally and to the persons interested in the area and situated in the area, the City is of the opinion that the said change of zoning on application of Southwestern Town Lot Corporation should be granted and the Comprehensive Zoning Ordinance should be amended in the exercise of its legislative discretion. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. That the Comprehensive Zoning Ordinance of the City, be and the same is hereby amended by amending the zoning map of the City, so as to give the hereinafter described property located within the corporate limits of the City, the zoning district classification as hereinafter designated: Changed from "2F-1, MF-1, PD, R and C" District Classifications to "I-1" Light Industrial District Classification, said tract being described as follows: BEING a tract of land situated in the James A. Simmons Survey, Abstract No. 1296, City of Coppell, Dallas County, Texas, and being a tract of land conveyed to Loyse E. Caldwell by deed recorded in Volume 68200 at Pate 1496 of the Deed Records of Dallas County, Texas, and being more particularly described as follows: BEGINNING at the intersection of the North line of Cowboy Road (a 60.00 foot R.O.W.) with the West line of Belt Line Road (a 120.00 foot R.O.W.) said point also being South 89 deg. 35 min. 54 sec. West, 60.00 feet from the Southeast corner of said James A. Simmons Survey, Abstract No. 1296, an iron stake for corner; THENCE, South 89 deg. 35 min. 54 sec. West, with the said North line of Cowboy Road part of the way same being the South line of said Simmons Survey a distance of 3,910.00 feet, to an iron stake found for corner; THENCE, North 00 deg. 02 min. East, with the East line of a 40 acre tract of land conveyed to First National Bank by deed filed 11/8/62, Deed Records of Dallas County, Texas, and a tract of land conveyed to R. F. Daniels Co. by deed filed 6/30/65, a distance of 2,996.76 feet to an iron stake found for corner; THENCE, South 89 deg. 35 min. 45 sec. East, a distance of 396.23 feet an iron stake found for corner; THENCE, North 01 deg. 16 min. 15 sec. West, a distance of 190.25 feet to a point in the center line of Coppell Road, an iron stake found for corner; THENCE, North 88 deg. 29 min. East, with the center line of Coppeli Road and its extension a distance of 1,352.25 feet, to an iron stake in a fence line; THENCE, South 02 deg. 13 min. East, with said fence line a distance of 18.38 feet to a rivet found in a corner post; THENCE, South 34 deg. 42 min. East, with an old fence line and its extension a distance of 231.88 feet to a R.R. Spike found in the center line of Coppell Road; THENCE, North 89 deg. 43 min. 30 sec. East, with the said center line of Coppell Road a distance of 2,030.10 feet to a point in the West line of Belt Line Road as widened by deed recorded in Volume 4519 at Page 493, Deed Records of Dallas County, Texas, an iron stake for corner; THENCE, South 00 deg. 01 min. 50 sec. East, with the West line of said Belt Line Road same being on a line Westerly 60.00 feet from and parallel to the East line of said Simmons Surve~v a distance of 2,993.29 feet to the place of beginning and containing 275.216 acres of land, having 3.591 acres lying in Coppell Road, leaving a net area of 271.625 acres of land. SECTION 2. That all ordinances of the City in conflict with the provision of thi~ ordinance be, and the same are hereby, repealed and all other ordinances of the City not in conflict with the provisions of this ordinance shall remain in full force and effect. SECTION 3. That the above described property shall be used only in the manner and for the purposes provided for in the Comprehensive Zoning Ordinance of the City, as amended herein by the granting of this zoning classification. SECTION 4. That should any paragraph, sentence, subdivision, clause, phrase or section of this ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall not affect the validity of this ordinance as a whole or any part or provision thereof other than the part so decided to be invalid, illegal or unconstitutional and shall not affect the validity of the Comprehensive Zoning Ordinance as a whole. SECTION 5. That any person, firm or corporation violating any of the provisions or terms of this ordinance shall be subject to the same penalty as provided for in the Comprehensive Zoning Ordinance of the City, as heretofore amended, and upon conviction shall be punished by fine not to exceed the sum of Two Hundred Dollars ($200.00) for each offense, and that each day such violation shall continue to exist shall constitute a separate offense. SECTION 6. It is necessary to give the property described herein the above mentioned zoning classification in order to permit its proper development and in order to protect the public interest, comfort and general welfare of the City. Therefore, this ordinance shall take effect immediately from and and after its passage and publication of its caption, as the law in such cases provides.
