ORDINANCE NO. 129A10
AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING THE COMPRE-
HENSIVE ZONING ORDINANCE OF THE CITY, AS HERETOFORE AMENDED, SO AS TO
CHANGE THE ZONING CLASSIFICATION ON THE PROPERTY HEREINAFTER DESCRIBED
AND DESIGNATED; PROVIDING PENALTIES FOR VIOLATION OF THIS ORDINANCE NOT
TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE;
AND DECLAIRING AN EFFECTIVE DATE.
WHEREAS, the City Zoning Commission of the City and the governing
body of the City, in compliance with the laws of the State of Texas with
reference to the granting of zoning changes under the zoning ordinance and
map, have given requisite notices by publication and otherwise, and after
holding due hearings and affording a full and fair hearing to all property
owners generally and to the persons interested in the area and situated in
the area, the City is of the opinion that the said change of zoning on
application of Bert Meadows should be granted and the Comprehensive Zoning
Ordinance should be amended in the exercise of its legislative discretion.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF COPPELL, TEXAS:
SECTION 1: That the Comprehensive Zoning Ordinance of the City,
be and the same is hereby amended by amending the zoning map of the City,
so as to give the hereinafter described property located within the corp-
orate limits of the City, the zoning district classification as hereinafter
designated:
Changed from "PD-Ordinance No. 119" Planned Development Ordinance
No. 119 District Classification and "SF-12" One-Family Dwelling District
Classification to "SF-9" One-Family Dwelling District Classification and
"R" Retail District Classification, said tract being described as follows:
RESIDENTIAL
"SF-9"
BEING a tract of land in the Patience Piles Survey, Abstract No.
1137 situated in the City of Coppell, Dallas County, Texas, and
being more particularly described as follows:
COMMENCING at an iron rod found at the intersection of the East
right-of-way line of DeForest Road (45.0 feet wide) with the
North right-of-way line of Sandy Lake Road (60.0 feet wide);
THENCE alon§ the North right-of-way line of Sandy Lake Road as
follows:
North 89o28' East, 543.5 feet to an iron rod found;
North 89o04'24'' East, 253.0 feet to the North 89o53'40''
East, 27.09 feet to the PLACE OF BEGINNING;
THENCE NORTH 0030' West, 598.47 feet;
THENCE South 89o28' West, 23.78 feet;
THENCE North 0°11' West, 1855.25 feet;
THENCE North 89°15'53'' East along a wire fence, 1280.38 feet to
a fence corner post;
THENCE South 0°19'10'' East, 2467.6 feet to a fence corner post
on the North right-of-way line of Sandy Lake Road;
THENCE South 89°53'40'' West alon9 said North right-of-way line
of Sandy Lake Road 1259.08 feet to the PLACE OF BEGINNING, and
containing 72.1374 acres of land, of which 0.5781 acres lies
within proposed right-of-way for Sandy Lake Road, and leaving a
net of 71.5593 acres of land.
RETAIL
BEING a tract of land in the Patience Piles Survey, Abstract No.
1137 situated in the City of Coppell, Dallas County, Texas, and
being more particularly described as follows:
COMMENCING at an iron rod found at the intersection of the East
right-of-way line of DeForest Road (45.0 feet wide) with the
North right-of-way line of Sandy Lake Road (60.0 feet wide);
THENCE along the North right-of-way line of Sandy Lake Road as
follows:
North 89o28' East, 543.5 feet to an iron rod found;
North 89004'24'' East, 253.0 feet to the PLACE OF BEGINNING:
THENCE North 0°11' West, 598.27 feet;
THENCE North 89o28' East 23.78 feet;
THENCE South 0o30' East, 598.47 feet to a point on the North right-
of-way line of Sandy Lake Road;
THENCE South 89o53'40'' West along said North right-of-way line of
Sandy Lake Road, 27.09 feet to the PLACE OF BEGINNING, and con-
taining 0.3494 acres of land, of which 0.0124 acres lies within
proposed right-of-way for Sandy Lake Road, and leaving a net of
0.3370 acres of land.
SECTION 2: That all ordinances of the City in conflicting with
the provisions of this ordinance be, and the same are hereby, repealed and
all other ordinances of the City not in conflict with the provisions of this
ordinance shall remain in full force and effect.
SECTION 3: That the above described property shall be used only
in the manner and for the purposes provided for in the Comprehensive Zoning
Ordinance of the City, as amended herein by the granting of this zoning
classification.
SECTION 4: That should any paragraph, sentence, subdivision, clause,
phrase or section of this ordinance be adjudged or held to be unconstitutional
illegal or invalid, the same shall not affect the validity of this ordinance
as a whole or any part or provision thereof other than the part so decided
to be invalid, illegal or unconstitutional and shall not affect the validity
of the Comprehensive Zoning Ordinance as a whole.
SECTION 5: That any person, firm or corporation violating any of
the provisions or terms of this ordinance shall be subjected to the same
penalty as provided for in the Comprehensive Zoning Ordinance of the City,
as heretofore amended, and upon conviction shall be punished by fine not
to exceed the sum of Two Hundred Dollars for each offense, and that each
day such violation shall continue to exist shall constitute a separate
offense.
SECTION 6: It is necessary to give the property described herein
the above mentioned zoning classification in order to permit its proper
development and in order to protect the public interest, comfort, and general
welfare of the City. Therefore, this ordinance shall take effect immediately
from and after its passage and publication of its caption, as the law in
such cases provides.
