OR -129-A-09 Changes "PD-Ordinance No.119" Planned Development & "SF-12" One-Family to "SF-9" One-Family & "R" Retail AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 129A9 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING THE COMPRE- HENSIVE ZONING ORDINANCE OF THE CITY, AS HERETOFORE AMENDED, SO AS TO CHANGE THE ZONING CLASSIFICATION ON THE PROPERTY HEREINAFTER DESCRIBED AND DESIGNATED; PROVIDING PENALTIES FOR VIOLATION OF THIS ORDINANCE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City Zoning Commission of the City and the governing body of the City, in compliance with the laws of the State of Texas with reference to the granting of zoning changes under the zoning ordinance and map, have given requisite notices by publication and otherwise, and after holding due hearings and affording a full and fair hearing to all property owners generally and to the persons interested in the area and situated in the area, the City is of the opinion that the said change of zoning on application of Bert Meadows should be granted and the Comprehensive Zoning Ordinance should be amended in the exercise of its legislative discretion. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1: That the Comprehensive Zoning Ordinance of the City, be and the same is hereby amended by amending the zoning map of the City, so as to give the hereinafter described property located within the corp- orate limits of the City, the zoning district classification as hereinafter designated: Changed from "PD-Ordinance No. 119" Planned Development Ordinance No. 11g District Classification and "SF-12" One-Family Dwelling District Classification to "SF-9" One-Family Dwelling District Classification and "R" Retail District Classification, said tract being described as follows: RESIDENTIAL "SF-9" BEING a tract of land located at the intersection of Sandy Lake Road and DeForest Road in the City of Coppell, said tract being situated in the Patience Piles Survey Abstract 1137 Dallas County, Texas described by metes and bounds as follows: BEGINNING at a point on the West right-of-way line of DeForest Road (45.0 feet wide), said point being North 0o30' West, 600.0 feet from the North right-of-way of Sandy Lake Road (60.0 feet wide); THENCE North 0o30, West Along said East right-of-way line of DeForest Road, 2972.41 feet; THENCE South 89o45'40" East, 816.14 feet; THENCE South 0°11, East, 2961.47 feet; THENCE South 89o28, West, 799.8 feet to the PLACE OF BEGINNING, and containing 55.0258 acres of land, of which 0.5118 acres lies within proposed right-of-way of DeForest Road, leaving a net of 54.514 acres of land. RETAIL BEING a tract of land located at the intersection of Sandy Lake Road and DeForest Road in the City of Coppell, said tract being 11.338 acres out of a 66.039 acre tract situated in the Patience Piles Survey Abstract No. 1137 Dallas County, Texas, described by metes and bounds as follows: BEGINNING at an iron rod located at the intersection of the East right-of-way lines of DeForest Road a 45 foot right-of- way and Sandy Lake Road a 60 foot right-of-way; THENCE North 0o30' West 600 feet to a point for corner; THENCE North 89o28' East 799.80 feet to a point for corner; THENCE South 0°30'' East 598.27 feet to a point for corner located on the north right-of-way line of Sandy Lake Road; THENCE South 89o04'24'' West 253.0 feet to iron rod; THENCE South 89o28, West 543.5 feet to the PLACE OF BEGINNING and containing 10.9886 acres of land, of which 0.4656 acres lies within proposed right-of-way for DeForest Road and Sandy Lake Road, and leaving a net of 10.5230 acres of land. SECTION 2: That all ordinances of the City in conflicting with the provisions of this ordinance be, and the same are hereby, repealed and all other ordinances of the City not in conflict with the provisions of this ordinance shall remain in full force and effect. SECTION 3: That the above described property shall be used only in the manner and for the purposes provided for in the Comprehensive Zoning Ordinance of the City, as amended herein by the granting of this zoning classification. SECTION 4: That should any paragraph, sentence, subdivision, clause, phrase or section of this ordinance be adjudged or held to be un- constitutional illegal or invalid, the same shall not affect the validity of the Comprehensive Zoning Ordinance as a whole. SECTION 5: That any person, firm or corporation violating any of the provisions or terms of this ordinance shall be subjected to the same penalty as provided for in the Comprehensive Zoning Ordinance of the City, as heretofore amended, and upon conviction shall be punished by fine not to exceed the sum of Two Hundred Dollars for each offense, and that each day such violation shall continue to exist shall constitute a separate offense. SECTION 6: It is necessary to give the property described here- in the above mentioned zoning classification in order to permit its proper development and in order to protect the public interest, comfort, and general welfare of the City. Therefore, this ordinance shall take effect immediately from and after its passage and publication of its caption, as the law in such cases provides.
