ORDINANCE NO. 91500-A-318
AN ORDINANCE OF THE CITY OF COPPELL, TEXAS,
AMENDING THE ORDINANCE NO. 91500, COMPREHENSIVE ZONING
ORDINANCE, BY MAKING TEXT CHANGES TO CREATE
CONSISTENCY WITH OTHER ORDINANCES OF THE CITY; BY
AMENDING SECTION 12-17-1.3 BY DELETING DAY NURSERIES AS A
PERMITED USE; BY AMENDING SECTION 12-18-4 TO CORRECT A
CLERICAL ERROR IN THE NUMBER OF PARKING SPACES; BY
DELETING SECTION 12-22-7 IN ITS ENTIRETY; BY AMENDING
SECTION 12-23-1.7 BY PROVIDING A DEFINITION; BY AMENDING
SECTION 12-26-1.2 BY CORRECTING THE SUBSECTION PROVIDING
FOR HI-SUP USES; BY AMENDING 12-27-2.2 TO REQUIRE A
DETAILED SITE PLAN FOR ALL PLANNED DEVELOPMENTS; BY
AMENDING SECTION 12-30-14 BY DELETING ALL REFERENCES TO
BUSINESS PROPERTY AND REPLACING THE SAME WITH BUSINESS
USE; BY AMENDING SECTIONS 12-34-4 AND 12-34-5 BY PROVIDING
FOR A LANDSCAPE PLAN AS A PART OF THE SITE PLAN REVIEW
AND PROVIDING FOR ONLY REGISTERED LANDSCAPE
ARCHITECTS TO PREPARE SUCH PLANS; BY AMENDING SECTION
12-34-8(C)2c TO CLARIFY LANDSCAPE REQUIREMENTS FOR
LANDSCAPING ADJACENT TO SHARED DRIVEWAYS; BY
AMENDING SECTION 12-30-15 TO PROVIDE FOR CHURCHES IN ALL
NON-REDIENTIAL ZONING DISTRICTS; BY AMENDING SECTION
12-36-3 BY CORRECTING THE REFERENCED SECTION FROM 12-34-4
TO 12-36-4; BY AMENDING SECTION 12-39-3(U) TO BE CONSISTENT
WITH THE PROVISIONS OF THE LANDSCAPE ORDINANCE,
SECTION 12-34-2-4(J); PROVIDING A REPEALING CLAUSE;
PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, after review of the Comprehensive Zoning Ordinance, City staff has found
several sections containing clerical errors, inconsistencies, and certain wording clarification; and
WHEREAS, the City staff has submitted their recommendation for correction of these
areas to the City Council for review and the City Council has determined that the errors are
clerical in nature and do not represent a significant change in the intent nor the provisions of the
Zoning Ordinance; and,
WHEREAS, the City Council desires to correct the clerical errors which have been
located in the current Zoning Ordinance of the City of Coppell;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF COPPELL, TEXAS;
SECTION 1. That the Comprehensive Zoning Ordinance of the City of Coppell, Texas,
be, and the same is, hereby amended by amending Section 12-17-1.3 by deleting "Day nurseries"
as a permitted use in the Multi-Family Residential Zoning District Regulations.
SECTION 2. That the Comprehensive Zoning Ordinance of the City of Coppell, Texas,
be, and the same is, hereby amended to correct the clerical error in Section 12-18-4, first
sentence, by deleting the requirement for "22 parking spaces per three-bedroom unit" and
amending the same to read as follows:
"Sec. 12-18-4. Parking regulations.
Two spaces for every one- and two-bedroom unit and 2.5 spaces per three-
bedroom unit ..... "
SECTION 3. That the Comprehensive Zoning Ordinance of the City of Coppell, Texas,
be, and the same is, hereby amended by amending Section 12-22-7, Site plan review, by deleting
this section in its entirety from the HC district.
SECTION 4. That the Comprehensive Zoning Ordinance of the City of Coppell, Texas,
be, and the same is, hereby amended by amending Section 12-23-1.7 to provide for a maximum
limit of the floor area, which shall read as follows:
"Sec. 12-23-1.7. Use regulations.
Limited warehousing and distribution shall be limited to a maximum of 20%
of the floor area of the building.
SECTION 5. That the Comprehensive Zoning Ordinance of the City of Coppell, Texas,
be, and the same is, hereby amended to correct the clerical error in Section 12-26-1.2 by
changing the section referenced therein to the correct section, which shall read as follows:
"Sec. 12-26-1.2. Use regulations.
2. Any uses permitted by special use permit, section 12-30-13."
SECTION 6. That the Comprehensive Zoning Ordinance of the City of Coppell, Texas,
be, and the same is, hereby amended to correct the clerical error in Section 12-27-2.2 to require a
public hearing for a detail site plan and by deleting any provisions not requiring the same, which
shall read as follows:
"Sec. 12-27-2. Conceptual plan.
Detail site plan - . . .
required.

SECTION 7. That the Comprehensive Zoning Ordinance of the City of Coppell, Texas,
be, and the same is, hereby amended by amending Sectionl2-30-14 by deleting all references to
"business property" and replacing the same with "business use".
SECTION 8. That the Comprehensive Zoning Ordinance of the City of Coppell, Texas,
be, and the same is, hereby amended to provide clarification of the zoning districts wherein
churches are permitted without a special use permit by deleting the reference to "commercial"
zoning district in the last paragraph of Section 12-30-15 and replacing with a reference to "non-
residential" zoning district.
SECTION 9. That the Comprehensive Zoning Ordinance of the City of Coppell, Texas,
be, and the same is, hereby amended to amend Section 12-34-4 by deleting the first sentence of
the section and replacing the same with similar language, which shall read as follows:
"Sec. 12-34-4. Permits.
As required in section 12-39-2.3, a landscape plan shall be part of the site
plan review which shall be submitted to the planning and zoning commission for
its recommendation and city council for its approval. In the event that .... "
SECTION 10. That the Comprehensive Zoning Ordinance of the City of Coppell,
Texas, be, and the same is, hereby amended by amending Section 12-34-5, the first and second
paragraphs, to read as follows:
"Sec. 12-34-5. Landscape plans.
As required in section 12-39-2.3, a landscape plan shall be part of the site
plan review which shall be submitted to the planning and zoning commission for
its recommendation and city council for its approval. The building official ....
Landscaping plans shall be prepared by a landscape architect. Landscape
plans shall contain ....
SECTION. 11. That the Comprehensive Zoning Ordinance of the City of Coppell,
Texas, be and the same is, hereby amended by clarifying the landscape requirements for
landscaping adjacent to shared driveways in Section 12-34-8(C)2(c), which shall read as follows:
"Sec. 12-34-8. Minimum requirements for off-street parking and vehicular use areas.
(C) Perimeter landscaping .....
(c)
·.. When at least 45 percent of a width of a driveway is shared by an
adjoining property owner, then a minimum 10 foot width of
landscaping shall be provided on each side of the driveway
pavement."
SECTION 12. That the Comprehensive Zoning Ordinance of the City of Coppell,
Texas, be, and the same is, hereby amended by correcting Section 12-36-3 by deleting the
reference to Section 12-34-4 and replacing the same with the correct Section 12-36-4.
SECTION 13. That the Comprehensive Zoning Ordinance of the City of Coppell,
Texas, be, and the same is hereby amended by amending Section 12-39-3(U) by deleting the
provision for trees which are eight (8") inches in caliper and replacing the same with trees which
are six (6") inches in caliper.
SECTION 14. That all provisions of the Ordinances of the City of Coppell, Texas, in
conflict with the provisions of this ordinance be, and the same are hereby, repealed, and all other
provisions of the Ordinances of the City not in conflict with the provisions of this ordinance shall
remain in full force and effect.
SECTION 15. That should any word, sentence, paragraph, subdivision, clause,
phrase or section of this ordinance, or of the Code of Ordinances, as amended hereby, be adjudged
or held to be void or unconstitutional, the same shall not affect the validity of the remaining portions
of said ordinance or the Code of Ordinances, as amended hereby, which shall remain in full force
and effect.
SECTION 16. That this ordinance shall take effect immediately from and after its
passage as the law and charter in such cases provide.
DULY PASSED by the City Council of the City of Coppell, Texas, this the 19th day of
