OR 129-A-07 Changes "SF-12" Single Family to "SF-7" Single Family AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 129A7 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY, AS HERETOFORE AMENDED SO AS TO CHANGE THE ZONING CLASSIFICATION ON THE PROPERTY AS HEREINAFTER DESCRIBED AND DESIGNATED; PROVIDING PENALTIES NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE; AND DECLARING AN EMERGENCY. WHEREAS, the City Zoning Commission of the City and the governing body of the City, in compliance with the laws of the State of Texas with reference to the granting of zoning changes under the zoning ordinance and zoning map, have given requisite notices by publication and otherwise, and after holding due hearings and affording a full and fair hearing to all property owners generally and to the persons interested in the area and situated in the area, the City is of the opinion that the said change of zoning application of Fox and Jacobs, Incorporated should be granted and the Comprehensive Zoning Ord- inance should be amended in the exercise of its legislative discretion. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1: That the Comprehensive Zoning Ordinance of the City, be and the same is hereby amended by amending the zoning map of the City, so as to give the hereinafter described property located within the corporate limits of the City, the zoning district classification as hereinafter designated: TRACT I Changed from "SF-12" Single Family Dwelling District to "SF-7" Single Family Dwelling District Classification, said tract being described as follows: BEING, a tract of land situated in the McKinney & Willjams Survey, Abstract No. 1062, the Siebert Henderson Survey, Abstract No. 629, and the Alfred Logsdon Survey, Abstract No. 783, City of Coppell, Dallas County, Texas, and being more particularly described as follows: BEGINNING at a point on the North line of Bethel School Road, said point being S.89g 29' 30"W, a distance of 2039.43 feet from the West line of Moore Road, a point for corner; THENCE, S. 89o 29' 30"W, along said North line of Bethel School Road, a distance of 540.00 feet to a point for corner; THENCE, N.O°30'40"W, leaving said North line of Bethel School Road, a distance of 132.12 feet to a point for corner; THENCE, N. 58°03'13"W, a distance of 342.12 feet to a point for corner; THENCE, N. 58°43'13"W, a distance of 1058.00 feet to a point on the East line of Heartz Road, a point for corner; THENCE, N.O°16'47"E, along said East line of Heartz Road, a distance of 472.00 feet to a point for corner; THENCE, S.89°43'13"E, leaving said East line of Heartz Road, a distance of 23.79 feet to the beginning of a curve to the right having a central angle of 31o00' and a radius of 560.10 feet, a point for corner; THENCE, in a Southeasterly direction and around said curve, a distance of 303.04 feet to end of said curve, a point for corner; THENCE, N.31°16'47"E, a distance of 28.00 feet to the beginning of a curve to the left having a central angle of 30o56'29" and a radius of 450.00 feet, a point for corner; THENCE, In a Northeasterly direction and around said curve a distance of 243.01 feet to end of said curve, a point for corner; THENCE, N.O°20'18"E, a distance of 486.36 feet to a point for corner; THENCE THENCE THENCE THENCE THENCE THENCE S.89°16'51"E, a distance of 830.26 feet to a point for corner; N.1°~3'38"E, a distance of 723.28 feet to a point for corner;. SECTION 2: That all ordinances of the City in conflict with the provisions of this ordinance be, and the same are hereby, repealed and all other ordinances of the City not in conflict With the provisions of this ordinance shall remain in full force and effect. SECTION 3: That the above described property shall be used only in the manner and for the purposes provided for in the Comprehensive Zoning Ordinance of the City, as amended herein by the granting of this zoning classification. SECTION 4: That should any paragraph, sentence, subdivision, clause, phrase or section of this ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall not affect the validity of this ordinance as a whole or any part or provision thereof other than the part so decided to be invalid, illegal or unconstitutional and shall not affect the validity of the Comprehensive Zoning Ordinance as a whole. SECTION 5: That any person, firm or corporation violating any of the provisions or terms of this ordinance shall be subject to the same penalty as provided for in the Comprehensive Zoning Ordinance of the City, as heretofore amended, and upon conviction shall be punished by fine not to exceed the sum of Two Hundred Dollars ($200.00) for each offense, and that each day such violation shall continue a separate offense. SECTION 6: Whereas, the above described property requires that it be given the above zoning classification in order to permit its proper development and in order to protect the public interest, comfort and general welfare of the City, and creates an urgency and an emergency for the preservation of the public health, safety and welfare, and requires that this ordinance shall take effect in=nediately from and after its passage and publication of the caption, as the law in such cases provides. the DULY PASSED by the City Council of the ~ of Coppell, Texas, on l b~ day of ~bf~u,-~ . , 19 .
