OR 129-A-06 Changes "SF-12" Single Family & "R" Retail to "SF-7" Single Family AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 129A6 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY, AS HERETOFORE AMENDED, SO AS TO CHANGE THE ZONING CLASSIFICATION ON THE PROPERTY AS HEREINAFTER DESCRIBED AND DESIGNATED; PROVIDING PENALTIES NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE; AND DECLARING AN EMERGENCY. ~tEREAS, the City Zoning Commission of the City and the governing body of the City, in compliance with the laws of the State of Texas with reference to the granting of zoning changes under the zoning ordinance and zoning map, have given requisite notices by publication and otherwise, and after holding due hearings and affording a full and fair hearing to all property owners generally and to the persons interested in the area and situated in the area, the City is of the opinion that the said change of zoning on application of G. M. Pointer should be granted and the Comprehensive Zoning Ordinance should be amended in the exercise of its legislative discretion. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. That the Comprehensive Zoning Ordinance of the City, be and the same is hereby amended by amending the zoning map of the City, so as to give the hereinafter described prop- erty located within the corporate limits of the City, the zoning district classification as hereinafter designated: TRACT 1 Changed from "SF-12" Single Family Dwelling District and "R" Retail District Classifications to "SF-7" Single Family Dwelling District Classification, said tract being described as follows: BEING a tract of land situated in the James Parrish Survey, Abstract No. 1139, Dallas County, Texas, and being more particularly described as follows: BEGINNING at a point in the South line of Sandy Lake Road, said point being N.89°28'E, a distance of 2092.40 feet along said Sandy Lake Road South line from the East line of Moore Road, said point also being N.89°28'E, a distance of 2135.80 feet and S.0oll'W, a distance of 30.00 feet from the Northwest corner of said James Parrish Survey; THENCE, N.89°28'E, along the said Sandy Lake Road South line, a distance of 3040.0 feet to a point for corner; THENCE, S.0°32'E, leaving said Sandy Lake Road South line, a distance of 77.0 feet to the beginning of a curve to the left, having a central angle of 41°08' and a radius of 1000.00 feet, a point for corner; THENCE, along said curve, a distance of 717.9 feet to the end of said curve and the beginning of a curve to the right having a central angle of 46~11'20'' and a radius of 1000.00 feet, a point for corner; THENCE, along said curve, a distance of 806.15 feet to the end of said curve, a point for corner; THENCE, S.85°28'40"E, a distance of 50.00 feet to a point for corner; THENCE, N.89028'E, a distance of 568.2 feet to a point for corner; ~{ENCE, corner; THEN CE, corner; THENCE, corner; THENCE, corner; THENCE, THENCE , corner; South, a distance of 1484.75 feet to a point for S.89~28'W, a distance of 944.00 feet to a point for North, a distance of 210.00 feet to a point for S.89°28'W, a distance of 520.00 feet to a point for South, a distance of 210.00 feet to a point for corner; S.89°28'W, a distance of 1760.00 feet to a point for THENCE, S.89~28'W, a distance of 937.50 feet to a point for corner; THENCE, North, a distance of 2087.00 feet to the PLACE OF BEGINNING and containing 232.85 acres of land. TRACT 3 Changed from "SF-12" Single Family Dwelling District and "R" Retail District Classifications to "FLF-i" Multi-Family District Classification, said tract being described as follows: BEING a tract of land situated in the James Parrish Survey, Abstract No. 1139, Dallas County, Texas, and being more particularly described as follows: BEGINNING at the Southwest corner of the proposed "R", Local Retail Tract, a point for corner; THENCE, N.48°20'E, a distance of 50.00 feet to a point for corner; THENCE, N.69°58'E, a distance of 754.6 feet to a point for corner; THENCE, East, a distance of 121.6 feet to a point for corner; THENCE, South, a distance of 741.3 feet to a point for corner; THENCE, S.89°28'W, a distance of 485.3 feet to the beginning of a curve to the left, having a central angle of 10°30' and a radius of 544.15 feet, a point for corner; THENCE, along said curve, a distance of 99.72 feet to the end of said curve, a point for corner; THENCE, S.78~58'W, a distance of 50.00 feet to a point for corner; THENCE, along a curve to the left having a central angle of 30~38', a radius of 1000.00 feet and a back tangent bearing N.11°02'W, an arc distance of 534.65 feet to the PLACE OF BEGINNING and containing 11.06 acres of land, save and except 0.63 acres in street R.O.W., leaving a net area of 10.43 acres of land. TRACT 4 Changed from "SF-12" Single Family Dwelling District and "R" Retail District Classifications to "2F-l" Two Family DWelling District Classification, said tract being described as follows: BEING a tract of land situated in the James Parfish Survey, Abstract No. 1139, Dallas County, Texas, and being more particularly described as follows: BEGINNING at the Southwest corner of the proposed MF-1 Apartment Zoning, a point for corner; THENCE, N.78°58'E, a distance of 50.00 feet to the beginning of a curve to the right having a central angle of 10°30' and a radius of 544.15 feet, a point for corner; THENCE, along said curve, a distance of 99.72 feet to the end of said curve, a point for corner; THENCE, N.89°28'E, a distance of 485.3 feet to a point for corner; THENCE, South, a distance of 293.0 feet to a point for corner; THENCE S.89°28'W, a distance of 568.2 feet to a point for corner; THENCE, N.85°28'40"W, a distance of 50.0 feet to a point for corner; THENCE, along a curve to the left having a central angle of 15°33'20'', a radius of 1000.0 feet and a back tangent bearing N.4°31'20"E, an arc distance of 271.50 feet to the PLACE OF BEGINNING and containing 4.02 acres of land. SECTION 2. That all ordinances of the City in conflict with the provisions of this ordinance be, and the same are hereby, repealed and all other ordinances of the City not in conflict with the provisions of this ordinance shall remain in full force and effect. SECTION 3. That the above described property shall be used only in the manner and for the purposes provided for in the Com- prehensive Zoning Ordinance of the City, as amended herein by the granting of this zoning classification. SECTION 4. That should any paragraph, sentence, subdivision, clause, phrase or section of this ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall not affect the validity of this ordinance as a whole or any part or provision thereof other than the part so decided to be invalid, illegal or unconstitutional and shall not affect the validity of the Compre- hensive Zoning Ordinance as a whole. SECTION 5. That any person, firm or corporation violating any of the provisions or terms of this ordinance shall be subject to the same penalty as provided for in the Comprehensive Zoning Ordinance of the City, as heretofore amended, and upon conviction shall be punished by fine not to exceed the sum of Two Hundred Dollars ($200.00) for each offense, and that each day such violation shall continue to exist shall constitute a separate offense. SECTION 6. Whereas, the above described property requires that it be given the above zoning classification in order to permit its proper development and in order to protect the public interest, comfort and general welfare of the City, and creates an urgency and an emergency for the preservation of the public health, safety and welfare, and requires that this ordinance shall take effect imme- diately from and after its passage and publication of the caption, as the law in such cases provides.
