AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, A~NDING
THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY, AS HERETOFORE
AMENDED, TO Ct~NGE THE ZONING CLASSIFICATION ON THE PROPERTY AS
HEREINAFTER DESCRIBED AND DESIGNATED; PROVIDING FOR A PENALTY
NOT TO EXCEED TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE
AND DECLARING AN EMERGENCY.
WHEREAS, the City Zoning Commission of the City and
the Governing Body of the City, in compliance with the laws of
the State of Texas with reference to the granting of zoning
changes under the zoning ordinance and zoning map, have given
requisite notices by publication and otherwise, and, after hold-
ing due hearings ~nd affording a full and fair hearing to all
property owners generally and to the persons interested in the
area and situated in the area, the City is of the opinion that
the said change of zoning on application of John W. Hudnall, III
should be granted and the Comprehensive Zoning Ordinance should
be amended in the exercise of its legislative direction.
NOW, THEREFORE, BE IT ORDAINED By THE CITY COUNCIL OF
THE CITY OF COPPELL, TEXAS:
SECTION 1. That the Comprehensive Zoning Ordinance
of the City, be, and the same is hereby amended by amending the
Zoning Map of the City so as to give the hereinafter described
property, located within the corporate limits of the City, the
zoning district classification, as hereinafter designated:
TRACT 1.
Changed from "SF-12" Single Family Dwelling District
Classification to "R" Retail District Classification, said tract
being described as follows:
A tract of land located on Sandy Lake Road in Dallas
County, Texas, and being out of WESTON PERRY SURVEY, AB-
STRACT NO. 1152 and being a part of property conveyed to
J. W. Hudnall, Jr., by deed recorded in Volume 3840 at
page 185 of the Deed Records of Dallas County, Texas,
and being more particularly described as follows:
BEGINNING at the Southwest corner of said J. W. Hudnall
tract, said beginning point being located in the West
line of said Perry Survey, Abstract No. 1152 and on the
East line of D. Myers Survey, Abstract No. 886;
THENCE North 03 deg. 28 min. West with old fence line,
tree line and Survey line, 862.09 feet to point for
corner located on the South line of Sandy Lake Road,
25 feet from centerline;
THENCE Southeasterly with the South line of said Sandy
Lake Road and with a curve to the left, 285.29 feet to
P.T. of Curve for corner, said curve having a radius of
1106.96 feet and a central angle of 14 deg. 46 min.;
THENCE North 87 deg. 35 min. East with tile South line of
said Sandy Lake Road 134.71 feet to point for corner;
THENCE South 03 deg. 28 min. East parallel to the West
line of said Hudnall Tract 821.73 feet to point for
corner in the South line of Hudnall Tract and on old
fence line;
THENCE South 87 deg. 07 min. West with old fence and South
line of said Hudnall Tract 416.02 feet to Place of Beginning
and containing 7.942 acres of land.
TRACT 2.
Changed from "SF-12" Single Family Dwelling District
Classification to "R" Retail District Classification with a
special use permit for a golf driving range type commercial
amusement, said tract being described as follows:
A tract of land located on Sandy Lake Road in Dallas
County, Texas, and being out of WESTON PERRY SURVEY, AB-
STRACT NO. 1152 and being a part of property conveyed to
J. W. Hudnall, Jr., by deed recorded in Volume 3840 at
page 185 of the Deed Records of Dallas County, Texas,
and being more particularly described as follows:
COMMENCING at the Southwest corner of said J. W. Hudnall
Tract, said commencing point being located in the West
line of said Perry Survey, Abstract No. 1152, and on the
East line of D. Myers Survey, Abstract No. 886; thence
North 87 deg. 07 min. East with fence line and South line
of Hudnall Tract 416.02 feet to Place of Beginning;
THENCE North 03 deg. 28 min. West parallel to the West
line of said Hudnall Tract 821.73 feet to point in South
line of Sandy Lake Road for corner;
THENCE North 87 deg. 35 min. East with the South line of
Sandy Lake Road 841.03 feet to stake for corner;
THENCE South 15 deg. 31 min. East with old fence 572.35
feet to stake for corner;
THENCE South 256.69 feet to stake set in South line of
Hudnall Tract in old fence line;
THENCE South 87 deg. 07 min. West with old fence and
South line of Hudnall Tract 944.90 feet to Place of
Beginning and containing 17.220 acres of land.
SECTION 2. That all other ordinances of the City
in conflict with the provisions of this Ordinance be, and the
same are, hereby repealed and all other ordinances of the City
not in conflict with the provisions of this Ordinance shall re-
main in full force and effect.
SECTION 3. That the above described property shall
be used only in the manner and for the purposes provided for in
the Comprehensive Zoning Ordinance of the City as amended herein
by the granting of this zoning classification.
SECTION 4. That should any paragraph, sentence, sub-
division, clause, phrase or section of this ordinance be adjudged
or held to be unconstitutional, illegal or invalid, the same shall
not affect the validity of this ordinance as a whole or any part
or provision thereof other than the part so decided to be invalid,
illegal or unconstitutional, and shall not affect the validity of
the Comprehensive Zoning Ordinance as a whole.
SECTION 5. That any person, firm or corporation vio-
lating any of the provisions or terms of this ordinance shall be
subject to the same penalty as provided for in the Comprehensive
Zoning Ordinance of the City as heretofore amended, and upon con-
viction shall be punished by a fine not to exceed the sum of Two
Hundred Dollars ($200.00) for each offense and that each day such
violation shall continue to exist shall constitute a separate
offense.
SECTION 6. Whereas, each tract, above described,
requires that it be given the above mentioned zoning class-
ification in order to permit its proper development and in
order to protect the public interest, comfort and general well-
fare of the City and creates an urgency and an emergency for
the preservation of the public health, safety and welfare and
requires that this ordinance shall take effect immediately from
and after its passage and publication of the caption as the law
in such cases provides.
