OR 124-A-4 Amends Ord. 124 by authorizing Reserve Officers with over one year of service to drive police vehicles AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 124A4 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING ORDINANCE NO. 124, WHICH ESTABLISHED A POLICE RESERVE FORCE WITHIN THE CITY BY CHANGING SECTION 10 OF SAID ORDINANCE TO AUTHORIZE RESERVE OFFICERS WITH OVER ONE (1) YEAR OF SERVICE TO DRIVE POLICE VEHICLES WITH AUTHORIZATION OF CHIEF OF POLICE; PROVIDING A REPEAL- ING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING PENALTIES FOR VIOLATION OF THIS ORDINANCE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. AMENDING (SECTION 10) ORDINANCE NO. 124. That Ordinance No. 124, the basic ordinance of the City of Coppell, establishing a Police Reserve Force of the City, heretofore passed by the City Council of the City of Coppell, Texas, on the 6th day of November, 1973, is hereby amended so that Section 10 thereof shall read as follows: "SECTION 10. DUTIES. Members of the Police Reserve Force shall serve at the discretion of the Chief of Police and may be called into service at any time the Chief of Police considers it necessary to have additional officers to preserve the peace and enforce the law. The Chief of Police may establish rules and regulations to govern the Police Reserve Force and may direct members of the Police Reserve to obey the instructions of Regular Police Officers, except as hereinafter authorized, a Police Reserve Officer shall not drive a Police Department vehicle unless accompanied by a regular duty Police Officer. Provided, however, Reserve Police Officers having more than one (1) year of service as a Coppell Reserve Officer may drive a Police Department vehicle when accompanied by another Police Reserve Officer and authorized by the Chief of Police. Such one (1) year period of service shall not be broken by more than thirty (30) days of inactive service as a Coppell Reserve Police Officer. Reserve Police Officers shall act only in a supplementary capacity to the Regular Police Force and shall in no case assume the full time duties of Regular Police Officers without first com- plying with all requirements for such Regular Police Officers." SECTION 2. REPEALING CLAUSE. Section 10 of Ordinance No. 124 and all other ordinances, or parts of ordinances, inconsistent or in conflict with the pro- visions of this ordinance are hereby repealed. Provided, however, all other parts of Ordinance No. 124 shall remain in full force and effect. SECTION 3. SEVEP~ILITY CLAUSE. If any article, paragraph or subdivision, clause, phrase or provision of this ordinance shall be adjudged invalid or held unconstitutional, the same shall not affect the validity of this ordinance as a whole or any part or provision thereof, other than the part so decided to be invalid or unconstitutional. SECTION 4. PENALTY CLAUSE. Any person, firm or corporation violating any of the provisions of this ordinance shall be deemed guilty of a mis- demeanor and, upon conviction, shall be punished by a penalty of fine not to exceed the sum of ~o Hundred Dollars ($200.00) for each offense, and each and every day such offense is con- tinued shall constitute a new and separate offense. SECTION 5. E~RGENCY CLAUSE. The fact that the present City regulations are inadequate to properly protect the public health, safety and welfare, creates an urgency and an emergency and requires that this ordinance shall take effect immediately from and after the publication of its caption, as the law in such cases provides.
