OR 111 Amends change from "SF-7" Single Family & "SF-10" Single Family to "PD" Planned Dev for a rec ctr AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 111 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF COPPELL, TEXAS AS HERETOFORE AMENDED SO AS TO CHANGE THE HEREINAFTER DESCRIBED PROPERTY FROM "SF-7 & SF-10" SINGLE FAMILY DWELLING DISTRICT CLASSIFICATION TO "PD" PLANNED DEVELOPMENT DISTRICT CLASSIFICA- TION FOR USE AS A RECREATION CENTER; REQUIRING APPROVAL OF A COMPREHENSIVE SITE PLAN OF THE DEVELOPMENT PRIOR TO THE ISSUANCE OF ANY BUILDING PERMIT; PROVIDING FOR A PENALTY NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE AND DECLARING AN EMERGENCY. WHEREAS, the City Zoning Commission and the Governing Body 9f the City, in compliance with the laws of the State of Texas with reference to the granting of zoning changes under the zoning ordinance and zoning map, have given requisite notices by publication and otherwise, and, after holding due hearings and affording a full and fair hearing to all property owners generally and to the persons interested and situated in the area, the City is of the opinion that the said change of zoning on application of COPPELL HISTORICAL CORP. should be granted and the comprehensive zoning ordinance should be amended in the exercise of its legislative direction: NOW, THEEFOE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. That the Comprehensive Zoning Ordinance of the City of Coppell, Texas, be, and the same is hereby amended by amending the Zoning Map of the City of Coppell so as to give the hereinafter described property the following zoning district class- ification, to wit: "PD" PLANNED DEVELOPMENT DISTRICT CLASSIFICATION FOR USE AS A RECREATION CENTER , and specifically a Family Enter- tainment Complex consisting of: EXHIBITS AND ATTRACTIONS SuCh as an old fort exhibit, Indian village exhibit, play ground equipment, covered shelters and observation decks. GARDEN AREAS inCluding'a greenhouse, a wishing well and fountains. GIFT, SOUVENIR AND CRAFT BUILDINGS. ADMINISTRATIVE STRUCTURES including ticket booths, rest rooms, dressing rooms and prop rooms for amphitheater associated warehouse buildings, and an animal shelter (a location to keep pets belonging to patrons of the park required because such pets are not to be allowed within the park area). FOOD AND BEVERAGE OUTLETS such as popcorn stands, sandwich shops, soft drink stands and watermelon stands. SHOWS such as puppet shows, a band stand and amphi- theater structures. A~SEMENT RIDES such as a railroad ride and various flat rides. The term "flat rides" as used herein means amusement rides primarily designed for small children. Such planned development to be subject to the ~pproval of a comprehensive site and development plan by the City Council prior to the issuance of any Building Permit in the Planned Develop- ment District and subject to such conditions as may be imposed by the City Council as conditions precedent to the granting of a Certificate of Occupancy. Such plan shall provide for.at least eight and one-half (8 1/2) acres of parking space to be developed in conjunction with the overall park project with an additional eight (8) acres of land to be held in reserve for additional park- ingspace as needed to meet increased attendance. The term "held in reserve" as used in this paragraph means an area maintained and landscaped as an open space, but not occupied by rides, buildings or other permanent type improvements. That all other ordinances of the City in conflict with the provisions of this Ordinance be, and the same are, hereby repealed and all other ordinances of the City not in conflict with the provisions of this Ordinance shall re- main in full force and effect. SECTION 3. That the above described property shall be used only in the manner and for the purposes provided for in the Comprehensive Zoning Ordinance of the City as amended herein by the granting of this zoning classification. SECTION 4. That should any paragraph, sentence, sub- division, clause, phrase or section of this ordinance be adjudged or held to be unconstitutional, illegal or inyalid, the same shall .not affect'the validity of this ordinance-as ~ whole or any part or provision thereof Other than the part sodecided to be invalid, illegal or unconstitutional, and shall not affect the validity of the Comprehensive Zoning Ordinance as a whole. SECTION 5. That any person, firm or corporation Vio- lating any of the provisions or terms of this ordinance shall be subject to the same penalty as provided for in the Comprehensive Zoning Ordinance of the City as heretofore amended, and upon con- viction shall be punished by a fine not to exceed the sum of Two Hundred Dollars ($200.00) for each offense and that each day such violation shall continue to exist shall constitute a separate offense. SECTION 6. Whereas, each tract, above described, requires that it be given the above mentioned zoning class- ification in order to permit its proper development and in order to protect the public interest, comfort and general well- fare of the City and creates an urgency and an emergency for the preservation of the public health, safety and welfare and requires that this ordinance shall take effect immediately from and after its passage and publication of the caption as the law in such cases provides.
