ORDINANCE NO. 103A1
AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING
ORDINANCE NUMBER 61, THE PLUMBING CODE OF THE CITY OF COPPELL,
TEXAS, BY ADDING THERETO A PROVISION THAT NO SEPTIC TANKS,
SANITARY SEWAGE TILE FIELDS OR OTHER SANITARY SEWAGE DISPOSAL
FACILITIES, LIVESTOCK PENS, OR DUMP GROUNDS WILL BE LOCATED
WITHIN A DISTANCE OF ONE HUNDRED FIFTY (150) FEET OF ANY
MUNICIPAL WATER WELL; PROVIDING PENALTIES FOR VIOLATION OF
THIS ORDINANCE; PROVIDING A SEVERABILITY CLAUSE AND DECIARING
AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL,
TEXAS:
SECTION 1. That Ordinance Number 61, the:City of Coppeli
Plumbing Code, heretofore passed by the City Council of the
City of Coppell, Texas, on the 7th day of December, 1970, is
hereby amended so that Section 3 thereof shall read as follows:
"SECTION 3. SPECIFIC AMENDS~NTS AND MODIFICATIONS:
This Code adopted hereby and attached hereto as Exhibit
is amended by adding thereto the following provision: No septic
tank, sanitary sewer tile field or other sanitary sewage dis-
posal facility, livestock pen, or dump ground shall be located
within a distance of 150 feet of any municipally-owned water
well which provides water for the Municipal Water System."
SECTION ~. Severability Clause:
If any Article, psragraph or subdivision, clause, phrsse or
provision of this Ordinance shall be deemed or ad3udged invalid,
or held unconstitutional, the same shall not affect the validity
of this Ordinance as a whole or any part or provision thereof,
other than the part so decided to be invalid or unconstitutional.
SECTION 3. Penalty Clause:
Any person, firm or corporation violating any o~ the pro-
visions of this Ordinance shall be deemed guilty of a misdemeanor
and, upon conviction, shall be fined not to exceed the sum of
Two Hundred Dollars ($200.00) for each offense, and each and every
day such offense shall continue shall constitute a separate offense.
SECTION 4. Emergency Clause:
The fact that the present City Ordinances are inadequate to
properly protect the public health, safety and welfare, creates an
urgency and an emergency and requires that this Ordinance shall
take effect immediately from and after the publication of its
caption, as the law in such cases provides.
