OR 103 Adopts Dallas Pluming Code to provide administration, licensing & regulation of plumbers & plumbing ORDINANCE NO. 103 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, ADOPTING THE PLUMBING CODE OF THE CITY OF DALLAS AS ESTABLISHED BY CITY OF DALLAS ORDINANCE NUMBER 12093; MAKING CERTAIN AMEND- MENTS TO THE DALLAS PLUMBING CODE; PROVIDING FOR THE ESTABLISH- MENT OF A BOARD OF PLUMBERS; PROVIDING FOR THE CREATION OF THE OFFICE OF CHIEF PLUMBING INSPECTOR; HIS ASSISTANTS, AND THEIR QUALIFICATIONS, DUTIES, LIABILITIES AND AUTHORITY; PROVIDING FOR THE ADMINISTRATIVE PROVISIONS OF THE PLUMBING CODE REGULATIONS GOVERNING THE INSTALLATION OF PLUMBING; PROVIDING FOR THE REGULATION AND LICENSING OF PLUMBERS; PROVIDING REGULATIONS FOR THE INSTALLATION OF GAS PIPING AND APPLIANCES; PROVIDING FOR REGULATION AND LICENSING OF GAS FITTERS; REPEALING ALL PARTS OF ORDINANCES IN CONFLICT WITH THIS ORDINANCE; SPECIFICALLY REPEALING ORDINANCE NUMBER 61 BUT SPECIFICALLY NOT REPEALING ORDINANCE NUMBER 104, PROVIDING A SEVERABILITY CLAUSE; PROVID- ING PENALTIES FOR VIOLATION OF THIS ORDINANCE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. TITLE. This Ordinance shall be known as "THE CITY OF COPPELL [ LUMBING CODE" . SECT[ION 2. ~DOPTION OF DALLAS PLUMBING CODE. 5~ere is hereby adopted by the City of Coppell, "ex~'~, for the purpose of providing requirements for safeguard- ing persons and property and promoting the welfare of the public, that certain PLUMBING CODE OF THE CITY OF DALLAS, TEXAS, as established by City of Dallas Ordinance Number 12093, save and except portions as are hereinafter deleted, modified, or amended. A copy of said adopted code is attached hereto as Exhibit "A" and made a part hereof the same as if fully set out at length herein, and from the date this ordinance shall take effect the provisions thereof shall be controlling within the corporate limits of the City. Where the words "City of Dallas" are used in the adopted Code they shall mean City of Coppell. Likewise, language in the Code shall be construed, where necessary, to apply to the City of Coppell. Reference to other City of Dallas Ordinances and Codes shall be construed to to refer to like Ordinances or Codes which are applicable to the City of Coppell. SECTION 3. SPECIFIC A~ViENDMENTS TO THE DALLAS PLUMBING CODE. The Plumbing Code of the City of Dallas adopted by this ordinance and attached hereto as Exhibit "A" is amended as follows: (a) Article II. "Board of Plumbers" is amended to read: "In order to determine the suitability of alternate materials and methods of con- struction and to provide for reasonable interpretations of the provisions of this Code, there shall be and is hereby c~eated a Board of Appeals consisting of five .(5) members, all of whom shall reside within the corporate limits of the City of Coppell. Members shall be appointeG by the City Council or if such members are not so appointed the City Council shall sit as the Board of Appeals. POWERS AND DUTIES OF THE BOARD OF APPEALS. The Board shall have the power to pass upon the true intent and meaning of the several provisions of the Plumbing Code and also on questions wherein it is claimed that an equally good or desirable form of plumbing or material can be used, and to permit the same, but it is expressly limited to those matters. The Board shall have no power to otherwise limit, modify, or change this Code the same to be accomplished only by ordinance amending the Code. All rulings and decisions of the Board shall be final and binding upon all parties, and upon making its decision on any matter it shall be the duty of the Bu~.lding Official to enforce the decision of the Board. APPEAL PROCEDURE. Any person aggrieved by any decision or ruling made by the Plumbing Official under the provisions of this Code, shall have the right to make an appeal to the Board. Such appeals shall be made by filing with the Plumbing Official, a written notice specifying the grounds therefor. The Plumbing Official shall forthwith transmit to the Board all of the papers and the record upon which the action appealed from is made. (b) Section 35-15. is amended to read: "The administration and enforcement of the Coppell Plumbing Code is hereby assigned to and shall be the responsibility of the City Building Inspection Division of the Building Department". (c) Section 35-16 is amended to read: "There is hereby created the office of Chief Plumbing Inspector. The person chosen to fill the office of Chief Plumbing Inspector shall be possessed of such executive ability as is required for the performance of his duties, and shall have a thorough knowledge of the standard materials and methods used in the installation of plumbing systems and gas fitting." (d) Section 35-18 is amended to read: "The Chief Plumbing Inspector and such other plumbing inspectors as are necessary for the proper administration and enforce- ment of this code shall be appointed by the City Council to serve at the pleasure of the City Council and shall receive for services performed such compensation as is fixed by the City Council." (e) Section 35-19 is amended by deleting the entire section. SECTION 4. REPEALING CLAUSE: Ail parts of ordinances inconsistent or in conflict with the provisions of this ordinance are hereby repealed. Ordinance No. 61 is specifically repealed, however, Ordinance No. 9~ is not repealed and shall remain in full force and effect. However, the repeal of existing ordinances by this ordinance shall not effect or prevent the prosecution or the punishment of any person for any act done or committed prior to the effective date of this ordinance in violation of any ordinance hereby repealed; and prosecution for such offenses may be instituted and causes presently pending proceeded with in all respects as if such prior ordinance or ordinances had not been repealed. SECTION 5. SEVERABILITY CLAUSE: If any article, paragraph or sub-division, clause, phrase or provision of this Ordinance shall be adjudged valid or held unconstitutional, the same shall not affect the validity of this Ordinance as a whole or any part or provision thereof other than the part so decided to be invalid or uncon- stitutional. SECTION 6. PENALTY CLAUSE: Aqy person, firm or corporation violating any of the provisions of this Ordinance shall be deemed guilty of a mis- demeanor and, upon conviction, shall be fined not to exceed the sum of two hundred ($200.00) dollars for each offense and each and every day such offense is continued shall constitute a new and separate offense. SECTION 7. EMERGENCY CLAUSE: The fact that the present City regulations are in- -adequate to properly protect the public health, safety and welfare, creates an urgency and an emergency and requires that this Ordinance shall take effect immediately from and after the publication of its caption as the law in such cases pro- vides. SECTION 8. SPECIAL HANDLING OF ORDINanCE: Due to the'size of the Volume attached hereto as Exhibit "A" it is hereby directed that the original of this Ordinance, with Exhibit "A" attached, be kept in a separate file in the office of the City Secretary, and that a duplicate original of the Ordinance, with a photocopy of the cover sheet of such Volume, be placed in the Official Ordinance Book. AS TO FORM: /CITY ATTORNEY AMENDMEND TO THI[ PLUMBING CODE OF COPPELL, TEXAS Gas Piping shall be of Type L or heavier annealed or drawn temper copper tubing with wrought copper solder Joint fittings; polyethylene plastic pipe with polyethylene plastic fittings and/ or approved compression type fittings with internal stiffeners; black steel pipe with threaded black malleable iron fittings. Ail ferrous pipe shall be Schedule 40 or heavier. Plastic piping or tubing conformAn~ with specification ASTM D2513-68 Standards Specification for Thermoplastic Gas Pressure Pipe, Tubing and Fittings, may be used for conveying gas. Tubing dimensions shall be specified on wall thickness and either inside or outside diameter. Standard Dimension Ratio (SDR) number for IPS gas pipi~ shall be S~ 11 on sizes to 2: or s~aller. Plastic piping and tubing must be buried in the ground for its entire length, and may not be used within or under a~y building. Such pipe and tube shall be ~mnufactured in accordance to the following specification: Material AST~ Standard Polyethylene, Type II, Grade 3 Class B (PE 2306) D 2513-68 Polyethylene, Type ~I, Grade 3 Class C (PE 2306) D 2513-68 Polyethylene, Type III, Grade 3 Class C (PE 3306) D 2513-68 Polyethylene plastic pipe and fittings shall be installed in accordance with the ANSI Standard Code for Pressure Piping B31.8- 1968 Edition. Heat fusion Joints as reco~ended by the manufacturer or compression type mechanical type Joints shall be used to join pipe, tubing and fittings. Service risers must be constructed of steel pipe and they must be protected from vehicular traffic. Risers connected to plastic pipe must be supported by a post driven or set into firm ground, or other- wise stabilized to prevent transferal of force due to natural settling or accidental movement of the riser to the polyethylene pipe. - 2 ~ Nothing in this code shall be construed as prohibiting an individual from negotiating with the Gas Ccmpanv for the repair, replacement, or installation of yard or service line (that line carryin~ unmeasured gas) on his premises or as requirinE a license or bond from Gas Compare. Such work shall be performed by qualified employees of the Gas Compare, in accordance with all other provisions of this code, including those related to permits, fees~ etc. RECOMMENED YARD LINE- INSTALLATION
