OR 100 Adopts Dallas Bldg Code to regulate construction, alteration, repair, etc. of buildings & structures ORDINANCE NO. 100 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, ADOPTING THE BUILDING CODE OF THE CITY OF DALLAS; REGULATING THE ERECTION, CONSTRUCTION, ENLARGEMENT, ALTERATIOIN, REPAIR, MOVING, REMOVAL, DEMOLITION, CONVERSION, OCCUPANCY, EQUIPMENT, USE, HEIGHT, AREA AND MAINTENANCE OF BUILDINGS AND STRUCTURES IN THE CITY OF COPPELL AND PROVIDING FOR INSPECTION, ISSUANCE OF PERMITS AND THE COLLECTION OF FEES THEREFOR; DECLARING AND ESTABLISHING A FIRE ZONE NO. 3; PROVIDING FOR CERTAIN AMENDMENTS TO THE DALLAS BUILDING CODE; REPEALING ALL PARTS OF ORDINANCES IN CONFLICT WITH THIS ORDINAI]CE; SPECIFICALLY REPEALING ORDIN- ANCE NUMBER SIXTY-TWO (62); PROVIDING A SEVERABILITY CLAUSE; PROVIDING PENALTIES FOR VIOLATION OF THIS ORDINANCE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE AND DECLARING AN EMERGENCY. , WHEREAS, the present Dallas Building Code is an amended version of Volume 1 of the 1970 edition of the Uniform Buildin~ Code; and, WHEREAS, it is deemed necessary to provide minimu~ standards to regulate the design, construction, materials use and occupancy, location and maintenance of buildings and struc- tures and certain equipment thereof, within the City to protect and promote public safety, health and welfare; NOW THEREFORE, BE IT OP~DAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. TITLE. This Ordinance shall be known as "THE CITY OF COPPELL BUILDING CODE." SECTION 2. ADOPTION OF DALLAS BUILDING CODE. There is hereby adopted by the City of Coppell, Texas, for the purpose of providing requirements for sdfe- guarding persons and property and promoting the welfare of the public, that certain Building Code of the City of Dallas, Texas, save and except portions as are hereinafter deleted, modified, or amended, a copy of which is attached hereto as Exhibit "A" and made a part hereof the same as if fully set out at length herein, and from the date this ordinance shall take effect the provisions thereof shall be controlling in the corporate limits of the City. Where the words "City of Dallas" are usedin the adopted Code they shall mean City of Coppell. Likewise, language in the Code shall be construed, where necessary, to applyto the City of Coppello Reference to other City of Dallas Ordinances or Codes shall be construed to refer to like Ordinances or Codes which are applicable to the City of Coppell. this SECTION 3. SPECIFIC A/IENDliENTS TO THE DALLAS BUILDING CODE. The Building Code of the City of Dallas adopted by ordinance and attached hereto as Exhibit "A" is amended follows: (a) Section 105 is amended to read: "Buildings and structures hereafter moved into the City, shall conform to or shall be made to conform to requirements of this Code which are applicable to new buildings. This subject is covered by a separate ordinance, to wit: THE CITY OF COPPELL ORDINanCE REGULATING TItE MOVING OF STRUCTURES INTO AND ACROSS THE CITY. (b) Section 201 is amended to read: "There is hereby established in the City the ~uilding Department which shall be under the jurisdiction of the Building Official which office has been created by City of Coppell Ordinance No. 86. The Building Official shall be the Chief Building Inspector for the City and the City Council shall appoint such other officers, inspectors, assistants and other employees as may from time to time be required by the Building Department. The Building Official may deputize any such employee of the Department as may be necessary to carry out the functions of the Department and the Ordinances of the City". (c) Section 204 is amended to read: "In order to determine the suitability of alternate materials and me~lods of con- struction and to provide for reasonable 7 interpretations of the provisions of this Code, there shall be and is hereby created a Board of Appeals consisting of five (5) members, all of whom shall reside within. the corporate limits of the City of Coppell. Members shall be appointed by the City Council or if such members are not so appointed the City Council shall sit as the Board of Appeals. POWERS AND DUTIES OF THE BOARD OF APPEALS. The Board shall have the power to pass upon the true intent and meaning of the several provisions of the Building Code and also on questions wherein it is claimed that an equally good or desirable form of construction or material can be used, and to permit the same, but it is expressly limited to those matters. The Board shall have no power to otherwise limit, modify, or change this Code the same to be accomplished only by ordinance amending the Code. All rulings and decisions of the Board shall be final and binding upon all parties, and upon making its decision on any matter it shall be the duty of the Building Official to enforce the decision of the Board. APPEAL PROCEDURE. Any person aggrieved by any decision or ruling made by the Building Official under the provisions of this Code, shall have the right to make an appeal to the Board. Such appeals shall be made by filing with the Building Official, a written notice specifying the grounds therefor. The Building Official shall forthwith transmit to the Board all of the papers and the record upon which the action appealed from is made. (d) Chapter 62, dealing with the moving of buildings and heavy equipment is deleted in its entirety. The subject is covered by a separate ordinance, to wit: The City of Coppell Ordinance Regulating the Moving of Structures into and across the City. (e) Section 301 is amended as follows: By changing the words "Chapter 62" to "The City of Coppell Ordinance Regulating the Moving of Structures into and across the City." (f) Section 1601 (a) is amended to read: "Fire Zones Defined. For the purpose of this Code, Fire Zones shall include such areas of the City as designated and des- cribed in a separate Ordinance, to wit: The City of Coppell Ordinance Establish- ing City Fire Zones. Areas of the City which are not designated and described therein as being in Fire Zone No. 1 or Fire Zone No. 2 shall be known, and are hereby designated, as being Fire Zone No. 3. Whenever reference is made in this Code to Fire Zone No. 1 or Fire Zone No. 2 or Fire Zone No. 3, such re- reference shall mean one of the areas indi'cated herein." (g) Section 6003 is amended by deleting the first paragraph only. (h) Section 6004 is amended by deleting the entire section. (i) Chapter 65, dealing with regulation of fences, is amended by deleting the chapter in its entirety. The subject is covered by separate ordinance. (j) The Appendix to Exhibit "A" which contains Chapter 48, Chapter 49 and Chapter 57 are adopted along with the Code. Chapter 48 contains Sections 4801 through 4803 and deals with Photo- graphic and X-Ray films; Chapter 49 contains Sections 4901 through 4903 and Table No. 49-A and deals with Patio Covers and Chapter 57 contains Sections 5701 through 5708 and Table 57-A, and deals with Fallout Shelters. (k) Section 303a is amended as follows: The ninth paragraph of section 303a deal- ing with fees for moving structures is deleted. SECTION 4. REPEALING CLAUSE: All parts of ordinances inconsistent or in conflict with the provisions of this ordinance are hereby repealed. Ordinance No. 62 is specifically repealed in its entirety. However, the repeal of existing ordinances by this ordinance shall not affect or prevent the prosecution or the punishment of any person for any act done or committed prior to the effective date of this ordinance in violation of any ordinance hereby repealed; and prosecution for such offenses may be instituted and causes presently pending proceeded with in all respects as if such prior ordinance or ordinances had not been repealed. SECTION 5. SEVERABILITY CLAUSE: If any article, paragraph or sub-division, clause, phrase or provision of this Ordinance shall be adjudged in- valid or held unconstitutional, the same shall not affect the validity of thi~ Ordinance as a whole or any part or provision thereof other than the part so decided to be invalid or uncon- stitutional. SECTION 6. PENALTY CLAUSE: Any person, firm or corporation violating any of the provisions of this Ordinance shall be deemed guilty of a mis- demeanor and, upon conviction, shall be fined not to exceed the sum of two hundred ($200.00) dollars for each offense and each and every day such offense is continued shall constitute a new and separate offense. SECTION 7. E~RGENCY CLAUSE: The fact that the present City regulations are in- adequate to properly protect the public health, safety and welfare, creates an urgency and an emergency and requires that this Ordinance shall take effect immediately from and after the publication of its caption as the law in such cases pro- vides. SECTION 8. SPECIAL HANDLING OF ORDINANCE: Due to the size of the Volume attached hereto as Exhibit "A" it is hereby directed that the original of this Ordinance, with Exhibit "A" attached, be kept in a separate file in the office of the City Secretary, and that a duplicate original of the Ordinance, with a photocopy of the cover sheet of such Volume, be placed in the Official Ordinance Book.
