Re: Bethel Road/Bass Pro Dr. project located as follows: Bethel Road/Bass Pro, Coppell, TX, in Dallas County
The undersigned, Murray Construction Co., Inc. ("Claimant"), has furnished labor and/or material to J&T Excavating
("Debtor"), who is the sub-contractor under the original contract made between the above Owner and Contractor, in
connection with the referenced project.
Claimant has not been paid all of the amounts due to it under its subcontract with Debtor for work performed during the
following calendar month(s): 2008 through June 2009. The aggregate of all amounts earned and unpaid to Claimant on the
referenced job is: $56,229.22.
Under the mechanic's lien laws of Texas, a subcontractor who contracts with another contractor to furnish material or labor
in connection with a construction project is required to notify the owner and the appropriate original contractor of all claims
that are not paid. Failure to give this notice could cause a claimant to lose its rights under the mechanic's lien laws.
Texas mechanic's lien law further requires that Claimant advise the Owner, and we hereby advise the above Owner-
addressee(s), that if the claim remains unpaid, the Owner may be personally liable and the Owner's property subjected to a
lien unless the Owner withholds payments from the Original Contractor for payment of the claim or the claim is otherwise
paid or settled.
Please consider this a demand for payment of the aforementioned aggregate unpaid balance, which is an accrued obligation or
is past due under the terms of our subcontract with Debtor.
The sending of a Notice as required by law is NOT to be construed as a reflection upon the credit practices or paying habits
of J&T Excavating. It is required by law, and is generally welcomed by all responsible firms who uphold sound methods of
conducting their businesses.
