I've reviewed the Dallas County Abstract maps (these are maps that Dallas County keeps that show all
activity that has ever occurred on a parcel of property) and they show that on August 2, 1961, a 35 foot
wide Perpetual Roadway Easement was dedicated for Mitchell Street. I do not have the dedication
document, so I'm not sure how the dedication was handled. Sometimes, on older dedications, the
dedication is simply in the verbiage of the legal description of the property with wording similar to
"save and except 35 feet for a perpetual roadway easement". If you have access to some of the legal
documents, you may want to check them. Also, the title company should have picked up some
reference to the 1961 easement.
At this time, I'm not sure how you wish to proceed. I'm having my staff do some additional
investigation to determine if we can discover what happened. Also, with the 1961 date, the title
company may have better luck in trying to determine how the 35 foot Perpetual Roadway Easement
came to be on the Dallas County Abstract maps.
