THAT THE RETAINING/SCREENING WALL WHICH IS LOCATED ON THEIR
PROPERTY ENCROACHES ONTO THE CITY OF COPPELL'S SANITARY SEWER
EASEMENT; AND
WHEREAS, THE OWNERS UNDERSTAND AND ACKNOWLEDGE THAT IN
CASE REPAIRS OR IMPROVEMENTS ARE REQUIRED TO BE MADE TO THE CITY
OF COPPELL'S SANITARY SEWER EASEMENT WHICH WOULD REQUIRE
REMOVAL OF THE RETAINING/SCREENING WALL IN ORDER TO EFFECT SUCH
IMPROVEMENTS; AND
WHEREAS, THE OWNERS RECOGNIZE AND ACKNOWLEDGE THAT SUCH
RETAINING/SCREENING WALL WAS INSTALLED DESPITE KNOWLEDGE OF THE
CITY'S SANITARY SEWER EASEMENT;
OWNERS HEREBY AGREE TO REMOVE SUCH RETAINING/SCREENING
WALL AT THEIR OWN COST AND UPON REQUEST BY THE CITY OF COPPELL,
AND IF OWNERS FAIL TO REMOVE THE RETAiNING/SCREENING WALL UPON
REQUEST BY THE CITY, THEN CITY WILL REMOVE SUCH
RETAINING/SCREENING WALL AND OWNERS HEREBY INDEMNIFY AND HOLD
THE CITY HARMLESS FROM ALL CLAIMS OF DAMAGE TO TH~
RETAINING/SCREENING WALL WHICH ARISE FROM THE CITY'S REMOVAL OF
SUCH RETAINING/SCREENING WALL WHILE REPAIRING, INSPECTING,
IMPROVING OR IN ANY WAY SEEKING ACCESS TO THE SANITARY SEWER
EASEMENT. ADDITIONALLY, OWNERS AGREE TO REIMBURSE THE CITY FOR
REASONABLE COSTS INCURRED IN REMOVING THE RETAINING/SCREENING

WHEREAS, THE OWNER OF LOT 6-R, BLOCK F, OF THE
N.L.W.E. #12 SUBDMSION, 776 CRESTVIEW COURT,
COPPELL, TEXAS (THE OWNER) HAVE REPETEDLY INFORM~.D
THE CITY OF COPPELL ABOUT DAMAGES TO CITY PROPERTY
LOCATED ADJACENT AND TO THE WEST OF THE PROPERTY
DESCRIBED ABOVE, AND WHEREAS THE DAMAGE TO CITY
PROPERTY ENCROACHES ONTO THE OWNER'S PROPERTY, AND
WHEREAS, THE CITY UNDERSTANDS AND ACKNOWLEDGES
THAT FAILURE TO REPAIR THE DAMAGE TO CITY PROPERTY
THREATENS THE SECURITY AND VALUE OF THE ABOVE LISTED
PROPERTY, AND
WHEREAS THE CITY RECOGNIZES AND ACKNOWLEDGES THAT
THE DAMAGE WAS CAUSED BY DIGGING AND DRILLING OPERATIONS
PERFORMED DURING THE INSTALLATION OF THE CITY'S SANITARY
SEWER PROJECT,
OWNERS HEREBY SERVE NOTICE THAT THE CITY HAS CAUSED AND
CONTINUES TO CAUSE MATERIAL DAMAGE TO THE ABOVE LISTED
PROPERTY AND ITS OWNERS. THE CITY'S FAILURE TO RESPOND TO OR
RECTIFY THE LANDSLIDE AND SINK HOLES ON CITY PROPERTY AND IN
THE SANITARY SEWER EASEMENT IN A TIMELY FASHION HAS CAUSED
THE POSTPONEMENT AND ULTIMATE CANCELLATION OF THE OWNER'S
PLAN TO BUILD A PERMANENT RETAINING WALL ON THE WEST EDGE OF
THE AFOREMENTIONED PROPERTY.
THE CITY AGREES THAT IT WILL BEGIN TO MAINTAIN CITY PROPERTY
ADJACENT TO THE AFOREMENTIONED PROPERTY, REPAIR EXISTING
DAMAGE CAUSED BY THE CITY SEWER PROJECT, AND REFRAIN FROM
ACTS WHICH RESULT IN FURTHER DAMAGE TO THE OWNER'S PROPERTY.
