THE CITY'S FAILURE TO RESPOND TO OR RECTIFY THE LANDSLIDE AND SINK HOLES ON CITY PROPERTY AND IN THE SANITARY SEWER EASEMENT IN A TIMELY FASHION HAS CAUSED THE POSTPONEMENT AND ULTIMATE CANCELLATION OF THE OWNER'S PLAN TO BUILD A PERMANENT RETAINING WALL ON THE WEST EDGE OF THE AFOREMENTIONED PROPERTY. THE CITY AGREES THAT IT WILL BEGIN TO MAINTAIN CITY PROPERTY ADJACENT TO THE AFOREMENTIONED PROPERTY, REPAIR EXISTING DAMAGE CAUSED BY THE CITY SEWER PROJECT, AND REFRAIN FROM ACTS WHICH RESULT IN FURTHER DAMAGE TO THE OWNER'S PROPERTY.
