Dear Mr. Marvin,

I am writing in regard to my home at 501 Halifax Lane, which has been
affected and damaged by the construction on Coppell Road. Thank you for
your initial visit a couple of weeks ago in response to our call to the city.
To recap, there are several problems that have occurred with our house since
road construction began, just adjacent to the house, in June 2008:
1. The retaining wall between our house and Coppell Road was
removed without any notice to us. We had understood from
previous discussions with the city-long prior to the current road
project-that the retaining wall was our responsibility in terms of
its upkeep. If this was the case, then how could it be removed
without prior notice to and approval from us?
2. Our driveway has sunk several inches since the beginning of the
Coppell Road project.
3. The stone walkway in our backyard has sunk several inches as
well.
4. Several doors in our house either do not close or will not stay
closed, or both.
5. Large cracks have appeared in the walls of the master bathroom.
6. There are several cracks outside the house.
7. There are additional large cracks inside the house, particularly in
the garage.
8. The sidewalk in the front of the house is broken and cracked.
9. There is a large crack in the stone wall of our front flowerbed.
l0.This list leaves aside the cosmetic damage to the front and sides of
our house-landscaping removed, sidewalk cut, gravel in the yard,
etc. We are less concerned about those fairly minor problems,
which we trust will be remedied for all adjoining homeowners
before the road construction ends.
We are afraid that several-if not all-of the problems in our house and yard
are the result of the removal of the retaining wall on the Coppell road (east)
side of the house, which caused a lack of proper support for the foundation.
We want to make very clear at the outset that we have had foundation
repairs to the house during the years that we have lived here (since 1990).
Still, the house seemed quite stable after those repairs. It is only since the
Coppell Road construction has commenced, that this new and different
damage has appeared. Of course we have full documentation of the older
problems and their repair, as well as digital photos of the new problems.
We want to set up a meeting with you as an authorized representative of the
city. At that meeting, we expect that you and the city will help to develop a
plan for addressing our concerns. It is not our wish to seek legal action, but
we do reserve that as an option.
We look forward to working through this with you, for we have found
Coppell officials to be reasonable people during our many years here.
We travel frequently for work and this week (the week of 2/2/09-2/06/09) is
the only open week on our calendar.
A hard copy of this letter with a CD of pictures of damage would be hand
delivered to your office today.
