I will be in Dallas August 5, 6 and 7th. Summer is quickly disappearing on us and we need to get a shovel in the
ground. I spoke with Dave Littleton last week and he said that he would get with Keith to discuss the utility
companies and their status (or lack their of)......I'd be interested to hear how that went.
Additionally, it is my intention to bring Matt Oyen (PacTrust construction manager) with me in the hopes of getting
together with Keith, Dave and Ken to discuss logistics, expectations, timing and other specifics regarding the
actual construction process. Ken, Keith and Dave, please let me know what your availability would be for such a
meeting. Towards the end of the day on the 6th or some time before noon on the seventh would be best for us.
Our attorney is out oftown, however, we will be backto you shortly regarding your comments to the agreement.

As a follow up to our meeting on the 9th, I am inquiring as to the progress of the development contract. My
understanding is that the City was going to make modifications to the document based on our discussion last
week then provide a copy for our review. If this is not the case, please advise.

Completing the development agreement in a timely manner is paramount, as many portions of that
contract directly affect the content of the bid packages for the contractors.
