Please note that the bid date is July 2, 2009 at 4:00 p.m. This is the final Addendum to this project. Further questions may or may not be answered. Attachments: Sheet with answers. Page 1 Copies: File (8/2812009) Keith Marvin -Questions -Southwestern Blvd Response 3.doc Questions and answers to the Contractor as part of Addendum No. 3 1. Question: Addendum #1 changed the bridge sidewalk quantity to 7 CY which is consistent with the summary sheets, but if you calculate the quantity it was closer to being correct the first time at 20 CY. Answer: ITEM 63A, TxDOT Item 420, described as Class "S" Concrete for sidewalk, is listed as 7 cubic yards. This quantity only accounts for the sidewalk on the approach slab. ITEM 64A, TxDOT Item 422, quantifies the Reinforced Concrete Slab in square feet, and according to the TxDOT Standard Specifications for Construction and Maintenance of Highways, Streets, and Bridges (2004), this item should include any sidewalk located on the slab (Sec 422.5). For a detailed look at the required quantities for Class "S" Concrete and the Reinforced Concrete Slab, refer to Sheets SC1.19 through SC1.22 in the Construction Documents for the Drainage, Paving, and Utility Improvements for Southwestern Blvd. From Coppell Rd. to Grapevine Creek. 2. Question: Normally on privately funded projects where the street will become a public roadway, the city will issue a tax exempt certificate for materials for the project. Will this be the situation for Southwestern Boulevard sine it is an existing roadway? This was the intent of my question regarding this project being taxable. Answer: Keith Marvin from the City of Coppell replied, "We are 100% sure that the portion of the roadpurchased by the city would be exempt from sales tax for that tangible personal property that becomes a permanent part of the improvements. Our attorney is not as sure on the other portion. His opinion was that it would probably be covered." 3. Question: Under the "Invitation to Bid", the contractors will submit 1 electronic copy to Matt Oyen. Does the proposal to Halff need to be a hard copy or can we email that proposal also? Answer: Halff will accept a-mail submittal unti14:00 PM CDT, July 2, 2009. 4. Question: Will wasting of excess excavated material on Park West Commerce Center, LP property adjacent to the South right-of-way be allowed? Answer: The Owner will accept excess excavated material provided if is suitable for general site fill. Also Contractor shall provide a grading plan showing placement of material. Placement of fill shall compliment current plan elevations and shall be constructed in accordance with the reference specifications. Owner must approve plan prior to placement. Question: There is a bid item under the water section for TV inspection. Is this something new because quite frankly I have never heard of such a thing? Please advise. Answer: TV inspection for water is not required. Water mains shall be pressure tested and chlorinated per City and Standard Specification requirements. 6. Question: The Austin Bridge & Road Legal and Insurance Department: A. The insurance requirements are for an insurance carrier with a Best's rating of A VII.Our in house company, BAIC is rated A VI. Will the owner accept BAIC? B. There is a requirement for the insurance to be maintained for at least 10 years following substantial completion. This is a difficult requirement to meet as policy conditions, carriers and limits could possibly change within that 10 year timeframe. Is this going to be required by the owner? C. Please note that in 11.1.3.1 (page 53 of the pdf) your subcontractors will be required to carry CGL and AL limits of $2M per occurrence and $2M per aggregate and their policies must also stay in force fora 10 year period after substantial completion. Is this going be needed for all subcontractors? This seems excessive. D. Note that in 11.1.6 there is a requirement that the OCP policy be issued by the same insurance company that carries the Contractor's liability insurance. Neither of our in house companies (ACE or BAIC) can issue the OCP. Will the owner except a policy from a second carrier? Answer: PacTrust will negotiate specific contract points following receipt of all bid proposals with the successful bidder. Contractors are to submit a memorandum with any concerns they have regarding the draft contract form as outlined in the invitation to bid E. Has the money for this project been placed in escrow with the City of Coppell?What are our assurances that Austin Bridge & Road will receive payments? Answer: The contract for the entire project will be between PacTrust and the successful bidder. The contract will be financed from PacTrust's unsecured line of credit with Bank of America, which currently has a balance of $15 Million. Additional information regarding the funding source for the project and financial statements will be provided to the successful bidder.
