Date: 7/6/2009 4:26 PM Subject: Re: grading sets Robert, Its been my experience that a CLOMR does not have an expiration date if the FIRM mapping that it is based on does not change. From the preliminary Denton County FIRM update I don't see that our CLOMR would change. (Denton and Dallas County appeal periods closed on February 13, 2009 and these counties may require their DFIRMs to be reissued as revised preliminary maps and will probably be delayed further due to resolution of appeals and protests that have been submitted to FEMA.) On other projects, I have also processed only partial LOMR's based on a previous FEMA CLOMR and processed a second LOMR when the second portion of the project was completed. A 404 permit with the Corps of Engineers does have an expiration date but this project has no jurisdictional Waters of the US that are being impacted. I am not aware that the FEMA rules have changed. DiWanna called me and asked me to be sure that this was the case. She wanted me to emphasize that the CLOMR is only good for 2 years and that if it expires all necessary data will have to be resubmitted to the Corps of Engineers. There is the possibility that the rules could be changed and that the CLOMR might not be granted in the future. If you wish to complete the work for the CLOMR, several large trees along the bank of Denton Creek will have to be removed. The date on the CLOMR is May 2008 and the expiration date is May 2010 (2 years). If the work is not completed, then you will need to redo the entire process with FEMA. We understand about the time limit of 2 years after City approval. It is fully the intention of the Akula's to start the Commercial project in mid to late 2010, so the 2 year time limit should not come into play.
