Hello Robert,
We cannot allow fill/structures in the floodplain without a CLOMR that defines the scope, regardless of the
amount. If you do not want to carryoutthe scope of the CLOMR currently in existence, you will need new
documentation defining the new scope, which is the retaining wall, etc.
Otherwise, you can fulfill the requirements of the CLOMR we currently have on file.
You may want to look into requirements of a LOMA (Letter of Map Revision)

Per the contractor's response below, the owners would like to defer any work
on relating to the CLOMR until a later date. Please note that our grading
plan does show some minimal work below the base flood elevation (BFE) which
was recently adjusted upward to 447.0. At the original BFE of 445.1, all of
the work shown on the grading plan for the residence would be above the BFE.
The total amount of fill below the elevation of 447 should be less than 100

Robert,
You are correct. We do not wantto do the CLOMR atthis time. We
understand about the time limit of 2 years after City approval.
It is fully the intention of the Akula's to start the Commercial project in
mid to late 2010, so the 2 year time limit should not come into play.

Dan and Raj, I know that you told me you did not want to do any work related
to the CLOMR at this time. DiWanna called me and asked me to be sure that
this was the case. She wanted me to emphasize that the CLOMR is only good
for 2 years and that if it expires all necessary data will have to be
resubmitted to the Corps of Engineers. There is the possibility that the
rules could be changed and that the CLOMR might not be granted in the
future. Ifyou wish to complete the work forthe CLOMR, several large trees
along the bank of Denton Creek will have to be removed. Apparently the City
feels that it makes sense to do all of the dirt work now. Please let me know
