Per the instructions of our property management group, this should be given to the city's attorney and attached to the documents accomplishing this transaction to show that the Board has actually authorized this action. Project Engineer (972) 304-3681 »> <kbury99Calaol.com> 7/29/2009 10:57 PM »> Keith - In response to Ken Griffin's a-mail earlier today, I wanted to send you most of the information you will need to for the city's attorney to draft the Quit Claim documents for the transfer of the concrete improvements on the south side of Westminster Way from HOA to City of Coppell ownership. First, as Ken requested, the official name of the HOA is Asbury Manor Homeowners Association, Inc. as recorded with the State of Texas under our articles of incorporation. Second, Ken asked for the name, or names, of the person(s) that would be signing for the HOA. We have elected to have each of the five members of our Board of Directors to sign the deed, so you will need to know the following names and positions on the BOD: . ? Larry Kingsbury ? President ? Manibala Jonnalagadda ? Vice-President ? Jennifer Gunter ? Secretary ? John Pouwels ? Treasurer ? Moresh Damle ? Member At Large In addition, or Property Management Company, Cornerstone, has suggested that we provide a copy of the meeting minutes wherein the Board of Directors authorized this deeding to the City of Coppell. Larry Kingsbury Asbury Manor HOA 7/18/09 Asbury Manor HOA Board Meeting 0830-1000 Starbuck, Coppell, TX Meeting called by: Larry Kingsbury Type of meeting: Quarterly Attendees: Larry Kingsbury, Manibala Jonnalagadda, Jennifer Gunter, John Pouwels, Moresh Damle Minutes Agenda item: CC&R Violations Discussion: Presenter: Larry Kingsbury Discussion included need for information from Cornerstone regarding the protocol for how violations are handled (second notices, certified letters, etc). Is it possible for the Board to get a list of the violations issued each month? The Board discussed the possibility of allowing a third notice and then assessing a daily fine. Board discussed the current lien status of both the Shaik's and Hemphill's homes. Board discussed the possible options for proceeding with the Hemphill home since their past due assessments fall under both the new and old CC&Rs. There was also discussion regarding whether Cornerstone currently surveys the backside of homes along the hike and bike trail for CC&R violations. Conclusions: Decision was made to contact Gary Josephson with Cornerstone to determine the management company's standard protocol for issuing and enforcing violations. Determine if the Board can receive a monthly list of notified homeowners. Board voted unanimously (Vote: 5-0) to allow Cornerstone to enforce the CC&Rs to the letter for homeowners at 521 Abbey Court. Action items Person responsible Deadline / Contact Cornerstone regarding standard protocol for CC&R violations and determine if they are/will survey hike and bike, fences, etc. / Proceed with enforcement for 521 Abbey Court / Determine options for enforcement for 704 Westminster Way Agenda item: National Night Out Discussion: See Larry Kingsbury document above Cornerstone Board and Cornerstone Presenter: Mani and Larry Board discussed food and entertainment for NNO to be held in October. Discussed provision of food (other than pizza) with consideration for apot-luck and grilled items (veggies and brats, etc). Discussed use of a "bounce house" as well as the liability for providing such entertainment. It was determined that Mani would be the HOA/Neighborhood Captain for NNO. Conclusions: Mani is to determine needs and propose a plan and budget to host Asbury Manor's NNO. Mani will be the NNO Captain for Asbury Manor. Will need to contact our Insurance agent to determine liability for bounce house. Action items Person responsible Deadline / Contact our Insurance agent and Cornerstone to try to determine who ?? holds liability for the bounce house. / Make decision regarding food. Board / Contact Officer Harr with City of Coppell Police Department Mani / Provide proposed plan and budget to host NNO. Mani Agenda item: Replacing entrance trees Discussion: Presenter: John Pouwels Discussed whether to replace the four dead Bradford Pears that were removed from the Asbury Manor entrance at North Coppell and Westminster Way. Consider replacing with Crepe Myrtles or Gem Magnolias. Conclusions: To check with Jay Savage (and possibly others) regarding cost to replace the 4 trees. Action items Person responsible Deadline / Get bids from Jay Savage (and others) regarding cost to replace John Pouwels trees. Agenda item: Canal (dredging and deeding of south stone portion) Presenter: Larry Kingsbury Discussion: Board was updated on the status of City's discussion with The Mansions regarding dredging of the canal. Larry reported that per Clay Phillips, the City has taken legal action against The Mansions for failure to comply. City to send a bid to the Board for dredging of the canal. Asbury Manor will pay a pro rata based on square foot dredged for our portion of the canal. Larry also reported that the City has drawn up an ordinance for purchase of the south stone canal. Conclusions: Board agreed that prompt action for approval of payment will be necessary once the City provides a bid for the dredging. Board voted unanimously (Vote: 5-0) to deed over the south stone canal to the City at no cost (or minimum cost required). The deed would grant the City with ownership, liability, and maintenance of the stone canal south of Westminster Way.
