Dear Mr. Witt:
As you know we have tried to get together over the past few months to discuss the above
referenced project. As we have been unable to schedule some time together, I thought it
might be appropriate to send you a summary of some of the issues on the project that
need to be finalized to close the project.
HDR has a remaining fee in the amount of $6,540 which has not been invoiced to the City.
However, there is the remaining HDR Task of preparing "as-recorded" drawings in order
to earn the remaining fee. This task cannot be completed without information being
provided by the City to HDR. The City should have received this information from the
Construction Contractor upon completion of construction. We have requested this
information verbally on several occasions. Upon receipt of the information, we will be
glad to prepare as-recorded drawings, and then invoice the City for the remaining fee. As
an alternate, if the City does not want us to prepare the as-recorded drawings, please let
us know and we will close the project and forgo any remaining fee.
During construction of the above referenced project it was determined that a portion of
the line had to be altered due to field conditions differing from as-built drawings furnished
bv the City. HDR prepared an alternate design at no cost to the City based upon an
a~reed alternative. In addition, HDR sent the City a check in the amount of $5,709 as a
contribution to assist in construction of the sewer line where the design had to be
modified. Upon completion of this design but prior to construction, it was discovered
that the field conditions were different from that determined by HDR and the City in a
previous field inspection. At that time HI)R offered another alternative design concept
and offered to prepare the design at no cost to the City and allow the City to use the
$5,709 contribution for this alternate.
In a letter dated August 26, 1996, Mr. Ken Griffin, Assistant City Manager/City Engineer
returned the HDR check, and requested that we state our position on financial
contribution to this project prior to the City committing to relocating sewer lines.

In a letter dated August 30, 1996 to Mr. Griffin from Mr. Joe Ezzell, HDR Project
Manager, we reconfirmed our willingness to redesign the line at no additional cost to the
City, and to make available the previously committed $5,709 contribution for the alternate
construction.
Since that letter of August 30, 1996 we have not received a reply from the City, and we
have been unable to find a time when you and I can discuss this matter. Will you please
review these issues and contact me so that we can resolve them to our mutual satisfaction,
